नि�यम, २०१८ मध्ये सुधाारणाा करण्यासाठीी महाारााष्ट्र सरकाारनेे प्रस्ताावि�त केलेला खाालील नि�यमांं�चा मसुुदाा, महाारााष्ट्र दुकााने आणिि” आस्थाापनाा

(नोकरीीचे आणिि” सेेवाशर्तींचे वि�नि�यमन) अधि�नि�यम, २०१७ (२०१७ चा ६१) च्या कलम ३७ च्या पोट-कलम (१) द्वाारे प्रदाान केलेल्या

अधि�काारांं�चा वापर करून आणिि” त्यासंदर्भाा�त सक्षम करणााऱ्या इतर सर्वव अधि�काारांं�चा वापर करून, या काायद्यााच्या कलम ३७ च्या पोट-

कलम (२) द्वाारे आवश्यकतेेप्रमाणे प्रसि�ध्द करण्यात येत आहे, ज्यामुळेे प्रभाभाावि�त होण्याची शक्यताा असलेेल्या सर्वव व्यक्तींच्या माहि�तीीसाठीी;

आणिि” येथे सूचनाा देण्यात येत आहे की, ही अधि�सूूचनाा महाारााष्ट्र शाासनाच्या रााजपत्रात प्रसि�ध्द झााल्याच्या दि�नांं�काापासून पंचेचाळीस

दि�वसांं�च्या समााप्तीनंंतर महाारााष्ट्र शासनााकडूून वि�चााराात घेेतलाा जाईल.

त्या संदर्भाा�त सक्षम असलेेल्या इतर सर्वव अधि�काारांं�चा वापर करून, महाारााष्ट्र शासन, महाारााष्ट्र दुकााने व आस्थाापनाा (नोकरीीचे आणिि”

सेेवाशर्तींचे वि�नि�यमन) नि�यम, २०१८ मध्ये सुधाारणाा करण्यासाठीी खाालील नि�यम तयाार करत आहे, हे नि�यम उक्त अधि�नि�यमाच्या कलम

३७ च्या पोट-कलम (२) द्वाारे आवश्यक असल्याप्रमाणे पूर्वीच प्रकााशि�त करण्यात आले आहेत, ते पुढीीलप्रमाणे आहेत :-

१. या नि�यमांं�ना महाारााष्ट्र दुकााने व आस्थाापनाा (नोकरीीचे आणिि” सेेवाशर्तींचे वि�नि�यमन) (सुधाारणाा) नि�यम, २०२५ असेे म्हणाावे.

२. महाारााष्ट्र दुकााने व आस्थाापनाा (नोकरीीचे आणिि” सेेवाशर्तींचे वि�नि�यमन) (सुधाारणाा) नि�यम, २०२५ (यात यापुढे ज्याचा नि�र्देेश

“मुख्य नि�यम” असा केला आहे) च्या नि�यम ३ मध्ये, “दहाा” या मजकुरााऐवजी “वीस” हा मजकूर दााखल करण्यात येईल.

३. मुुख्य नि�यमांं�च्या नि�यम-८ मध्ये, “दहाा” या मजकुरााऐवजी “वीस” हा मजकूर दााखल करण्यात येईल.

४. मुुख्य नि�यमांं�च्या नि�यम ११ मध्ये,-

(अ) पोट-नि�यम (१) मध्ये, “दहाा” या मजकुरााऐवजी “वीस” हा मजकूर दााखल करण्यात येईल;

(ब) पोट-नि�यम (२) मध्ये, “दहाा” या मजकुरााऐवजी “वीस” हा मजकूर दााखल करण्यात येईल;

५. मुुख्य नि�यमांं�च्या नि�यम १३ ऐवजी पुढीील नि�यम दााखल करण्यात येईल :—

“१३.- राात्री ९-३० ते सकााळी ७-०० या वेळेेत आस्थाापनांं�मध्ये कााम करणााऱ्या महि�लाा काामगाारांं�ना पुरवाावयाची सुरक्षि�तताा,

सुरक्षा उपाययोजनाा व सुरक्षा उपाय, भोोगगवटादाार, आस्थाापनांं�मध्ये महि�लाा काामगाारांं�साठीी सकााळी ७-०० पूर्वी आणिि” राात्री ९-३० नंंतर,

पुढीील अटींची पूर्तताा सुनि�श्चि�ित करीील:-

(१) महि�लाा काामगाारांं�ना त्यांं�च्या नि�वाासस्थाानाापासून आस्थाापनांं�मध्ये घेेऊन जाण्यासाठीी आणिि” पुन्हा घरीी सोडण्यासाठीी पुरेशा

वाहतुुकीच्या सुवि�धाा पुरवि�ण्यात येतील.

(२) शौचालये, स्वच्छताागृृहे, पि�ण्याचे पाणी, कपडे बदलण्याची खोली, महि�लाा काामगाारांं�च्या प्रवेश करण्याच्या व बाहेर

पडण्याच्या सोयी व सुवि�धांं�सह काामाचे ठि�कााण, चांं�गलेे प्रकााशमान असेेल.

(३) कोणत्याही काामाच्या ठि�कााणी कि�माान दोन महि�लाा काामगाार कर्ततव्यावर उपस्थि�ित रााहतीील.

(४) राात्र पाळीमध्ये व नि�यमि�त पाळीमध्ये कााम करणााऱ्या महि�लाा काामगाारांं�ना, दर आठ आठवड्याातून एकदाा तक्रार दि�न

म्हणूून त्यांं�च्या प्रति�नि�धींंमार्फफत व्यवस्थाापकााबरोबर बैठक घेेताा येईल आणिि” व्यवस्थाापक, तक्रारींचे नि�वाारण करण्याचा प्रयत्न करीील.

(५) अशा काामासाठीी व अशा काालावधीसाठीी प्रत्येक महि�लाा काामगाारााची नमुुनाा “ल” मध्ये लेखी संमतीी घेेण्यात येईल

आणिि” ती तीन वर्षांंɕसाठीी जतन करण्यात येईल.

(६) कि�माान पंचेचाळीस दि�वसांं�ची रेकॉर्डिं�ंगचीी सुवि�धाा असलेेली सीसीटीव्ही संनि�रीीक्षण यंत्रणाा बसवण्यासह, महि�लाा

काामगाारांं�च्या सुरक्षेसाठीी व सुरक्षि�ततेेसाठीी सर्वव व्यवहार्यय उपाययोजनाा केल्याची सुनि�श्चि�ित करण्यात येईल”.

६. मुुख्य नि�यमांं�सोबत जोडलेेल्या नमुुनाा-“ह” मध्ये, “दहाा” या मजकुरााऐवजी “वीस” हा मजकूर दााखल करण्यात येईल.

७. मुुख्य नि�यमांं�सोबत जोडलेेल्या नमुुनाा-“जे” मध्ये, “दहाा” या मजकुरााऐवजी “वीस” हा मजकूर दााखल करण्यात येईल.

८. मुुख्य नि�यमांं�सोबत जोडलेेल्या नमुुनाा-“के” मध्ये, “दहाा” या मजकुरााऐवजी “वीस” हा मजकूर दााखल करण्यात येईल.

NOTIFICATION

Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service)

Act, 2017.

No. MSA-1225/C.R. 153 /Lab-10.— The following draft of rules which the Government

of Maharashtra proposes to amend the Maharashtra Shops and Establishments (Regulation

of Employment and Conditions of Service) Rules, 2018, in exercise of the powers conferred by

sub- section (1) of section 37 of the Maharashtra Shops and Establishments (Regulation of Employment

and Conditions of Service) Act, 2017 (Mah. LXI of 2017), and of all other powers enabling it in

that behalf, is hereby published as required by sub-section (2) of section 37 of the said Act, for the

information of all persons likely to be affected thereby and notice is hereby given that the said draft

will be taken into consideration by the Government of Maharashtra after the expiry of forty-five

days from the date on which the draft rules are published in the Maharashtra Government Gazette.

2. Any objection or suggestion which may be received by the Commissioner of Labour,

Maharashtra State, Kamgar Bhavan, ‘E’ Block, C-20, Bandra-Kurla Complex, Bandra East,

Mumbai 400 051 or on email [email protected] from any person with respect to the

said draft, within the aforesaid period, will be considered by the Government.

DRAFT RULES

No. MSA-1225/C.R.153/Lab-10.— In exercise of the powers conferred by sub-section (1) of

section 37 of the Maharashtra Shops and Establishments (Regulation of Employment and Conditions

of Service) Act, 2017 (Mah. LXI of 2017), and of all other powers enabling it in that behalf, the

Government of Maharashtra hereby makes the following rules to amend the Maharashtra Shops

and Establishments (Regulation of Employment and Conditions of Service), Rules, 2018 the same

having been previously published as required by sub-section (2) of section 37 of the said Act, as

follows, namely:-

1. These rules may be called the Maharashtra Shops and Establishments (Regulation of

Employment and Conditions of Service) (Amendment) Rules, 2025.

2. In rule 3 of the Maharashtra Shops and Establishments (Regulation of Employment and

Conditions of Service) Rules, 2025 (hereinafter referred to as “the principal Rules”) for the word “ten”

the word “twenty” shall be substituted.भाभा

3. In rule-8 of the principal Rules, for the word “ten” the word “twenty” shall be substituted.

4. In rule 11 of the principal Rules,-

(a) in sub-rule (1), for the word “ten” the word “twenty” shall be substituted;

(b) in sub-rule (2), for the word “ten” the word “twenty” shall be substituted.

5. For rule 13 of the Principal Rules, the following rule shall be substituted, namely:-

“13.- Safety, security measures and safeguards to be provided to women workers working in

establishments between 9-30 p.m. to 7-00 a.m.- The occupier shall, for employment of women, in

Shop and Establishments before 7-00 a.m. and beyond 9-30 p.m., ensure the following conditions,

namely:-

(1) Adequate transportation facilities shall be provided to women worker to pick-up from

her residence and drop to establishment and vice-versa.

(2) The workplace including passage towards conveniences and facilities concerning toilets,

washrooms, drinking water, changing room, entry and exit of women worker should be well-lit.

(3) Minimum two women workers shall be present on duty at any work place.

(4) The women worker, who work in night shifts and regular shifts, shall have a meeting

through their representatives with the manager, once in eight weeks as grievance day and the

manager shall try to comply with grievances.

(5) Written consent of each woman worker for such work and for such period, shall be

obtained in Form “L” and preserved for three years.

(6) All reasonably practicable measures shall be ensured for the safety and security of

women worker including installation of CCTV surveillance with recording facilities for at least

forty-five days.”.

6. In Form “H” appended to the principal Rules, in the heading for the word “ten” the word

“twenty” shall be substituted.

7. In Form “J” appended to the principal Rules, in the heading for the word “ten” the word

“twenty” shall be substituted.

8. In Form “K” appended to the principal Rules, in the heading for the word “ten” the word

“twenty” shall be substituted.
