म, १९९९.

क्रमांं�क एमपीीआय-२०१६/प्र.क्र.११९/पोल-११.— ज्याअर्थीी, प्लेथि�कोो फाार्मा�सि�टीीकल लि�. (यापुढेे "उक्त विि¦त्तििƫय संस्थाा" असे

संबोधिि˜ले आहे) ही विि¦त्तीय संस्थाा आणिि” सदर संस्थेेचे अध्यक्ष, संचाालक, व्यवस्थाापक आणिि” प्रवर्ततक किं�ंवा कर्ममचाारी यां�नीी ग्रााहकांं�कडूून

ठेेवी स्वि�िकाारल्या होत्या ;

आणिि” ज्याअर्थीी, उक्त विि¦त्तीय संस्थाा व सदर संस्थेेचे अध्यक्ष, संचाालक, व्यवस्थाापक आणिि” प्रवर्ततक यां�नीी ठेेवीदारां�नीी स्वि�िकाारलेल्या

ठेेवी मुदतपूूर्तीनंंतर परत करण्यास कसूूर केली असल्याने प्लेथि�कोो फाार्मा�सि�टीीकल लि�. यांं�च्याविि¦रूध्द एम.आय.डी.सी. पोलीस ठाणे येथेे

गु.र.क्र. ६२०/२०१५ (आर्थि�िक गुन्हे विि¦भााग गु. र. क्र. ६५/२०१५) नुसार भाारतीय दंड विि¦धान (१८६० चाा ४५) च्या कलम ४२०,

४०९ आणिि” ३४ भाा.द.विि¦. सह महाराष्ट्र ठेेवीदारांं�च्या (विि¦त्तीय संस्थाामधील) हि�तसंंबंधां�चेे संरक्षण अधिि˜नि�यम, १९९९ (महा. २०००

चाा १६) च्या कलम ३ व ४ अन्वये गुन्हा दाखल करण्यात आलाा आहे ;

आणिि” ज्याअर्थीी, महाराष्ट्र शाासनााची अशी खात्री झााली आहे की, उक्त विि¦त्तीय संस्थाा आणिि” सदर संस्थेेचे अध्यक्ष, संचाालक,

व्यवस्थाापक आणिि” प्रवर्ततक हे ठेेवीदारां�नाा त्यांं�च्या ठेेवी मुदतपूूर्तीनंंतर परत करण्यास अपयशी ठरले असून उक्त विि¦त्तीय संस्थााद्वाारे

ठेेवीदारांं�च्या ठेेवी परत करण्याची शक्यताा दि�सूून येत नााही ;

आणिि” ज्याअर्थीी, महाराष्ट्र शाासनाालाा, उक्त विि¦त्तीय संस्थेेने जमा केलेल्या ठेेवींमधून त्यांं�च्या स्वतःःच्या अथवाा अन्य व्यक्तीच्या

नाावे रक्कम व अन्य मालमत्ता संपादि�त करण्यात आली असल्याचे अभि�कथि�त

असल्याने उक्त विि¦त्तीय संस्थांं�मधील ठेेवीदारांं�च्या

हि�तााचे संरक्षण करण्यासाठी अशी रक्कम किं�ंवा अन्य मालमताा जप्त करण्याचे आणिि” अशाा जप्त रक्कम किं�ंवा अन्य मालमत्ता यांं�वर

नि�यंंत्रण ठेेवण्याकरि�ताा उप जि�ल्हाधिि˜काारी (अति�क्रमण/नि�ष्काासन), अंधेरी-१ तथाा सक्षम प्राधिि˜काारी यां�चीी सक्षम प्राधिि˜काारी म्हणूून

नि�युुक्ती करणे आवश्यक वाटतेे.

(यात यापुढेे ज्याचाा उक्त अधिि˜नि�यम असा नि�र्देेश करण्यात आलाा आहे) याच्या कलम ४ चे पोट-कलम (१) व कलम ५ चे पोट-

कॉपरिं�ंट ऑफि�स, शबमन हाऊस, तळ मजलाा, प्लॉट् नंं. ए/१५-१६, सेंट्रल क्रॉस रोड बी, एम.आय.डी. सी. पोलि�स स्टेशनच्या

मागे, अंधेरी (पूर्वव), मुंं�बई ४०० ०९३ असा असून या संस्थेेचे संचाालक यांं�च्या नाावे असलेली, सोबतच्या अनुसूचीत विि¦नि�र्दि�िष्ट

केलेली मालमत्ता जप्त करीीत आहे ; आणिि”

(आ)  अशाा जप्त केलेल्या रक्कम व अन्य मालमत्तेवर नि�यंंत्रण उप जि�ल्हाधिि˜काारी (अति�क्रमण/नि�ष्काासन), अंधेरी-१

यां�चीी सक्षम प्राधिि˜काारी म्हणूून नि�युुक्ती करीीत आहे.

Order

Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999.

No. MPI-2016/C.R.119/Pol-11.—Whereas, M/s. Plethico Pharmaceutical Ltd. (hereinafter referred

to as “the said Financial Establishments”), and its Chairman, Directors, Managers, Promoters,

Partners and its employees responsible for its management have received deposits from depositors

under the scheme to repay the deposits on maturity along with benefits promised thereof to the

depositors ;

And whereas, an offence has been registered against M/s. Plethico Pharmaceutical Ltd. and its

Chairman, Directors, Managers and Promotors at M.I.D.C. Police Station vide Complaint Register

No. 620/2015, (Ε.Ο.W No.65/2015) under sections 420, 409 and 34 of the Indian Penal Code (45 of

1860) read with sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial

Establishments) Act, 1999 (Mah. XVI of 2000), that they have collected the deposits and have failed

to repay the deposits to the depositors ;

And whereas, the Government of Maharashtra is satisfied that the said Financial Establishments

and its Chairman, Directors, Managers and Promoters has failed to repay the deposits and the said

Financial Establishments is not likely to return the deposits to the depositors ;

And whereas, the Government of Maharashtra considers it expedient to attach the monies or

other properties believed to have been acquired by said Financial Establishments and its Chairman,

Directors, Managers, Promoters and any other person, either in their own name or in the name of

any other person from out of the deposits collected by the said Financial Establishments, in order to

protect the interest of the depositors of the said Financial Establishments and to appoint the Deputy

Collector (Encroachment/Removal), Andheri-1 cum Competent Authority as the Competent Authority

to exercise control over the monies and the other properties attached.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4 and sub-section

(1) of 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act,

1999 (Mah. XVI of 2000), the Government of Maharashtra hereby.—

(a)  attaches properties in the name of M/s. Plethico Pharmaceutical Ltd. Address

A. B. Road, Manglia 453771. Indore (Madhya Pradesh) and Corporate Office - Shabnam House,

Lower Floor, Polt No. A/15-16, Central Cross Road B, Behind the M.I.D.C. Police Station,

Andheri (East), Mumbai 400 093 and Director as specified in the Schedule appended hereto; and

(b)  appoints the Deputy Collector (Encroachment/Removal), Andheri-1 cum Competent

Authority to be the Competent Authority to exercise control over the monies and other properties

attached.
