Notiﬁ cation

No. TPS-1116/143/CR-93/2019/UD-9.– Whereas, the Government in Urban Development

Department vide Notiﬁ cation No.TPS-1115/181/C.R.111/2015/UD-09, dated 6th January 2016 has

Partly sanctioned the Second Revised Development Plan for Igatpuri City (Original Limit) (hereinafter

referred to as "the said Development Plan") under Section 31 (1) of the Maharashtra Regional Planning

and Town Planning Act, 1966 (Mah. Act No.XXXVII of 1966) (hereinafter referred to as "the said Act")

and the same has come into force with eﬀ ect from dated the 20th May 2016 ;

and whereas, in the said Development Plan, land bearing Gat No. 82-A Pt., admeasuring @ 0.34

Hectares of Mouje lgatpuri (hereinafter referred to as "the said Land") is reserved as "Home Guard

Oﬃ ce" (hereinafter referred to as "the said Reservation") and the appropriate authority for the said

Reservation is Home Guard Department ;

and whereas, the said appropriate authority requested to delete the Reservation on the said Land

as the same being not feasible and no budget provision for acquisition of the said Land and instead

grant the government land bearing Survey No. 639/A for the said Reservation. In view of this, the

Igatpuri Municipal Council being the Planning Authority for the said Development Plan (hereinafter

referred to as "the said Planning Authority") vide it's General Body Resolution No. 843, dated 31st

May 2017 resolved to modify the said Development Plan by deleting the area admeasuring 0.364

Hectare of land bearing S.No. 82-A/1 from the said Reservation and to be included in Residential

Zone (hereinafter referred to as "the said Modiﬁ cation Proposal") by carrying out a modiﬁ cation to the

said Development Plan by following all the legal formalities stipulated under the said Act, forwarded

the proposal to Government for sanction vide letter dated 26th November 2017 ;

and whereas, after making necessary enquiries and consulting the Director of Town Planning,

Maharashtra State, Pune the Government is of the opinion that the Proposed Modiﬁ cation should be

sanctioned with some changes ;

and whereas, the land owners of the land bearing S.No. 82-A/1 Pt., for an area of 0.33 Hectares

as per the Government Policy have deposited Rs. 4,80,975/- towards the 50 per cent Government

share of premium amount as per the 5 per cent rate of the said Land as prescribed in the Annual

Statement of Rates (ASR) for the year 2024-25 in the Government Treasury on 26th August 2024

through the Assistant Director of Town Planning, Nashik Branch, Nashik and remaining 50 per cent

Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37

of the said Act, the Government hereby, sanctions the Proposed Modiﬁ cation and for that purpose

amends the aforesaid Notiﬁ cation dated 6th January 2016.

"In the Schedule of Modiﬁ cations appended to the Notiﬁ cation dated 6th January 2016 sanctioning

the said Development Plan, the following new entry shall be added after the last entry".

"Out of total area admeasuring 3400 sq. mtrs. of land bearing S. No.82-A/1 Pt. of Mouje Igatpuri

taluka Igatpuri, district Nashik under reservation, an area admeasuring 100.00 sq. mtrs. on eastern

side is kept reserved and remaining area under reservation is deleted and land thus released, is

included in Residential Zone as shown on the Plan".

No. TPS-3524/944/C.R. 101/2024/UD-9.– Whereas, Development Plan of Parola City (Second

Revised) has been sanctioned by the Government vide Urban Development Department’s Notiﬁ cation

No. TPS-3520/609/CR-95/2020/Part Sanction/UD-9, dated 22nd October 2020 and has come into force

with eﬀ ect from dated 4th December 2021 (hereinafter referred to as “the said Development Plan”)

under Section 31 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Mah. Act

No. XXXVII of 1966) (hereinafter referred to as “the said Act”) ;

and whereas, in the said Development Plan, land bearing Gat No. 155 Pt., Gat No. 194 Pt.,

Gat No. 195 Pt. and Gat No. 196 Pt. area admeasuring @ 1.00 hectare of Mouje Parola (hereinafter

referred to as “the said Land”) is reserved as Site No. 44 “Garden” (hereinafter referred to as “the

said Reservation”) ;

and whereas, the Parola Municipal Council, Parola being the Planning Authority (hereinafter

referred to as “the said Planning Authority”) vide it’s Administrative Resolution No. 28, dated 20th

October 2023 has resolved to delete the Reservation on the land bearing Gat No. 155 Pt. out of

the said Land and reserve the same as Municipal Council Pumping Station and Solar Project and

accordingly after after following all the legal procedure laid down under the said Act vide it’s letter

dated 13th March 2024 submitted to the Government for it's sanction, a modiﬁ cation proposal as per

the provisions of sub-section (1) of Section 37 of the said Act (hereinafter referred to as “the said

Proposed Modiﬁ cation”) ;

and whereas, after making necessary enquiries and consulting the Director of Town Planning,

Maharashtra State, Pune, the Government is of the opinion that the Proposed Modiﬁ cation should

be sanctioned with condition.

Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of

the said Act, the Government hereby sanctions the said Proposed Modiﬁ cation and for that purpose

amends the aforesaid Notiﬁ cation as follows.

In the Schedule of Modiﬁ cations appended to the Notiﬁ cation, sanctioning the said Development

Plan, the following new entry shall be added after the last entry.–

“The Reservation on area admeasuring 0.50 hectare of land bearing Gat No. 155 (Pt.) of mouje

Parola is deleted from Site No. 44 “Garden” and land so released is reserved as Municipal Council

Pumping and Solar Project as shown on the Plan subject to following condition”.

Condition

Out of the total area admeasuring @ 1.00 Ha., reserved under Site No. 44 “Garden”, the possession

of the remaining area under reservation except 0.50 hectare area of Gat No. 155 (Pt.), shall be taken by

the Municipal Council and same me be developed as public amenity having dense tree forestation.

A copy of the Notiﬁ cation along with the Part Plan showing the aforesaid sanctioned Modiﬁ cation

shall be available for inspection of the General Public, in the Oﬃ ce of the Chief Oﬃ cer, Parola Municipal

Council, Parola during oﬃ ce hours on all working days for a period of one month.

sanctioned the Development Plan for (Original + Excluded limits of Nandurbar City (hereinafter referred

to as “the said Development Plan”) under Section 31 (1) of the Maharashtra Regional Planning and

Town Planning Act, 1966 (Mah. Act No. XXXVII of 1966) (hereinafter referred to as “ the said Act”)

and the same has come into force with eﬀ ect from dated the 30th April 2007 and Excluded Part of the

said Development Plan has been sanctioned under Section 31 (1) of the said Act vide Government

in Urban Development Department Notiﬁ cation No. TPS-1507/2641/CR-87/08/UD-9, dated 31st August

2009 and the same has come into eﬀ ect from 15th October 2009 ;

and whereas, in the said Development Plan, the land bearing Survey No. 405 of Mouje Nandurbar

(hereinafter referred to as “the said Land”) is included in “Public / Semi-Public Zone” (hereinafter

referred to as “the said Zone”) ;

and whereas, the Nandurbar Municipal Council being the Planning Authority (hereinafter referred

to as “the said Planning Authority”) vide it’s General Body Resolution No. 29, dated 13th June 2021

has resolved to delete the area admeasuring 1.72 hectare of Hissa No. 2/1 of the said Land from

the said Zone to Residential Zone and after following the procedure laid down under the said Act,

submitted a Proposal to the Government, vide it’s letter dated 21st January 2022 for it's sanction

(hereinafter referred to as “the said Proposed Modiﬁ cation”) ;

and whereas, after making necessary enquiries and consulting the Director of Town Planning,

Maharashtra State, Pune, the Government is of opinion that the said Proposed Modiﬁ cation should

be sanctioned with certain conditions ;

and whereas, the Land Owner of Survey No. 405/2/1 out the said Land have deposited Rs.

3,10,000 towards the 50 per cent Government share of 5 per cent premium amount as per the rate

of the said Land as prescribed in the Annual Statement of Rates (ASR) for the year 2024-25 in the

Government Treasury on 3rd October 2024 through the Assistant Director of Town Planning, Nandurbar

Branch, Nandurbar and remaining 50 per cent of the 5 per cent premium amount of Rs. 3,10,000

payable to the Planning Authority has been deposited with the Chief Oﬃ cer, Nandurbar Municipal

Council, Nandurbar on 3rd October 2024.

Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of

the said Act, the Government hereby, sanctions the said Proposed Modiﬁ cation and for that purpose

amends the aforesaid Notiﬁ cation, dated the 14th March 2007 as follows.

In the Schedule of Modiﬁ cations appended to the Notiﬁ cation, dated 14th March 2007 sanctioning

the said Development Plan, the following new entry shall be added after the last entry –

ENTRY

The land bearing Survey No. 405/2/1 admeasuring 1.72 hectare of Mauje Nandurbar is deleted from

“Public / Semi-Public Zone ” and is included in “ Residential Zone ” as shown on the Plan, subject to the

conditions mentioned speciﬁ ed below.–

Condition No. 1 :– 10 per cent additional amenity space shall be provided in the layout in addition

to 10 per cent compulsory open space and amenity space as per the prevailing

Development Control Regulations for Nandurbar.

Condition No. 2 :– It is necessary to construct compound wall around the open space.

Condition No. 3 :– It is compulsory for the Land Owner / Developer to provide all the Basic Amenities

required for the land under modiﬁ cation at his own cost. The Basic Amenities

included as Road, Water Supply, Sewerage and Drainage etc.

Condition No. 4 :– As per the Uniﬁ ed Development Control and Promotion Regulations, construction

permission shall not be permissible where the area under modiﬁ cation has a slope of

1:5 or more.

Condition No. 5 :– lf the land is proposed to be developed by way of plotted layout, then sale of plots

under such layout shall be monitored by the Chief Oﬃ cer, Nandurbar Municipal

Council, Nandurbar in relation to development of Basic Amenities as per the stages

given below.

(a) After ﬁ nal approval of layout

Chief Oﬃ cer, Nandurbar Municipal Council, Nandurbar unless all the Basic Amenities are fully developed.

A copy of the submitted Notiﬁ cation / Development Plan part plan of the aforesaid sanctioned

Modiﬁ cation shall be available for Public inspection in the oﬃ ce of the Chief Oﬃ cer, Nandurbar Municipal

Council, Nandurbar during oﬃ ce hours on all working days for a period of one month.

This Notiﬁ cation shall also be available on the Government website www.maharashtra.gov.in

Notiﬁ cation

No. TPS-3523 / 96 / C.R.15 / 2024 / UD-9.– Whereas, the Government in Urban Development

Department vide Notiﬁ cation No. TPS-3515/39/C.R.21/2015/UD-9, dated 21st January 2016 has

sanctioned the Part of Development Plan of Chopda (Second Revised + Additional Area) (hereinafter

referred to as ‘the said Development Plan’) under Section 31 (1) of the Maharashtra Regional Planning

and Town Planning Act, 1966 (Mah. Act No.XXXVII of 1966) (hereinafter referred to as “the said Act”)

and the same has come into force with eﬀ ect from dated 20th February 2016 ;

and whereas, in the said Development Plan, land bearing Gat No. 43 Pt. and Gat No. 44 of

Mouje Chopda, taluka Chopda (hereinafter referred to as “the said land”) is included in “Agriculture

Zone” (hereinafter referred to as “the said Zone”) ;

and whereas, the Administrator of Chopda Municipal Council being the Planning Authority

(hereinafter referred to as “ the said Planning Authority” vide it's Order No. 2076, dated 14th September

2022 resolved to modify the said Development Plan by deleting the said Land from the said Zone

and to be included in Residential Zone (hereinafter referred to as “the said Modiﬁ cation Proposal”)

by carrying out a modiﬁ cation to the said Development Plan, by following all the legal formalities

stipulated under the said Act, forwarded the proposal to Government for sanction vide letter dated

16th December 2022 ;

and whereas, after making necessary enquiries and consulting the Director of Town Planning,

Maharashtra State, Pune, the Government is of the opinion that the proposed Modiﬁ cation should be

sanctioned subject to certain conditions ;

and whereas, the land Owners of the said land as per the Government policy have deposited

Rs. 9,01,950 towards the 50 per cent Government share of premium amount as per the 5 per cent rate

of the said Lands as prescribed in the Annual Statement of Rates (ASR) for the year 2024-25 in the

Government Treasury on 4th October 2024 through the Assistant Director of Town Planning, Jalgaon

Branch, Jalgaon and remaining 50 per cent of the premium amount Rs. 9,01,950/- payable to the

Planning Authority has been deposited with the Chief Oﬃ cer, Chopda Municipal Council, Chopda on 3rd

October 2024 ;

Now therefore, in exercise of the powers conferred on it under sub-section 2 of Section 37 of the

said Act, the Government hereby, sanctions the Proposed Modiﬁ cation as follows and for that purpose

amends the aforesaid Notiﬁ cation dated 21st January 2016.

“In the Schedule of Modiﬁ cations appended to the aforesaid Notiﬁ cation dated 21st January 2016

sanctioning the said Development Plan, the following new entry shall be added after the last entry–

ENTRY

“The land bearing Gat No. 43 Pt. and Gat No. 44 totally admeasuring 6.13 hectares of Mouje Chopda,

taluka Chopda, District Jalgaon is deleted from Agriculture Zone and land thus released, is included in

Residential Zone as shown on the plan, subject to the conditions mentioned speciﬁ ed below –

Condition No. 1 :– It will be compulsory to keep the area under existing Nalla and existing Cremation

Ground unaﬀ ected, while granting development permission.

Condition No. 2 :– It will be compulsory to continue the alignment of 12.00 meters Development Plan

Road passing through Gat Nos. 40 Pt. and 41 Pt., by proposing the same through

Gat No. 43 Pt. and Connecting to 24.00 meters wide Development Plan Road on

west of Gat No. 43.

Condition No. 3 :– It will be compulsory to provide additional 10 per cent Amenity space in addition to

the mandatory 10 per cent open Space and Amenity Space as per the applicable

Uniﬁ ed Development Control Regulations for Chopda City.

Condition No. 4 :– The land bearing Gat Nos. 45 and 46 are inside the land bearing Gat No.44 as

per Revenue Records and will not be desirable to keep it in Agriculture Zone from

Planning Point of view, Considering having a far less area and therefore the Proposal

of modiﬁ cation for conversion from Agriculture to Residential Zone may be carried

out, subject to consent of 5 per cent premium by the land owner's otherwise only

after the assurance of the approach road to land bearing Gat Nos. 45 and 46, the

necessary action in regard to layout sanction be carried out as per law.

Condition No. 5 :– The Compound is to be constructed surrounding the Boundary of “Open Space” .

Condition No. 6 :– It will be Compulsory to develop and provide all the required basic services/ amenities

by the land owner/developer at their cost. The Roads, Water Supply, Drainage and

Sewage treatment are covered in the basic amenities.

Condition No. 7 :– If the land is proposed to be developed by way of plotted layout, then sale of plots

under such layout shall be monitored by the Chief Oﬃ cer, Chopda Municipal Council,

Chopda in relation to development of basic amenities as per the stages given below.

No. TPS-1025 / 598 / CR-60 / 2022 / UD-9.– Whereas, the Government of Maharashtra in Urban

Development Department vide Notiﬁ cation No. TPS-1012/526(N)/Recon.62/CR-106(A)/2012/UD-9,

dated 28th December 2012 has sanctioned the second revised Development Plan of Dhule City

under Section 31 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966 (Mah. Act

No. XXXVII of 1966) (hereinafter referred to as “the said Act”) and the same has come into force

with eﬀ ect from 22nd June 2013 (hereinafter referred to as “the said Development Plan”) ;

and whereas, the Dhule Municipal Corporation is the Planning Authority for the said Development

Plan (hereinafter referred to as “the said Planning Authority”) ;

and whereas, in the said Development Plan land bearing Gat No.142 Pt. admeasuring @ 2.45

hectares of Mouje Mohadi, taluka-district Dhule (hereinafter referred to as “the said Land”) is reserved

as Site No. 174, “Housing for Urban Poor” (hereinafter referred to as “the said Reservation”);

and whereas, the said Planning Authority vide it's General Body Resolution No. 79, dated 25th

November 2019 has resolved to delete the area admeasuring 0.3375 hectare (45.0 Meter x 75.0 Meter)

out of the said Land from the said Reservation and reserve as “Cremation Ground” and accordingly

after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the

said Act, submitted a modiﬁ cation proposal to the Government, for it's sanction vide it's letter dated

12th February 2021 (hereinafter referred to as “the said Proposed Modiﬁ cation”) ;

and whereas, after making necessary enquiries and consulting the Director of Town Planning,

Maharashtra State, Pune, the Government is of opinion that the Proposed Modiﬁ cation should be

sanctioned with certain conditions ;

Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of

the said Act, the Government hereby sanctions the said Proposed Modiﬁ cation and for that purpose

amends the aforesaid Notiﬁ cation dated 28th December 2012 as follows.

“In the Schedule of Modiﬁ cations appended to the Notiﬁ cation dated 28th December 2012

sanctioning the said Development Plan the following new entry shall be added after the last entry”.–

Out of total area admeasuring 2.45 hectares of Gat No.142 Pt. of village Mohadi, taluka-district

Dhule reserved for Site No. 174, “Housing for Urban Poor” an area admeasuring 0.3375 hectares

(45.0 Meter X 75.0 Meter) is deleted from the said Reservation and reserved as “Cremation Ground”

as shown on the Plan, subject to the condition mentioned speciﬁ ed below–

Condition No. 1 : The Dhule Municipal Corporation shall conﬁ rm about the availability of access road

of minimum width of 9.00 meter for the proposed use, as per Uniﬁ ed Development

Control and Promotion Regulations.

Condition No. 2 : It shall be binding to follow the Instructions strictly as mentioned in Government,

Urban Development Circular dated 24th January 1983, regarding leaving Open

Belt around Burial and Cremation Grounds.

A copy of the said Notiﬁ cation, along with the part plan showing the aforesaid sanctioned modiﬁ cation,

shall be available for inspection of the general public, in the oﬃ ce of the Commissioner, Dhule Municipal

Corporation, Dhule during oﬃ ce hours on all working days for a period of one month.

Development Department vide Notiﬁ cation No. TPS-1191/35/CR-88/UD-9, dated 28th June 1993 has

sanctioned the Development Plan of Nashik City (hereinafter referred to as “üthe said Development

Plan”) partly under Section 31 (1) of the Maharashtra Regional Planning and Town Planning Act, 1966

(Mah. Act No. XXXVII of 1966) (hereinafter referred to as “üthe said Act”) and the same came into

force with eﬀ ect from the 16th November 1993 and the excluded part of the said Development Plan

has been sanctioned under Section 31 (1) of the said Act vide Notiﬁ cation No. TPS-1191/35/CR-88/

UD-9, dated 15th May 1995 and the same came into force with eﬀ ect from the 29th June 1995 ;

and whereas, in the said Development Plan, land bearing Survey No. 84 of Mouje Nashik

(hereinafter referred to as “üthe said Reserved Land”) are reserved as Site No. 296- “üPlayground” and

Site No. 297- “Primary School” (hereinafter referred to as “üthe said Reservationü”) and the Appropriate

Authority for the said Reservation is Nashik Municipal Corporation (hereinafter referred to as the “üsaid

Authority”) ;

and whereas, the various owners of the said Reserved Land has served a Notice dated 24th

August 2015 for the said Reservation under Section 127 (1) of the said Act (hereinafter referred to

as “üthe said Notice”) ;

and whereas, even after service of the said Notice as aforesaid, the said Land has not been

acquired within stipulated time limit from the date of the service of said Notice under sub-section (1)

of Section 127 of the said Act by the said Authority ;

and whereas, in the mean-time the Government of Maharashtra in Urban Development Department

vide Notiﬁ cation No. TPS-1116/CR-140(A)/UD-9, dated 9th January 2017 has sanctioned the Revised

Development Plan of Nashik City (hereinafter referred to as “üthe said Revised Development Plan”)

partly under Section 31 (1) of the said Act and the same came into force with eﬀ ect from the 9th

February 2017;

and whereas, in the said Revised Development Plan, the said Land along with other lands

is reserved for the said Authority as Site No.121- “üPlaygroundü” and Site No. 122- “üWater Works”

(hereinafter referred to as “üthe said Revised Reservation”) ;

and whereas, now it becomes expedient to notify by an order under Section 127 (2) of the said

Act that the said Reservation on the said Land, in the said Development Plan has been lapsed ;

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the

said Act, and of all other powers enabling it in that behalf, the Government of Maharashtra, hereby

notiﬁ es that the said Reservation on the said Land stands lapsed from the said Development Plan

and Consequently the said Revised Reservation on the said Land, in the said Revised Development

Plan has become redundant the said Land so released shall be available to the landowner for the

purpose of Development as otherwise permissible in the case of adjacent land under the said Revised
