(१९६५ चा महा. ४०) यामध्ये सुधाारणाा करण्यात आली असून, नगरपंंचायतींच्या नि�वडणुकांं�करीताा, महारााष्ट्र शाासन, रााज्य नि�वडणूक

आयुक्तांं�च्या मान्यतेने राजपत्राात प्रसि�द्ध केलेल्या आदेशााद्वाारे, प्रभाागां�चीी संख्या नि�श्चिĐित करेल आणि� त्यांं�च्या सीीमा नि�र्दि�िष्ट करेल अशी

तरतूूद करण्यासाठीी सुधाारणाा करण्यात आली आहे ;

आणि� ज्याअर्थीी, कलम ३४१ब चे पोट-कलम (१) नुसार नगरपंंचायतींमधील थेेट नि�वडूून येणााऱ्या नगरपंंचायत सदस्यां�चीी संख्या

सतराा असेल ;

आणि� ज्याअर्थीी, महारााष्ट्र नगरपरि�षदाा, नगरपंंचायती व औद्योोगि�क नगरी अधि�नि�यम, १९६५ मधील कलम ३४१ब पोट-कलम (१)

मधील तरतुुदीनुसार नगरपंंचायतींमध्ये नि�वडूून द्यावयाच्या सदस्यां�चीी संख्या १७ अशी नि�श्चिĐित करण्यात आलेली आहे;

आणि� ज्याअर्थीी, उक्त तरतुुदी अंमलात आणण्याच्या उद्देेशााने महि�लांं�करीताा तसेेच अनुसूचि�त जाती, अनुसूचि�त जमाती, नाागरि�कांं�चा

मागासवर्गग प्रवर्गग यातील व्यक्तींकरीताा नगरपंंचायतींमधील प्रभाागांं�मध्ये नगरपंंचायत सदस्यांं�च्या रााखीीव जागां�चेे वाटप करण्याच्या आणि�

त्या चक्रानुक्रमे फििœरवण्याच्या संबंधाात नि�यम करणेे इष्ट वाटतेे ;

आणि� ज्याअर्थीी, याबाबत ताात्काळ कार्ययवाही करण्यासाठीी या नि�यमां�चीी पूर्वव प्रसि�द्धीीची शर्तत काढूून टाकणे, जीमुळे आवश्यक व्हावे

अशी परि�स्थि�ितीी अस्ति�ित्वात असल्याबद्दल महारााष्ट्र शाासनााची खात्री पटलीी आहे.

त्याअर्थीी, आताा महारााष्ट्र नगरपरि�षदाा, नगरपंंचायती व औद्योोगि�क नगरी अधि�नि�यम, १९६५ (१९६५ चा महा. ४०) कलम १०

आणि� कलम ३२१ द्वाारे प्रदाान करण्यात आलेल्या अधि�काारांं�चा आणि� यासंदर्भाभाा�त त्यास समर्थथ करणााऱ्या इतर सर्वव अधि�काारांं�चा वापर करून

तसेेच यासंदर्भाभाा�त अगोदर काढलेेल्या इतर सर्वव अधि�सूूचनाा, आदेश, नि�यम, इत्यादींचे अधि�क्रमण करून, महारााष्ट्र शाासन, रााज्य नि�वडणूक

आयुक्तांं�शी वि¦चार वि¦नि�मय केल्यानंंतर, याद्वाारे पुढील नि�यम करीत आहेत :–

१. संक्षि�प्त नाव :– या नि�यमां�नाा महारााष्ट्र नगरपंंचायत (प्रभाागांं�मध्ये रााखीीव जागां�चेे वाटप करणेे आणि� त्या जागा चक्रानुक्रमे

फििœरवि¦ण्याची पद्धत) नि�यम, २०२५ असे म्हणण्यात येईल.

२. व्याख्या :– (एक) या नि�यमांं�मध्ये संदर्भाभाा�नुुसार दुसराा अर्थथ अपेक्षििȦत नसेेल तर ;

(अ) “ अधि�नि�यम ” याचा अर्थथ, महारााष्ट्र नगरपरि�षदाा, नगरपंंचायती व औद्योोगि�क नगरी अधि�नि�यम, १९६५ (१९६५

चा मुंं�बई महा. ४०) असा आहे;

(ब) “ प्रभााग ” याचा अर्थथ, पंचायत सदस्यां�नाा नि�वडूून देण्याच्या प्रयोजनाार्थथ, नगरपंंचायतींचे क्षेत्र ज्या नि�वडणूक

मतदाार संघांं�मध्ये वि¦भाागलेले असेल त्यांं�च्यापैकी नि�वडणूक मतदाार संघ, असा आहे.

(दोन) या नि�यमांं�मध्ये वापरलेेले, परंतु व्याख्या न केलेले शब्द व शब्द प्रयोग यां�नाा अधि�नि�यमामध्ये जो अर्थथ नेमून

दि�लेेला असेल तोच अर्थथ असेल.

३. अनुसूचि�त जातींसाठी राखून ठेेवलेेल्या जागां�चेे वाटप करण्याची व त्या चक्रानुक्रमे फििœरवि¦ण्याची पद्धत :–

(१) अनुसूचि�त जातींच्या व्यक्तींसाठीी नगरपंंचायतींच्या सदस्यांं�च्या जागा रााखून ठेवण्याकरि�ताा, प्रथम प्रभाागां�चीी मांं�डणी ही,

ज्या प्रभाागातील अनुसूचि�त जातीच्या लोकसंख्येची टक्केवारी त्या प्रभाागातील एकूण लोकसंख्येच्या तुलनेत सर्वा�धि�क असेल अशाा

प्रभाागापासून सुरुवात करून, उतरत्या क्रमाने करण्यात येईल ;

(२) त्यानंंतर, अनुसूचि�त जातींच्या लोकसंख्येची टक्केवारी सर्वा�धि�क असलेेल्या प्रभाागापासून सुरुवात करून उतरत्या

क्रमाने जागा अनुसूचि�त जातींसाठीी नेमून देण्यात येईल ;

परंतु, नगरपंंचायतींच्या सर्वव प्रभाागांं�मध्ये असे आरक्षण चक्रानुक्रमे फििœरवलेे जाईपर्यंत, ज्या प्रभाागात अनुसूचि�त जातींसाठीी अशी

कोणतीीही जागा यापूर्वी रााखून ठेवलेली नव्हतीी अशाा प्रभाागांं�करीताा नगरपंंचायतींच्या पुढील नि�वडणुकांं�मध्ये शक्य होईल तेथवर, या पोट

नि�यमाखाली रााखून ठेवलेल्या जागा चक्रानुक्रमे फििœरवि¦ण्यात येतील.

४. अनुसूचि�त जमातींसाठी राखून ठेेवलेेल्या जागां�चेे वाटप करण्याची व त्या चक्रानुक्रमे फििœरवि¦ण्याची पद्धत :–

(१) अनुसूचि�त जमातीच्या व्यक्तींसाठीी नगरपंंचायतींच्या सदस्यांं�च्या जागा रााखून ठेवण्याकरि�ताा, प्रथम प्रभाागां�चीी मांं�डणी

ही, ज्या प्रभाागातील अनुसूचि�त जमातींच्या लोकसंख्येची टक्केवारी त्या प्रभाागातील एकूण लोकसंख्येच्या तुलनेत सर्वा�धि�क असेल

अशाा प्रभाागापासून सुरुवात करून, उतरत्या क्रमाने करण्यात येईल.

(२) त्यानंंतर, अनुसूचि�त जमातींच्या लोकसंख्येची टक्केवारी सर्वा�धि�क असलेेल्या प्रभाागापासून सुरुवात करून उतरत्या

क्रमाने जागा अनुसूचि�त जमातींसाठीी नेमून देण्यात येईल ;

परंतु, नगरपंंचायतींच्या सर्वव प्रभाागांं�मध्ये असे आरक्षण चक्रानुक्रमे फििœरवलेे जाईपर्यंत, ज्या प्रभाागात अनुसूचि�त जमातींसाठीी अशी

नि�यमाखाली रााखून ठेवलेल्या जागा चक्रानुक्रमे फििœरवि¦ण्यात येतील.

५. एकााच प्रभाागात अनुसूचि�त जातीी व अनुसूचि�त जमातीीची जागा येत असल्यास :- वरीील नि�यम ३ व ४ नुसार अनुसूचि�त

जाती व अनुसूचि�त जमातीच्या जागां�चेे वाटप केल्यानंंतर जर एकच प्रभााग अनुसूचि�त जाती व जमातीकरीताा आरक्षििȦत होत असेल तर :–

(i) त्या प्रभाागामध्ये अनुसूचि�त जाती व अनुसूचि�त जमाती यांं�च्यापैकी ज्या प्रवर्गा�चीी लोकसंख्या जास्त असेल, त्या प्रवर्गा�करीताा

तो प्रभााग आरक्षििȦत होईल आणि� दुसऱ्या प्रवर्गा�चेे आरक्षण उतरत्या क्रमाने पुढील प्रभाागात देण्यात येईल ;

(ii) आणि� जर, प्रभाागातील अनुसूचि�त जाती व अनुसूचि�त जमातीची लोकसंख्या समाान असल्यास तो प्रभााग अनुसूचि�त

जमातीकरीताा आर‍‍क्षििȦत होईल, कारण अनुसूचि�त जमातीची लोकसंख्या ही वि¦शि�ष्ट क्षेत्राामध्येच समाावि¦ष्ट असतेे.

६. एकाापेक्षा अधिि˜क प्रभाागांं�मध्ये त्या प्रवर्गाा�च्या लोकसंंख्येची समान टक्केवारी असल्यास :– नि�यम ३ व ४ नुसार उतरत्या

क्रमाने प्रभाागां�चीी मांं�डणी केल्यानंंतर, सदर नि�यमातील तरतुुदीनुसार अनुसूचि�त जाती अथवाा अनुसूचि�त जमाती या प्रवर्गा�सााठीी आरक्षििȦत

प्रभााग नि�श्चिĐित करेल. मात्र, जर ज्या प्रवर्गा�तीील शेवटच्या आरक्षििȦत जागेसाठीी प्रभााग नि�श्चिĐित करताानाा, दोन अथवाा अधि�क प्रभाागांं�मध्ये

त्या प्रवर्गा�च्या लोकसंख्येची टक्केवारी समाान असल्यास, त्या प्रभाागां�पैैकी कोणत्या प्रभाागात आरक्षण देय होईल तो प्रभााग चि�ठ्ठ्याा टाकून

नि�श्चिĐित करण्यात यावा.

७. नागरि�कांं�च्या मागासवर्गग प्रवर्गाा�करि�ताा जागां�चेे वाटप करण्याची व त्या चक्रानुक्रमे फििœरवि¦ण्याची पद्धत :-

(१) अनुसूचि�त जाती व अनुसूचि�त जमातीकरीताा आरक्षििȦत जागा नि�श्चिĐित केल्यानंंतर उर्ववरि�त प्रभाागांं�मधून सोडत काढूून

नाागरि�कांं�च्या मागासवर्गग प्रवर्गा�च्या जागां�चेे वाटप करण्यात येईल.

(२) त्या पुढील नि�वडणुकीमध्ये, जे प्रभााग अगोदरच्या नि�वडणुकीमध्ये नाागरि�कांं�च्या मागासवर्गग प्रवर्गा�करीताा सोडतीने आरक्षीत

झााले होते ते प्रभााग आणि� या नि�वडणुकीमध्ये अनुसूचि�त जाती व अनुसूचि�त जमातीसाठीी आरक्षििȦत झाालेले प्रभााग वगळून उर्ववरि�त

प्रभाागांं�मधून सोडत काढूून नाागरि�कांं�च्या मागासवर्गग प्रवर्गा�च्या जागा नेमून देण्यात येतील :

परंतु, नगरपंंचायतीच्या सर्वव प्रभाागांं�मध्ये असे आरक्षण चक्रानुक्रमे फििœरवलेे जाईपर्यंत, ज्या प्रभाागात नाागरि�कांं�च्या मागासवर्गग प्रवर्गा�सााठीी

अशी कोणतीीही जागा यापूर्वी रााखून ठेवलेली नव्हतीी अशाा प्रभाागांं�करीताा नगरपंंचायतींच्या पुढील नि�वडणुकांं�मध्ये, शक्य होईल तेथवर,

या पोट नि�यमाखाली रााखून ठेवलेल्या जागा चक्रानुक्रमे फििœरवि¦ण्यात येतील.

८. महि�लांं�साठी जागा नेमून देण्याची व त्या चक्रानुक्रमे फििœरवि¦ण्याची पद्धत :-

(१) प्रथम, अनुसूचि�त जातीतील महि�लांं�साठीी रााखून ठेवावयाच्या जागा या, अनुसूचि�त जातीसाठीी रााखीीव जागा असलेेल्या

प्रभाागांं�मधून सोडतीने नेमून देण्यात येतील.

(२) यानंंतर, अनुसूचि�त जमातीतील महि�लांं�साठीी रााखून ठेवावयाच्या जागा या, अनुसूचि�त जमातीसाठीी रााखीीव जागा

असलेेल्या प्रभाागांं�मधून सोडतीने नेमून देण्यात येतील.

(३) नाागरि�कांं�च्या मागासवर्गग प्रवर्गा�तीील महि�लांं�साठीी रााखून ठेवावयाच्या जागा या, नाागरि�कांं�चा मागास प्रवर्गा�करीताा रााखीीव

जागा असलेेल्या प्रभाागांं�मधून सोडतीने नेमून देण्यात येतील.

(४) या नि�यमांं�च्या प्रारंभाानंंतरच्या पुढील नि�वडणुकीमध्ये, शक्य असेल तेथवर, सर्वव प्रभाागांं�मध्ये असे महि�लांं�चे आरक्षण

चक्रानुक्रमे नेमून दि�लेे जाईपर्यंत, नगरपंंचायतींच्या यापूर्वीच्या सार्ववत्रि�क नि�वडणुकांं�मध्ये एखाद्या वि¦शि�ष्ट प्रवर्गा�तीील महि�लांं�साठीी

जेथेे अशी कोणतीीही जागा नेमून देण्यात आली नव्हतीी त्या प्रभाागां�सााठीी, त्या प्रवर्गा�तीील महि�लांं�साठीी रााखीीव जागा चक्रानुक्रमे नेमून

देण्यात येतील.

९. चक्रानुक्रमासाठी प्रथम नि�वडणूक :– ह्याा नि�यमानुसार चक्रानुक्रमाच्या प्रयोजनांं�सााठीी, या नि�यमांं�च्या प्रारंभाानंंतर घेतलेेल्या

सार्ववत्रि�क नि�वडणुका ह्याा, प्रथम नि�वडणूक असल्याचे मानण्यात येईल.

महारााष्ट्राचे रााज्यपाल यांं�च्या आदेशाानुसार व नाावाने,

प्रि�यांं�काा कुलकर्णी-छाापवालेे,

NOTIFICATION

Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965.

No. MCO-2025/C.R.290/UD-14.—Whereas, by the Mumbai Municipal Corporation, Maharashtra

Municipal Corporations and Maharashtra Municipal Councils, Nagar Panchayats and Industrial

Townships (Amendment) Act, 2022 (Mah. XXI of 2022), the Maharashtra Municipal Councils, Nagar

Panchayats and Industrial Townships Act, 1965 (Mah. XL of 1965) (hereinafter referred to as “the

said Act”) has been amended to provide that for the purposes of elections of the Nagar Panchayats, the

State Government with the approval of the State Election Commissioner shall by an order published

in the Official Gazette, divide into number of wards and specify the boundaries thereof ;

And whereas, sub-section (1) of section 341B of the said Act provides that a Nagar Panchayats

shall consist of seventeen directly elected Councillors ;

And Whereas, to give effect to the said provisions, it is considered expedient to frame the rules

regarding the manner of allotment and rotation of reservation of seats of Counicllors in wards in the

Nagar Panchayat for Women and the persons belonging to the Scheduled Castes, Scheduled Tribes

and Backward Class of citizens ;

And whereas, the Government of Maharashtra is satisfied that circumstances exist which render

it necessary to take immediate action in this behalf by dispensing with the condition of previous

publication of these rules ;

Now, therefore, in exercise of the powers conferred by section 10 read with section 321 of the

Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah. XL of

1965) and of all other powers enabling it in that behalf, and in supersession of all earlier notifications,

orders, rules, etc., issued in this behalf, the Government of Maharashtra, after consultation with the

State Election Commissioner, hereby makes the following rules, namely :–

1. Short title.— These rules may be called the the Maharashtra Nagar Panchayats (Manner

of Allotment and Rotation of Reservation of Seats of Councillors in Wards) Rules, 2025.

2. Definitions.— (1) In these rules, unless the context otherwise requires,—

(a) “Act” means the Maharashtra Municipal Councils, Nagar Panchayats and Industrial

Townships Act, 1965 (Mah.XL of 1965) ;

(b) “ward” means the territorial constituencies into which the area of the Nagar Panchayats

is divided for the purpose of election of Councillors ;

(2) Words and expressions used in these rules but not defined hereinabove shall have the same

meaning as assigned to them in the Act respectively.

3. Manner of allotment and rotation of seats reserved for Scheduled Castes.—

(1) For reserving seats of Councillors for the persons belonging to the Scheduled Castes, the

wards shall be first arranged in descending order, beginning with a ward where the percentage

of population of the Scheduled Castes with regard to the total population of such ward is the

highest.

(2) Thereafter, seat shall be allotted to the Scheduled Castes, beginning in the descending

order with the ward having the highest percentage of population of the Scheduled Castes :

Provided that, the seats reserved under this sub-rule shall be rotated, as far as possible, in

the subsequent elections of the Nagar Panchayat, to such wards in which no such seat had been

previously reserved for the Scheduled Castes until such reservation is provided in all the wards in

the Nagar Panchayat by rotation.

4. Manner of allotment and rotation of seats reserved for Scheduled Tribes.—

(1) For reserving seats of Councillors for the persons belonging to the Scheduled Tribes, the

wards shall be first arranged in descending order, beginning with a ward where the percentage

of population of the Scheduled Tribes with regard to the total population of such ward is the

highest.

(2) Thereafter, seat shall be allotted to the Scheduled Tribes, beginning in the descending

order with the ward having the highest percentage of population of the Scheduled Tribes :

Provided that, the seats reserved under this sub-rule shall be rotated, as far as possible, in

the subsequent elections of the Nagar Panchayat, to such wards in which no such seat had been

previously reserved for Scheduled Tribes until such reservation is provided in all the wards in the

Nagar Panchayat by rotation.

5. If Seats of Scheduled Cast and Scheduled Tribe fall in a same ward:– After the

allocation of seats of Scheduled Castes and Scheduled Tribes in accordance with rule 3 and rule 4

above, if seats of Scheduled Castes and Scheduled Tribes are reserved in the same ward, then :–

(i) That ward shall be reserved for the category of Scheduled Castes or Scheduled Tribes

whose population is more in that ward and the reservation of the other category shall be given

in the ward which is next in the descending order ;

(ii) And if, the population of Scheduled Castes and Scheduled Tribes in the ward is equal,

that ward shall be reserved for Scheduled Tribes because the population of Scheduled Tribes is

confined to a particular area.

6. If more than one ward has same percentage of population of that category :– After

arranging the wards in descending order as per rules 3 and 4, the reservation for the categories of

Scheduled Castes or Scheduled Tribes in the ward shall be determined as per the provisions of the

said rules. However, while determining the ward for the last seat to be reserved in that category, if

the percentage of population of that category is the same in two or more wards, then the ward to be

reserved shall be decided by drawing of lots from amongst those wards.

7. Manner of allotment and rotation of seats for backward classes of citizens :–

(1) After the reservation of seats for Scheduled Castes and Scheduled Tribes has been

determined, the seats reserved for Backward Class of citizens shall be allotted by drawing lots

from the remaining wards.

(2) In the next election, the seats for Backward Class of Citizens shall be allotted by drawing

lots from the remaining wards, excluding the wards which were reserved for Backward Class of

citizens in the previous elections and the wards reserved for Scheduled Castes and Scheduled

Tribes in this election :

Provided that, the seats reserved under this sub-rule shall be rotated, as far as possible, in

the subsequent elections of the Nagar Panchayats, to such wards in which no such seat had been

previously reserved for Backward Class of Citizens until such reservation is provided in all the wards

in the Corporation by rotation.

8. Manner of allotment and rotation of seats for women.—(a) Firstly, the seats to be

reserved for women belonging to the Scheduled Castes shall be allotted by drawing lots from amongst

the wards having the seats reserved for the Scheduled Castes ;

(b) thereafter, the seats to be reserved for women belonging to the Scheduled Tribes shall

be allotted by drawing lots from amongst the wards having the seats reserved for the Scheduled

Tribes.

citizens shall be allotted by drawing lots from amongst the wards having the seats reserved for

the Backward Class of citizens ;

(d) the seats reserved for the Women in a particular category shall be allotted by rotation, as

far as possible, in the subsequent elections to the Nagar Panchayat to the wards where no such

seat was allotted to women in that category in the previous elections of the Nagar Panchayat

till all the wards are allotted such reservation by rotation.

9. First election for rotation.—For the purposes of rotation of seats under these rules, the

general election held after commencement of these rules shall be considered as the first election.
