वि¦कास नि�यंंत्रण व प्रोत्साहन नि�यमावलीस (CDCPR) (यापुुढेे याचा उल्लेख ‘उक्त नि�यमावली’ असा करणेत आलेला आहे) शाासन
नगरवि¦कास वि¦भाागाकडील दिि—.०५/०७/२०२३ रोजीीचेे अधिि˜सूचनेेन्वये मंजुुरी देण्यात आली असून, सदर नि�यमावली दिि—.१३/०७/२०२३
पासून अंमलात आली आहे;
आणि�, ज्याअर्थीी उक्त नि�यमावलीचेे वि¦नि�यम २.२.१५ ‘Premium Charges’ संदर्भाभााɑत असून, त्यामध्ये उक्त नि�यमावलीतील
तरतुदीीनुुसाार प्राधिि˜करणास भरणा करावयाच्या अधिि˜मूल्य रकमेचा भरणा हप्त्यांं�मध्ये करणेसंदर्भाभााɑतील पर्याɑयाबाबत तरतूद आहे; आणि�
ज्याअर्थीी, वि¦नि�यम २.२.१५ खालील टीप क्र. (v) मध्ये अधिि˜मूल्याचेे शुुल्क हप्त्याने भरणा करण्यासबंधीचेे पर्याɑय दिि—. २/१२/२०२४
पर्यंत लागू राहतीील अशी तरतूद आहे;
आणि� ज्याअर्थीी, मुुख्य कार्ययकारी अधिि˜कारी, महााराष्ट्र औद्योोगि�क वि¦कास महाामंडळाचेे (यापुुढेे याचा उल्लेख ‘उक्त प्राधिि˜करण’
असा करणेत आलेला आहे) दिि—. १५/०१/२०२५ रोजीीचेे पत्र शाासन नगर वि¦कास वि¦भाागास प्राप्त झााले असून, त्यामध्ये नमूूद आहे की,
“अध्ययक्ष, क्रेडााई बीएएनएम राययगड यांं�चे दि�.१०/०१/२०२५ रोजीचे उक्त प्रााधि�करणास सादर केलेेल्याा पत्रामध्येे चटई क्षेत्र
नि�र्देशां�काासाठी आकारावयााचे अधि�मूल्यय हप्त्यांं�मध्येे भरण्यााची तरतूद वि�कासकां�वरील आर्थि�िक भार कमी करेल आणि�
त्याामुळेे प्रकल्पां�चीी अंमलबजावणी सुलभरि�त्याा होऊ शकेल. त्याानुषंंगाने वि�कासाच्याा गतीमध्येे तसेच बांं�धकामाच्याा गुणवत्तेेशी
तडजोोड न करता प्रकल्प वेळेेवर पूर्णण करणे सुनि�श्चििĐित होण्यााचे दृष्टीीने हप्त्यााचे सुवि�धेचाा कालावधी वाढवि�ण्यााची वि�नंती
केली आहे”; आणि� ज्याअर्थीी, उक्त वि¦नंंतीच्या अनुुषंंगाने उक्त प्राधिि˜करणाने उक्त नि�यमावलीचेे २.२.१५ मधील टीप क्र.(v) रद्द
करण्यासंबंधी उक्त नि�यमावलीमध्ये फेेरबदल करण्याबाबत वि¦नंंती केली आहे;

आणि� ज्याअर्थीी, यासंदर्भाभााɑतील तरतूद संपूर्णण महााराष्ट्र राज्याकरि�ता (काही नि�योोजन प्राधिि˜करणे वगळता) लागू असलेल्या एकत्रि�कृृत
वि¦कास नि�यंंत्रण व प्रोत्साहन नि�यमावलीमध्ये (यापुुढेे याचा उल्लेख ‘UDCPR’ असा करणेत आलेला आहे) वि¦नि�यम ११.२.५ मध्ये
अंतर्भूɑत करण्यात आली आहे; आणि� ज्याअर्थीी, सदर तरतुदीीनुुसाार अधिि˜मूल्य शुुल्काचेे हप्त्याने भरणा करण्यासंबंधीचा कालावधी दिि—.
२/१२/२०२४ रोजीी संपुुष्टात आला आहे; आणि� ज्याअर्थीी, सदर तरतुदीीनुुसाार अधिि˜मूल्य शुुल्काचेे हप्त्याने भरणा संबंधीची सुुवि¦धा कायम
ठेवणेबाबत शाासनाास प्राप्त झाालेल्या वि¦नंंती वि¦चारात घेेऊन शाासनााने वि¦चारात घेेऊन, त्याअनुुषंंगाने UDCPR मध्ये फेेरबदल करण्यासाठीी
फेेरबदल प्रस्ताव कार्याɑन्वि�¦त करून त्यासंबंधी उक्त अधिि˜नि�यमाचेे कलम ३७ (१कक) अन्वये सूचनाा दिि—.११/१०/२०२४ नि�र्गगमि�त
करण्यात आली असून सदर प्रस्तावि¦त फेेरबदल लगोलग लागू करण्याकरीता सदर सूचनेेसोबत उक्त अधिि˜नि�यमाचेे कलम १५४(१)
अन्वये नि�देेश देण्यात आले आहेत;
आणि� ज्याअर्थीी, उक्त वस्तुस्थि�ितीी, UDCPR मधील यासंबंधीच्या तरतुदींंमध्ये प्रस्तावि¦त फेेरबदल व उक्त प्राधिि˜करणाची वि¦नंंती
वि¦चारात घेेता, राज्यातील वि¦कासामध्ये सूसुत्रता असण्याचेे दृष्टीने सोबत जोडलेल्या परि�शि�ष्टामध्ये दर्शशवि¦ल्यानुुसाार उक्त नि�यमावलीचेे
वि¦नि�यम २.२.१५ खालील टि�प क्र.(v) रद्द करणेबाबत उक्त नि�यमावलीमध्ये फेेरबदल करणे सार्ववजनि�क हि�तााचेे दृष्टीने आवश्यक आहे,
असे शाासन नगरवि¦कास वि¦भाागाचेे मत झााले आहे (यापुुढेे याचा उल्लेख “प्रस्तावि¦त फेेरबदल” असा करणेत आलेला आहे).
आणि� त्याअर्थीी, उपरोोक्त परि�स्थि�ितीी आणि� वस्तुस्थि�ितीी वि¦चारात घेेता आणि� उक्त अधिि˜नि�यमाच्या कलम ३७ च्या पोट-कलम (१कक)
अन्वये प्राप्त अधिि˜कार आणि� त्या संदर्भाभााɑतील सर्वव शक्तींचा वापर करुन, शाासन याद्वाारे प्रस्तावि¦त फेेरबदलावि¦षयी उक्त अधिि˜नि�यमाच्या
कलम ३७, पोट-कलम (१कक) चेे खंड(क) नुुसाार कोणत्याही व्यक्तीकडून हरकती / सूचनाा मागवि¦ण्यासाठीी तसेच संभााव्य बाधिि˜त
होणाऱ्या व्यक्तींच्या माहि�तीीसाठीी सदर सूचनाा प्रसि�ध्द करीत आहे. शाासनााकडून अ़सेही कळवि¦णेत येत आहे की, खालील परि�शि�ष्टात
नमूूद प्रस्तावि¦त फेेरबदलावि¦षयी कोणत्याही हरकती/ सूचनाा महाराष्ट्र शासन राजप त्रात सदर सूचनाा प्रसि�द्ध झााल्याच्या दिि—नांं�कापासून
एक महि�न्याच्या आत संबंधिि˜त सहसंंचालक, नगररचनाा यांं�चेेकडे पाठवि¦ण्यात याव्यात. सदर प्राप्त हरकती / सूचनांं�वर सुनाावणी देऊन
तसेच लागू असेल त्याप्रमाणे उक्त महाानगरपालि�केचेे म्हणणे घेेऊन त्यावरील अहवााल शाासनाास सादर करण्यासाठीी संबंधिि˜त सहसंंचालक,
नगररचनाा, यां�नाा शाासनााचेे वतीने “अधिि˜कारी” म्हणूून प्राधिि˜कृत करण्यात येत असून त्यांं�च्याकडे सदरच्या कालावधीत प्राप्त होणाऱ्या
हरकती/सूचनाा यावर उक्त अधिि˜नि�यमाच्या कलम ३७ च्या पोट-कलम (१कक) अन्वये कार्ययवाही करण्यात येईल;
शाासन याद्वाारे उक्त अधिि˜नि�यमाचेे कलम १५४(१) अन्वये नि�र्देश देत आहे की, उक्त अधिि˜नि�यमाचेे कलम ३७(१कक) चेे उप
कलम (ग) अन्वये प्रस्तावि¦त फेेरबदलास शाासन मान्यता प्रलंबि�त असेपर्यंत प्रस्तावि¦त फेेरबदल लगोलग अंमलात येईल;
उक्त अधिि˜नि�यमाचेे कलम ३७(१कक) अन्वये सदर फेेरबदलाची सूचनाा महााराष्ट्र शाासनााच्या www.maharashtra.gov.in
(कायदा /नि�यम ) या वेबसाईटवर देखील प्रसि�द्ध करण्यात यावी.

Notice
Maharashtra Regional & Town Planning Act, 1966.
No.TPB-4325/207/CR-24/2025/UD-11.—Whereas, the Comprehensive Development Control
and Promotion Regulations (CDCPR) (hereinafter referred to as ‘the said Regulations’) for
the Maharashtra Industrial Development Corporation Area have been sanctioned vide Urban
Development Department’s notification No.TPB-4322/314/C.R.25/2022/UD-11, dated 05/07/2023 and
the said Regulations have come into force from 13/07/2023;
And, whereas Regulation 2.2.15 of the said Regulations stipulate about ‘Premium Charges’ and
it contains a provision regarding the options for the payment of premium charges in instalments to
be paid to the Authority as per the said Regulations; And Whereas, Note No. (v) under Regulation
2.2.15 stipulate that the aforesaid options regarding payment of premium charges shall be applicable
for the period upto 02/12/2024;
And whereas, Government in Urban Development Department has received a letter dated
15/01/2025 from Chief Executive Officer, Maharashtra Industrial Development Corporation
(hereinafter referred to as ‘the said Authority’) wherein it is stated that, “CREDAI BANM Raigad
vide its letter dated 10/01/2025 addressed to the said Authority has stated that the provision to pay
FSI premium in instalments is easing the financial burden on builders and facilitating smoother
projection execution. Therefore, association has requested to extend this instalment facility which
will help developers in maintaining liquidity and ensuring timely completion of projects without
compromising the pace of development or quality of construction; And whereas, in view of the above
request of association the said Authority has requested the Government in Urban Development
Department to modify the said Regulations by deleting the provision of Note No. (v) given under
Regulation 2.2.15;
And Whereas, the similar provisions in this regard are incorporated in Regulation 2.2.14 of
the Unified Development Control and Promotion Regulations (hereinafter referred to as ‘UDCPR’)
applicable to the entire State of Maharashtra (except for certain Planning Authorities); And whereas
the period for facility of premium charges payment in installments as per this provision is ended on
02/12/2024; And whereas, in view of the request received by Government to continue the facility of
premium charges payment in instalments given under this provision, the Government has initiated
a modification proposal to UDCPR by issuing a notice dated 11/10/2024 under Section 37 (1AA) along
with directives under Section 154(1) of the said Act to make applicable the proposed modification
forthwith from the date of the notice;
And whereas, considering the above said facts, proposed amendments in the similar provisions of
the UDCPR and the request of the said Authority, the Government in Urban Development Department
is of the opinion that in view of streamlining the development in the state, in the public interest,
it is expedient to modify the said Regulations by deleting the provision of Note No. (v) given under
Regulation 2.2.15 of the said Regulations as specifically described in the Schedule attached herewith
(hereinafter referred to as “the Proposed Modification”).
Now, therefore, after considering the above facts and circumstances and in exercise of the powers
conferred by sub-section (1AA) of Section 37 of the said Act; and of all other powers enabling it in this
behalf, Government hereby publishes a Notice for inviting objections/ suggestions from any persons
with respect to the Proposed Modification, as required by clause (a) of sub-section (1AA) of Section
37 of the said Act, for information of all persons likely to be affected thereby. The Government is
further pleased to inform that any objections/ suggestions in respect of the Proposed Modification
mentioned in the Schedule attached herewith may be forwarded, before the expiry of one month
from the date of publication of this Notice in the Maharashtra Government Gazette (hereinafter
referred to as “the said period”) to the Concerned Joint Director of Town Planning. Any objections /
suggestions, which may be received within the said period will be dealt with in accordance with the

provisions of sub-section (1AA) of Section 37 of the said Act by the Concerned Joint Director of Town
Planning, who is hereby authorised as an “officer” on the behalf of Government to hear objections /
suggestions which are received and say of the said Corporation, as the case may be and submit his
report to the Government;
Further, the Government hereby issues directives under Section 154(1) of the said Act that,
pending sanction to the Proposed Modification under clause (C) of Section 37(1AA) of the said Act
by the Government, the Proposed Modification shall come into force forthwith.
This Notice under sub-section (1AA) of Section 37 of the said Act shall also be available on the
Govt. of Maharashtra website : www.maharashtra.gov.in ( Acts/Rules ).
