क्र. आयडीसी २०२५/(प्र.क्र.५२६)/उद्योोग-१४.– ज्याअर्थीी, अनुसूचि�त उल्लेखिि‡लेल्या क्षेेत्राात महााराष्ट्र औद्योोगि�क

विि¦काास अधिि˜नि�यम, १९६१ (१९६२ चाा महाा. तीन) चे प्रकरण सहाा, जे अधिि˜सूचनाा क्रमांं�क आयडीसी २०११/(५३९)/उ-१४,

दि�नांं�क ९ ऑगस्ट २०११ अन्वये महााराष्ट्र शाासनााने सदर अधिि˜सूचनेेच्या (यापुुढेे ज्याचाा उल्लेख "उक्त अधिि˜नि�यम" असा करण्यात येईल)

चे कलम सहाा, दि�नांं�क ११ ऑगस्ट, २०११ रोजी अंमलाात आणले होते व उक्त अधिि˜नि�यमााच्या आधारे मौजे वडगाव (सि�ध्देश्वर),

ताालुकाा धाराशि�व, जि�ल्हा धाराशि�व येथीथीील उक्त अनुसूचीत नमूूद केलेले क्षेेत्र अधिि˜नि�यमााच्या कलम २, खंड (ग) अन्वये औद्योोगि�क

क्षेेत्र म्हणूून जाहीर केलेले आहे;

आणि� ज्याअर्थीी उपविि¦भाागीय अधिि˜काारी, व भूसंंपादन अधिि˜काारी धाराशि�व यां�नीी उक्त अधिि˜नि�यमाातील कलम ३२ च्या पोट-कलम

ी संंभााजीनगर विि¦भाागीय पुुरवणी, पृष्ठ क्रमांं�क १४८७-१४८९ दि�नांं�क ९ ऑक्टोबर २०१४ च्या महााराष्ट्र

शाासनााच्या राजपत्राात नोटीस क्रमांं�क २०११-एल. एन. क्यु. सीआर-२, दि�नांं�क २० सप्टेंबर २०१४ रोजी प्रसि�ध्द करून, उक्त औद्योोगि�क

क्षेेत्राासाठी भूसंंपादन प्रक्रि�या सुरू केली आहे आणि� उक्त कलम ३२ च्या पोट-कलम (४) नुसार उक्त नोटीसेेत नमूूद केलेले क्षेेत्र सर्वव भाार

मुक्त होवून राज्य शाासनााच्या ठायी नि�हीीत झााले आहे.

आणि� ज्याअर्थीी, या सोबत जोडलेल्या अनुसूचीतील जमि�नीीचाा (यापुुढेे जि�चाा उल्लेख उक्त जमीन असा करण्यात येईल) तााबा

राज्य शाासन किं�ंवा त्याच्या वतीीने घेेण्यात आलेला नााही आणि� उक्त जमीन उक्त काायद्याच्या प्रयोजनाासाठी आवश्यक नााही असेे राज्य

शाासनााचे मत झााले आहे.

त्याअर्थीी आताा, उक्त अधिि˜नि�यमााच्या कलम ३२ च्या पोट-कलम (४) मधीील परंंतुक व इतर अधिि˜काारांं�चाा वापर करून राज्य शाासन

उक्त जमीन संंपादनाातून कााढून घेेत आहे आणि� असेे घोषिि¨त करीीत आहे की, ही सूचनाा महाारााष्ट्र शाासन रााजपत्रात प्रसि�द्ध झााल्यानंंतर

कलम ३२ च्या पोट-कलम (१) नुसार नोटीस प्रसि�द्ध होण्याच्या लगतपूूर्वी उक्त जमीन जि�च्याकडेे नि�हीीत होती त्या व्यक्तीकडेे ती त्यावेळीी

अस्ति�िवाात असतीील असेे भाारां�नाा अधिि˜न राहून पूर्ववलक्षी प्रभाावासह पुुनर्नि�िहि�त

होईल.

NOTIFICATION

No. IDC 2025/(C.R.526)/IND- 14).– Whereas, by the Government Notification, Industries,

Energy and Labour Department, No. IDC. 2011/(539)/IND-14, dated the 09th August, 2011 issued

under sub-section (3) of section 1 of the Maharashtra Industrial Development Act, 1961 (Mah.III of

1962) (hereinafter referred to as “the said Act “), the Government of Maharashtra has appointed the

11th August, 2011 to be the date from which the provisions of Chapter VI of the said Act shall take

effect in certain areas in village Wadgaon (Siddheshwar) in Taluka Dharashiv, District Dharashiv

mentioned in the Schedule appended to the said notification and declared those area as an industrial

area under clause (g) of section 2 of the said Act;

And whereas, as per the provisions of the said act, the Sub-Divisonal Officer, and Land

Acuquisition Officer Dharashiv has, by issuing Notice No. 2011/LNQ/CR-2 dated 20/9/2014,

published in the Maharashtra Government Gazette, Part 1 Chhatrapati Sambhaji Nagar Divisional

Supplementary, on page No.1490 to 1491 dated 9th October, 2014 under sub-section (1) of section

32 of the said Act, initiated the process for the acquisition of lands in the said industrial area, and

as such, the lands mentioned in the said notice have vested absolutely in the State Government free

from all encumbrances under sub-section (4) of said section 32;

And whereas, the actual possession of the land mentioned in the Schedule appended hereto

(thereinafter referred to as “the said land”) was not taken by or on behalf of the State Government

and it appeared to the State Government that the said land is no more required for the purposes of

the said Act;

Now, therefore in exercise of the powers conferred by the proviso to sub-section (4) of section 32

of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra

hereby withdraws the said land from acquisition and declares that, on the publication of this Notice

in the Maharashtra Government Gazette, the said land shall re-vest with retrospective effect in the

person in whom it was vesting immediately before the publication of the notice under sub-section

(1) of the said section 32, subject to such encumbrances, if any, as may be subsisting at that time.
