ùयाअथȯ, महाराđł झोपडपƾी (सुधारणा, िनमूɑलन आिण पुनिवɑकास) अिधिनयम, १९७१ चे कलम ३ब ÷या पोट-कलम (३) अनुसार

झोपडपƾी पुनवɑसन Ōािधकरणाने झोपडपƾी पुनवɑसन योजना तयार कȠन िदनांक ९ एिŌल १९९८ रोजी राजपŇात Ōिसǌ कɁली आहे ;

ùयाअथȯ, महाराđł झोपडपƾी (सुधारणा, िनमूɑलन आिण पुनिवɑकास) अिधिनयम, १९७१ चे कलम ३ (क) उप-कलम (१)

अनुसार “झोपडपƾी पुनवɑसन ȦेŇ” घोिषत करĀयाचे अिधकार मुóय कायɑकारी अिधकारी, यांना आहेत.

āयाअथȯ, उòत कलम ३ (क) चे उप-कलम (१) मधील अिधकाराचा वापर कȠन मी, खालीलŌमाणे अनुसूचीमĄये दशɑिवलेले

ȦेŇ “झोपडपƾी पुनवɑसन ȦेŇ” Ċहणून याǑारे घोिषत करीत आहे. सदरचे ȦेŇ बृहąमुंबई िवकास िनयंŇण व Ōोāसाहन िनयमावली, २०३४

चे िनयम ३३ (१०) अąवये झोपडपƾी पुनवɑसन योजना दाखल करĀयास पाŇ आहे.

NOTIFICATION

No. SRA,B/ED/OW/3C(1)/Shree Vinayak CHS (prop)/Mulund (E)/T/2025/4826.—Whereas, the

Slum Rehabilitation Authority has formed Slum Rehabilitation Scheme under the provision of section

3B (3) of Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 and

published in Gazette on 9th April 1998 ;

Whereas, in view of the provision of section 3C (1) of the Maharashtra Slum Areas (Improvement,

Clearance and Redevelopment) Act, 1971 the Chief Executive Officer, Slum Rehabilitation Authority

is empowered to declare any area as “Slum Rehabilitation Area”.

Therefore, in view of the said provision of section 3C (1) of the Maharashtra Slum Areas

(Improvement, Clearance and Redevelopment) Act, 1971. I, undersigned is hereby declare the area

shown in schedule as “Slum Rehabilitation Area”. Now, the said area is open to submit scheme of

slum rehabilitation as per regulation 33 (10) of Development Control and Promotion Regulation,

2034 of Greater Mumbai.

िटपीएस-१२९६/८४७/Ō.ĸ. १६२/९६/निव-१२, िदनांक १४ मे, १९९७ अąवये मंजूर झाली असून, ती िदनांक १५ जुलै, १९९७ पासून

अंमलात आली आहे आिण उòत िवकास योजने÷या वगळलेčया भागाची िवकास योजना शासन नगरिवकास िवभागाची अिधसुचना ĸ.

िटपीएस-१२९८/९४१/Ō.ĸ.८९/९८/निव-१२, िदनांक २५ ऑगĒट २००० अąवये मंजूर झाली असून, ती िदनांक १५ ऑòटोबर २०००

पासून अंमलात आली आहे (यापुढɂ ùयाचा एकिŇतपणे उčलेख "उòत अिधसूचना" असा करĀयात आला आहे);

आिण ùयाअथȯ, िमरा-भाʚदर महानगरपािलकɁची ŌाȠप सुधाȫरत िवकास योजना कलम २६ अąवये, िदनांक २७ ऑòटोबर २०२२

रोजी Ōिसǌ होऊन ती अिधिनयमाचे कलम ३० खालील तरतुदीनुसार िनयुòत अिधकारी तथा सहायक संचालक नगररचना, ठाणे शाखा,

ठाणे िजčहा यांनी िदनांक २५ नोďहɞबर २०२३ रोजी मंजुरीसाठी शासनास सादर कɁलेली आहे.

आिण ùयाअथȯ, िमरा-भाʚदर महानगरपािलका ȦेŇातील भाʚदर (पȬĐचम) बालाजी नगर, िवनायक नगर, महाराणा Ōताप मागɑ,

Ōकाश माकɩट, कमला पाकɒ, इंिदरा माकɩट, ďयंकटɂश पाकɒ, मोतीनगर, डॉ. बाबासाहेब आंबेडकर मागɑ, मॅòसेस मॉल भागातील पावसाचे

पाणी जाĀयासाठी भाʚदर (पȬĐचम) रेčवे समांतर नाला हा एकमेव नाला असून, सदर नाčयातून पावसाचे पाणी िमरारोड (पȬĐचम) रेčवे

समांतर व नाझरेथ आगार झोपडपƾी येथून जाफरी खाडीत जाऊन िमळते. महानगरपािलकɁ÷या बांधकाम िवभागाकडȴन पावसाळयापुवȯ

सदर पȫरसरामĄये पाĀयाचा िनचरा होĀयासाठी ताāपुरāया Ēवȟपात नाला तयार करĀयात येतो, तथािप सदर पȫरसरामधील िमरारोड

(पȬĐचम) भागातील सदर नैसिगɑक पाणी जाणारा नाला कायम राहĀयासाठी मंजूर िवकास योजनेत नाला दशɑिवणे आवĐयक असčयाचे

महानगरपािलकɁचे बांधकाम िवभागाने कळिवले आहे.

आिण ùयाअथȯ, िमरा-भाʚदर शहरा÷या ŌाȠप िवकास योजनेमĄये दशɑिवčयानुसार अȬĒतāवातील पुवɑ-पȬĐचम नाला हा पुढɂ िमरारोड

रेčवे Ēटɂशनकडɂ जातो तर इतर एक नाला हा देखील पुवɑ-पȬĐचम वाहत जावून पुढɂ तो रेčवे समांतर खाडीला िमळत असून सदर िमरारोड

Ēटɂशनकडɂ जाणारा नाला पुढɂ रेčवे Ēटɂशन व रेčवे लाईन असčयाने सदर पȫरसरामĄये पाĀयाचा िनचरा होत नसčयाने सदर दोąही नाले

एकमेकास जोडले गेčयास रेčवे Ēटɂशनकडɂ जाणारे पाणी हे काही Ōमाणात उपरोòत नमूद कɁčयानुसार ताāपुरāया Ēवȟपात वळवĀयात

येणाķया नाčया÷या िठकाणामधून खाडीकडɂ जाऊ शकते āयामुळɂ रेčवे Ēटɂशन पȫरसरामĄये पाणी तुंबून राहणार नाही ही बाब व बांधकाम

िवभागाने नमूद कɁčयानुसारची बाब िवचारात घेता सुधाȫरत ŌाȠप िवकास योजना अǐाप मंजूर झाली नसčयाने व िमरारोड पȬĐचम भागातील

पाणी तुंबĀयाची शòयता िवचारात घेता नैसिगɑक पाणी वाहून जाणेकȫरता कायम Ēवȟपात नाला ŌĒतािवत करणे आवĐयक असčयाने मंजूर

िवकास योजनेत āयानुसार फɁरबदल करणे आवĐयक असून ŌाȠप िवकास योजना मंजुरीसाठी लागणारा कालावधी िवचारात घेता मंजूर

िवकास योजने÷या नकाशावर दोन नाčयाला जोडणार नाला A TO B अशी ७.०० मी. ȟंदी दशɑिवčयानुसार नाला ŌĒतािवत करणेकामी

मंजूर िवकास योजनेमĄये कलम ३७ (१) अąवये फɁरबदल कायाɑȬąवत करणे आवĐयक आहे.

आिण ùयाअथȯ, िमरा-भाʚदर महानगरपािलकɁने Ōशासकीय ठराव ĸ.४०१, िदनांक २८ जानेवारी २०२५ अąवये उòत अिधिनयमाचे

कलम ३७ (१) नुसार मंजूर िवकास योजनेमĄये फɁरबदल ŌĒतािवत करĀयाचे ठरिवले आहे. यापुढɂ “उòत ŌĒतावीत फɁरबदल" असे

संबोधĀयात येत आहे.

उपरोòत नमूद “उòत ŌĒतावीत फɁरबदलाबाबत" ùया नागरीकांना हरकती िकȽवा सूचना ǐावया÷या असčयास āयांनी हरकती / सूचना

लेखी Ēवȟपात सदरची सूचना शासन राजपŇात Ōिसǌ झालेčया िदनांकापासून ३० िदवसा÷या मुदतीपयɕत सादर कराďयात, Ċहणजे सदर

फɁरबदला÷या ŌĒतावास अंितम Ēवȟप देĀयापूवȯ उòत सूचना / हरकतȮचा िवचार करता येऊ शकɁल.

ŌĒतािवत फɁरबदल दशɑिवणारा दशɑिवणारा नकाशा जनते÷या अवलोकनासाठी व मािहतीसाठी, महानगरपािलका, मुóय कायाɑलयात

व नगररचना िवभागामĄये कायाɑलयीन वेळɂत ठɂवĀयात आला आहे.

(UNDER SECTION 37(1) OF MAHARASHTRA REGIONAL AND TOWN PLANNING

ACT, 1966).

ĸमांक िमभा/मनपा/नर/३९२६/२०२४-२०२५.—Whereas, the Development Plan of the city of Mira-

Bhayander (hereinafter referred to as "the said Development Plan") has been sanctioned by the

Government in Urban Development Department, under section 31(1) of the Maharashtra Regional and

Town Planning Act, 1966 (hereinafter referred to as "the said Act") vide Notification No.TPS-1296/847/

CR- 162/96/UD-12, dated the 14th May, 1997 (hereinafter referred to as "the said Notification") and

has come into force with effect from 15th July, 1997 and the Excluded Part of the said Development

plan has been sanctioned by the Government in Urban Development Department vide Notification

No. TPS-1298/941/CR-89/98/UD-12, dated the 25th August, 2000 which came into fo ce with effect

from the 15th October, 2000.;

And Whereas, The revised draft development plan for Mira-Bhayandar Municipal Corporation

has been published under Section 26 of the Maharashtra Regional Planning and Town Planning

Act, 1966 (hereinafter referred to as "the said Act") and submitted to the Government for approval

under Section 30 of the said act.

And Whereas, in the Mira-Bhayandar Municipal Corporation area, Railway Parallel Nallah is

the only drain for rainwater to flow for Bhayandar (West), Balaji Nagar, Vinayak Nagar, Maharana

Pratap Marg, Prakash Market, Kamala Park, Indira Market, Venkatesh Park, Motinagar,

Dr. Babasaheb Ambedkar Marg, Maxes Mall, the Bhayandar (West) area, and rainwater from this

drain flows into Jaffri Creek from Mira Road (West) Railway Parallel and Nazareth Agar Slum.

In this area the Municipal Corporation to contruct temporary structure to drain water in the area

before the mansoon season. However the public works department of the Mira-Bhayandar Municipal

Corporation to request natural water drain in Mira Road (West) area to remain permanent, it is

necessary to show nallah in the santioned development plan.

And Whereas, As shown in the revised draft development plan of Mira-Bhayandar Municipal

Corporation, the existing east-west drain further goes to Mira Road Railway Station. while another

drain also flows east-west and then meets the creek parallel to the railway. Since the drain leading

to the said Mira Road Station is further from the railway station and the railway line, there is no

drainage in the said area. If the said two drains are connected to each other, the water going to the

railway station can to some extent flow towards the creek through the temporary diverted drain as

mentioned above. Therefore, water will not remain stagnant in the railway station area. Considering

the fact that, the revised draft development plan has not been santioned yet and considering the

possibility of stagnant water in the western part of Mira Road, it is necessary to propose a permanent

drain for natural water flow, it is necessary to carry out the modification in the sanctioned development

plan under section 37(1) of the said act accordingly. Considering the time required for santion of the

draft development plan, a 7.00 m long drain A to B connecting the two drains is shown on the map

of the santion development plan. It is necessary to implement the modification under section 37(1)

in the sanctioned development plan to propose a drain of the width as shown.

Now therefore, Mira-Bhayandar Municipal Corporation has decided to carry out modification in

the sanctioned development plan as per section 37(1) of the said Act vide Administrative Resolution

No.401, Date 28th January 2025 hereinafter referred to as "the proposed modification".

ĸ. टीपीएस-१२९८/९४१/Ō.ĸ.८९/९८/निव-१२, िदनांक २५ ऑगĒट २००० अąवये मंजूर झाली असुन, ती िदनांक १५ ऑòटोबर

२००० पासून अंमलात आली आहे (यापुढɂ ùयाचा एकिŇतपणे उčलेख "उòत अिधसूचना" असा करĀयात आला आहे);

आिण ùयाअथȯ, उòत िमरा भाʚदर महानगरपािलका ȦेŇासाठी मंजुर िवकास योजनेतील मौजे नवघर येथील स.ĸ. ४४१ ही शासकीय

जागा मंजुर िवकास योजनेŌमाणे भागशः रिहवास व भागश: १८.०० मी. ȟंद िवकास योजना रĒāयाने बािधत होत आहे.

िमरा-भाʚदर महानगरपािलका ȦेŇाची ŌाȠप सुधाȫरत िवकास योजना सुधाȫरत करणेकामीची कायɑवाही िनयुòत अिधकारी तथा

सहायक संचालक, नगररचना, ठाणे शाखा यांचेमाफɒत सुȠ कȠन महाराđł Ōादेिशक िनयोजन व नगररचना अिधिनयम, १९६६ चे कलम

२६ अąवये ŌाȠप िवकास योजना Ōिसǌ कȠन ती कलम ३० अąवये शासनास मंजुरीसाठी सादर करĀयात आली असून सदर िवकास

योजनेमĄये स.ĸ.४४१ या जिमनीवर आ.ĸ. १९१ "Education Amenity” (E.A.) व आ.ĸ.१९२ “Skill Development

Centre" (SDC) हे आरȦण ŌĒतािवत आहे.

िवनंती अजाɑ÷या अनुषंगाने मा. िजčहािधकारी कायाɑलयाने िदनांक २६/०८/२०२४ रोजी÷या पŇाąवये महानगरपािलकɁकडɂ सदर शासकीय

जागेबाबत अिभŌाय अपेिȦलेले होते, āयाअनुषंगाने महानगरपािलकɁने सदर Ōकरणी िदनांक २९ ऑगĒट २०२४ रोजी÷या पŇाąवये

अिभŌाय कळिवले असून, तसेच मɞ एडȲयल एùयुकɁशन łĒट यांनी िदनांक ०५ जानेवारी २०२५ अąवये ŌाȠप िवकास आराखडयामĄये

दशɑिवलेčया आरȦणानुसार महाराđł Ōादेिशक व नगररचना अिधिनयम, १९६६ चे कलम ३७ (१) अąवये मंजूर िवकास योजनेमĄये

फɁरबदल कȠन फɁरबदल ŌĒताव शासनास सादर करणेची िवनंती कɁलेली आहे. याबाबत मंजूर िवकास योजनेमĄये ŌĒतािवत जागा

रिहवास िवभागात समािवđट असčयाने सदर जागेत ŌाȠप िवकास योजनेनुसार “Education Amenity". ȦेŇ ६६५१.०० चौ.मी. व

"Skill Development Centre" (SDC) ȦेŇ २१७५.०० चौ.मी. हे आरȦणे ŌĒतािवत करणेबाबत महाराđł Ōादेिशक व नगररचना

अिधिनयम, १९६६ चे कलम ३७ (१) अąवये फɁरबदल करणे आवĐयक आहे.

आिण ùयाअथȯ, िमरा भाʚदर महानगरपािलकɁने Ōशासकीय ठराव ĸ.४००, िदनांक २८ जानेवारी २०२५ अąवये उòत अिधिनयमाचे

कलम ३७ (१) नुसार मंजूर िवकास योजनेमĄये फɁरबदल ŌĒतािवत करĀयाचे ठरिवले आहे. यापुढɂ “उòत फɁरबदल" असे संबोधĀयात

येत आहे.

आिण āयाअथȯ, उपरोòत नमूद “उòत फɁरबदलाबाबत" ùया नागरीकांना हरकती िकȽवा सूचना ǐावया÷या असčयास āयांनी हरकती

/ सूचना लेखी Ēवȟपात सदरची सुचना शासन राजपŇात Ōिसǌ झालेčया िदनांकापासून ३० िदवसां÷या मुदतीपयɕत सादर कराďयात,

Ċहणजे सदर फɁरबदला÷या ŌĒतावास अंितम ĒवȠप देĀयापूवȯ उòत सूचना / हरकतȮचा िवचार करता येऊ शकɁल.

[UNDER SECTION 37(1) OF MAHARASHTRA REGIONAL AND TOWN PLANNING

ACT,1966].

ĸमांक िमभा/ मनपा/नर/३९२७/२०२४-२०२५ —Whereas, the Development Plan of the city of Mira-

Bhayander (hereinafter referred to as "the said Development Plan") has been sanctioned by the

Government in Urban Development Department, under section 31(1) of the Maharashtra Regional and

Town Planning Act, 1966 (hereinafter referred to as “the said Act”) vide Notification No.TPS-1296/847/

CR-162/96/UD12, dated the 14th May 1997 (hereinafter referred to as "the said Notification") and

has come into force with effect from 15th July 1997 and the Excluded Part of the said Development

plan has been sanctioned by the Government in Urban Development Department vide Notification

No. TPS-1298/941/CR-89/98/UD-12, dated the 25th August 2000 which came into force with effect

from the 15th October 2000.

And Whereas, Government land bearing S. No. 441 at Navghar comes partly under residential

zone and partly under 18.00 m. wide development plan road in the sanctioned development plan.

And Whereas, The revised draft development plan for Mira-Bhayandar Municipal Corporation

has been published under Section 26 of the Maharashtra Regional Planning and Town Planning Act,

1966 (hereinafter referred to as "the said Act") and submitted to the Government for approval under

Section 30. In the revised development plan, Government land S. No. 441 at Navghar is reserved

as Reservation No. 191 "Education Amenity" (E.A.) and Reservation No. 192 “Skill Development

Centre” (SDC).

And Whereas, In accordance with the request made by the Edual Education Trust to the

Hon'ble District Collector to provide 1.18.0 ha. land bearing the old S.No.441, new S.No.114 of

village Navghar for the educational purpose, the Hon'ble District Collector's had sought the opinion

of the Mira-Bhayandar Municipal Corporation regarding the said Government land vide letter dated

26/08/2024. Accordingly, the Municipal Corporation has given its opinion in this matter vide letter

dated 29th August 2024. Also, the Edual Education Trust vide letter dated 05/01/2025 has requested

the Corporation to iniciate the proposal for modification in the sanctioned said Development Plan

under section 37(1) of the said act to the Government as per the reservations shown in the revised

draft development plan. In this regard, since the proposed land is included in the residential zone in

the sanctioned development plan, it is necessary to carry out the modification under section 37(1) of

the said act in the sanctioned development plan and reserved the said land as "Education Amenity”,

area 6651.00 sq.m. And “Skill Development Centre” (SDC) area 2175.00 sq..m as per the revised

draft development plan.

Now therefore, Mira-Bhayandar Municipal Corporation has decided to carry out modification in

the sanctioned development plan as per section 37(1) of the said Act vide Administrative Resolution

No.400 Date, 28th January 2025 hereinafter referred to as "the proposed modification".

And accordingly, the citizens who have objections or suggestions regarding the above-mentioned

"proposed modification" should submit their objections/suggestions in writing within 30 days from

the date of publication of the said notice in the Government Gazette, so that the said suggestions/

objections can be considered before finalizing the proposal for the said modification.

The map showing the proposed modification has been kept for public inspection and information

at the Municipal Corporation, Head Office and Town Planning Department during office hours.
