म, १९७१.

क्रमांं�क भूसंपाा-२०२५/प्र.क्र.७६/झोोपनि�-२.—ज्याअर्थीी, मुख्य कार्ययकारी अधिि˜कारी, मुं�बई महाानगर प्रदेश झोोपडपट्टीी पुनर्ववसन

प्राधिि˜करण, ठााणे यांं�च्या अभि�वेेदनााववरून महााराष्ट्र शासनाास असे दि�सूून आले आहे की, उक्त प्राधिि˜काऱ्यास यासोबत जोडलेल्या

अनुसूचीमध्ये (यात यापुढेे ज्याचाा नि�र्देेश उक्त अनुसूची असा करण्यात आला आहे.) नमूूद केलेल्या झोोपडपट्टीी पुनर्ववसन क्षेेत्रााववर

झोोपडपट्टीी पुनर्ववसन योजनाा राबवि�णेे शक्य व्हावेे म्हणूून उक्त अनुसूचीमध्ये वि�नि�र्दि�िष्ट केलेली जमीन (यात यापुढेे जि�चाा नि�र्देेश

उक्त जमीन असा करण्यात आला आहे.) संपाादीत करणे आववश्यक आहे ;

आणि� ज्याअर्थीी, महााराष्ट्र झोोपडपट्टीी (सु. नि�. वव पु.) अधिि˜नि�यम, १९७१ (महाा.१९७१ चाा २८) च्या प्रकरण I-A

च्या कलम ३ (D) (c) (i) च्या परि�च्छेेद (A) अन्वयेे सुधारणा करण्यात आलेल्या प्रकरण पााच मधीील कलम १४ च्या

पोट-कलम (१) (यात यापुढेे ज्याचाा नि�र्देेश उक्त अधिि˜नि�यम असा करण्यात आला आहे.) नुसार मुख्य कार्ययकारी अधिि˜कारी,

मुं�बई महाानगर प्रदेश झोोपडपट्टीी पुनर्ववसन प्राधिि˜करण, ठााणे यां�नीी बजावलेेल्या त्यांं�च्या क्र. झोोपुप्रा/सक्षम प्रा.४/भूसंपाादन ८७४/२०२४,

दि�नांं�क २६ सप्टेंंबर, २०२४ तसेेच “ठााणे वैैभवव वव लोकमत” या मरााठी वृृत्तपत्राात वव “द फ्रीी प्रेस जर्ननल” या इंंग्रजी वृृत्तपत्राात

दि�नांं�क २७ सप्टेंंबर, २०२४ रोजी जाहीर नोटीस प्रसि�द्ध करण्यात येवूून आणि� उक्त अधिि˜नि�यमांं�च्या कलम ३६ अन्वयेे, सदर क्षेेत्राात

सर्वांंɕनाा ठळकपणेे दि�सेेल अशा ठि�कााणी चि�कटवूून, उक्त अनुसूचीच्या स्तंभ (६) मध्ये नमुुद केलेल्या ज्या व्यक्ती, उक्त जमि�नीीचे

माालक आहेत वाा हि�तसंंबंधीय आहेत, अशा व्यक्तींनाा उक्त जमीन संपाादि�त करण्यासाठी शासनाास प्रस्ताावव का सादर करण्यात

येऊ नयेे, याबाबत उपरोोक्‍‍त नोटीस मि�ळााल्यापाासून वाा वृृत्तपत्राात नोटीस प्रसि�द्ध झाल्याच्या ताारखेेपाासून सात दि�वसांं�च्या कालावधीीत

कारणे दााखल करण्याबाबत फमाा�वि�लेे होते;

आणि� ज्याअर्थीी, मुख्य कार्ययकारी अधिि˜कारी, मुं�बई महाानगर प्रदेश झोोपडपट्टीी पुनर्ववसन प्राधिि˜करण, ठााणे यां�नीी संबंधिि˜त

झोोपडीीधारकांं�च्या सहकाारी गृहनि�र्मामाा�ण संस्थाा तसेेच जमि�नीीचे माालक वव हि�तसंंबंधीत यांं�च्या घेेतलेेल्या सुनाावणीीत, संबंधिि˜त

झोोपडीीधारकांं�च्या सहकाारी गृहनि�र्मामाा�ण संस्थेेचाा युक्तीवााद, अधिि˜कार अभि�लेेखांं�तील नोंंदी, उक्त जमि�नीीववर वि�काास आराखड्याानुसार

असलेले आरक्षण तसेेच संरक्ष‍ि�ित झोोपडीीधारकां�नीी सादर केलेली माागणी न्याय्‍‍य असल्याबाबत उक्त जमीन संपाादनााबाबतचेे अभि�वेेदन

मुख्य कार्ययकारी अधिि˜कारी, मुं�बई महाानगर प्रदेश झोोपडपट्टीी पुनर्ववसन प्राधिि˜करण, ठााणे यां�नीी राज्य शासनाास दि�नांं�क २४ एप्रि�ल,

२०२५ रोजी सादर केले आहे;

आणि� ज्याअर्थीी, उक्त अधिि˜नि�यमााच्या प्रकरण I-A च्या कलम ३ (D) (c) (i) च्या परि�च्छेेद (A) अन्वयेे सुधारणा

करण्यात आलेल्या प्रकरण पााच मधीील कलम १४ च्या पोट कलम (१) नुसार मुख्य कार्ययकारी अधिि˜कारी, मुं�बई महाानगर प्रदेश

झोोपडपट्टीी पुनर्ववसन प्राधिि˜करण, ठााणे यां�नीी सादर केलेले अभि�वेेदन, अहवााल वव त्यां�नीी या प्रकरणी केलेली कार्ययवाही राज्य शासनाास

उक्त अनुसूचीमध्ये नमूूद केलेल्या झोोपडपट्टीी पुनर्ववसन क्षेेत्रााच्या वि�काासासाठी झोोपडपट्टीी पुनर्ववसन योजनेअंतर्गगत वि�काास करणे शक्य

व्हावेे म्हणूून उक्त जमीन संपाादि�त करणे आववश्यक असल्याचे दि�सूून आले आहे;

त्याअर्थीी आताा, उक्त अधिि˜नि�यमााच्या प्रकरण I-A च्या कलम ३ (D) (c) (i) च्या परि�च्छेेद (A) अन्वयेे सुधारणा

करण्यात आलेल्या प्रकरण पााच मधीील कलम १४ च्या पोट-कलम (१) द्वाारे प्रदाान करण्यात आलेल्या अधिि˜कारांं�चाा वाापर करून

महााराष्ट्र शासन या नोटि�शीीद्वाारे असे घोषिि¨त करीत आहे की त्याने उक्त जमीन संपाादि�त करण्याचे ठरवि�लेे आहे.

Notice

Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971.

No. Bhusampa-2025/C.R.76/Zopani-2.—Whereas, on representation from the Chief Executive

Officer, Mumbai Metropolitan Region Slum Rehabilitation Authority, Thane it appears to the

Government of Maharashtra that in order to enable the said Authority to implement the Slum

Rehabilitation Scheme in relation to the Slum Rehabilitation Area mentioned in the Schedule

appended hereto (hereinafter referred to as “the said Schedule”), it is necessary that the land specified

in the said Schedule (hereinafter referred to as “the said land”), should be acquired ;

And whereas, as required by the proviso to sub-section (1) of section 14 of Chapter V read with

paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the Maharashtra Slum

Areas (Improvement, Clearance and Redevelopment) Act, 1971 (Mah. XXVIII of 1971) (hereinafter

referred to as “the said Act”), the Chief Executive Officer, Mumbai Metropolitan Region Slum

Rehabilitation Authority, Thane, has by his notice issued No. SRA/CO.AU.-4/873/2024, dated the

26th September 2025, served in prescribed manner and also by notice published in the daily Marathi

newspaper “Thane Vaibhav and Lokamat” and English newspaper “The Free Press Journal” dated

the 27th September 2024, and also by affixing on the conspicuous part in the premises of the said

land, as provided in section 36 of the said Act, called upon the persons mentioned in column (6) of the

said Schedule, who are the owners of the said land or any other person interested therein to show

cause, within seven days from the date of its publication in the newspapers, as to why the proposal

to acquire the said land for implementation of the Slum Rehabilitation Scheme for the concerned

protected slum dwellers should not be sent to the State Government for approval;

And whereas, the Chief Executive Officer, Mumbai Metropolitan Region Slum Rehabilitation

Authority, Thane, after considering the objections received in this behalf for the acquisition of the

said land and pleading received on behalf of the proposed Co-operative Housing Society of the slum

dwellers, entries as to the rights in the land record, reservation in the Development Plan and the

legitimate request of the protected slum dwellers, by his representation dated the 24 April 2025, has

submitted the report for the acquisition of the said land;

And whereas, as required by the first proviso to sub-section (1) of section 14 of Chapter V

read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the said Act,

on representation received from the Chief Executive Officer, Mumbai Metropolitan Region Slum

Rehabilitation Authority, Thane and after considering his report, it appears to the State Government

that, in order to enable the Slum Rehabilitation Authority to carry out the development under the

Slum Rehabilitation Scheme in the Slum Rehabilitation Area mentioned in the said Schedule, the

said land should be acquired;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 14 read with

paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the said Act, the Government

of Maharashtra hereby declares by this notice that, it has decided to acquire the said land.
