अधिि˜नि�यम, १९६१ (१९६२ चाा महाा. तीन) चे प्रकरण सहाा, जे अधिि˜सूचनाा क्रमांं�क आयडीीसीी २००६/(४९२)/उद्योोग-१४, दि�नांं�क २६

सप्टेंंबर २००६ अन्वयेे महााराष्ट्र शाासनााने सदर अधिि˜सूचनेेच्या अनुसूचि�त उल्लेखिि‡लेल्या क्षेेत्राात महााराष्ट्र औद्योोगि�क वि�काास अधिि˜नि�यम,

१९६१ (सन १९६२ चाा महााराष्ट्र अधिि˜नि�यम तीन) चे कलम सहाा, दि�नांं�क २९ सप्टेंंबर २००६ रोजी अंमलाात आणले होते व उक्त

अधिि˜नि�यमााच्या आधारे मौजे आंबी, ताालुकाा माावळ, जि�ल्हा पुुणे येथीथीील उक्त अनुसूचि�त नमूूद केलेले क्षेेत्र अधिि˜नि�यमााच्या कलम २, खंड

(ग) अन्वयेे औद्योोगि�क क्षेेत्र म्हणूून जाहीर केलेले आहे;

आणि� ज्याअर्थीी, उपवि�भाागीय अधिि˜काारी, माावळ-मुळशी उप-वि�भााग, जि�ल्हा पुुणे यां�नीी उक्त अधिि˜नि�यमाातील कलम ३२ च्या पोट-

कलम १ नुसार, भााग एक - पुुणे वि�भाागीय पुुरवणीी, पृष्ठ क्र.२० वर दि�नांं�क ४ जून २०१९, च्या महाारााष्ट्र शाासनाच्या रााजपत्रात नोटीस

क्रमांं�क भूसंपादन/एसआर-१०/२०१७, दि�नांं�क १३-१९ जून २०१९ रोजी प्रसि�द्ध करून, उक्त औद्योोगि�क क्षेेत्राासाठी भूसंपादन प्रक्रि�या

सुरु केली आहे आणि� उक्त कलम ३२ च्या पोट-कलम ४ नुसार उक्त नोटीसेत नमूूद केलेले क्षेेत्र सर्ववभाार मुक्त होऊन राज्य शाासनााच्या

ठायी नि�हि�त

झााले आहे;

आणि� ज्याअर्थीी, या सोबत जोडलेेल्या अनुसूचि�तीील जमि�नीीचाा (यापुुढेे जि�चाा उल्लेख उक्त जमीन असा करण्यात येईल) तााबा

राज्य शाासन किं�ंवाा त्याच्या वतीीने घेेण्यात आलेला नााही आणि� उक्त जमीन उक्त काायद्याच्या प्रयोजनाासाठी आवश्यक नााही असे राज्य

शाासनााचे मत झााले आहे.

त्याअर्थीी आताा, उक्त अधिि˜नि�यमााच्या कलम ३२ च्या पोट-कलम (४) मधीील परंंतुक व इतर अधिि˜काारांं�चाा वाापर करून राज्य शाासन

उक्त जमीन संपादनाातून कााढून घेेत आहे आणि� असे घोषिि¨त करीीत आहे की, ही सूचनाा महाारााष्ट्र शाासन रााजपत्रात प्रसि�द्ध झााल्यानंंतर

कलम ३२ च्या पोट-कलम (१) नुसार नोटि�स प्रसि�द्ध होण्याच्या लगतपूूर्वी उक्त जमीन जि�च्याकडेे नि�हि�त

होती त्या व्यक्ति�िकडेे ती त्यावेळी

अस्ति्तिĒित्वाात असतीील असे भाारां�नाा अधीन राहून पूर्ववलक्षी प्रभाावाासह पुुनर्नि�िहि�त

होईल.

NOTIFICATION

Maharashtra Industrial Development Act, 1961.

No.IDC.2020/(C.R.379)/IND-14.—Whereas, by Government Notification, Industries, Energy

and Labour Department, No. IDC.2006/(492)/IND-14, dated the 26th September 2006 issued under

sub-section (3) of section 1 of the Maharashtra Industrial Development Act, 1961 (Mah.III of 1962)

(hereinafter referred to as ‘‘the said Act ”), the Government of Maharashtra has appointed the 29th

September 2006, to be the date from which the provisions of Chapter VI of the said Act shall take

effect in certain areas in village Ambi, Taluka Maval, District Pune mentioned in the Schedule

appended to the said notification and declared the said area as an industrial area under clause (g)

of section 2 of the said Act;

And whereas, the Sub-Divisional Officer, Maval-Mulshi Sub-Division Pune, District Pune

has by issuing notice No. भूसंपादन/एसआर-10/2017, dated 4th June 2019, published in the Maharashtra

Government Gazette, Part I Supplementary, Pune Divisional Supplement, Ordinary, dated 13-19th

June 2019, on pages 20, under sub-section (1) of section 32 of the said Act , acquired the lands in the

said industrial area, and as such, the lands mentioned in the said notice have vested absolutely in

the State Government free from all encumbrances under sub-section (4) of said section 32;

And whereas, the actual possession of the lands mentioned in the Schedule appended hereto

(thereinafter referred to as “ the said lands”) was not taken by or on behalf of the State Government

and it appears to the State Government that the said lands is no more required for the purpose of

the said Act.

Now, therefore, in exercise of the powers conferred by the proviso to sub-section (4) of section

32 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra

hereby withdraws the said land from acquisition and declares that, on the publication of this Notice

in the Maharashtra Government Gazette, the said land shall re-vest with retrospective effect in the

person in whom it was vesting immediately before the publication of the notice under sub-section (1)

of said section 32, subject to such encumbrances, if any, as may be subsisting at that time.
