क्रमांं�क एमसीओ-२०२५/प्र.क्र.५३४/नवि¦-१४.—महारााष्ट्र महानगरपाालि�केच्या नि�वड

णुुकीच्या प्रयोजनाार्थथ महारााष्ट्र महानगरपाालि�का

(१९४९ चा महा. ५९) च्या अनुसूची ‘ड’ मधीील महारााष्ट्र महानगरपाालि�का नि�वडणूूक नि�यमांं�मध्ये आणखीी सुधारणाा करणेे इष्ट वाटते;

आणि� ज्याअर्थी, याबाबत ताात्काळ कार्ययवाही करण्यासाठीी या नि�यमां�चीी पूर्ववप्रसि�ध्दीची शर्तत काढूून टाकणे, जीमुळे आवश्यक व्हावे

अशी परि�स्थिĒितीी अस्तििĒित्वात असल्याबद्दल महारााष्ट्र शासनााची खात्री पटली आहे.

त्याअर्थी, आताा महारााष्ट्र महानगरपाालि�का अधि�नि�यम (१९४९ चा महा. ५९) कलम ४५६अ द्वाारे प्रदाान करण्यात आलेल्या

अधि�काारांं�चा आणि� यासंंदर्भाभाा�त त्यास समर्थथ करणााऱ्या इतर सर्वव अधि�काारांं�चा वापर करुन, महारााष्ट्र शासन, रााज्य नि�वडणूूक आयुक्तांं�शी

वि¦चारवि¦नि�मय करून, अनुसूची ‘ड’ मधीील महारााष्ट्र महानगरपाालि�का नि�वडणूूक नि�यमांं�मध्ये आणखीी सुधारणाा करुन, याद्वाारे पुढील

नि�यम तयाार करीत आहे :—

१. या नि�यमां�नाा महारााष्ट्र महानगरपाालि�का अनुसूची ‘ड’ मधीील नि�वडणूूक (सुधारणाा) नि�यम, २०२५ असेे म्हणण्यात येईल.

२. महारााष्ट्र महानगरपाालि�का अधि�नि�यम (१९४९ चा महा. ५९) च्या अनुसूची ‘ड’ मधीील महारााष्ट्र महानगरपाालि�का

नि�वडणूूक नि�यमांं�च्या नि�यम ११ मध्ये, उप-नि�यम (३) ऐवजी, खालील उप-नि�यम समाावि¦ष्‍‍ट करण्यात येत आहे :—

“(३) (i) नि�वडणूूक चि�न्ह नेमून दि�ल्यानंंतर नि�वडणूूक नि�र्णणय अधि�काारी, उमेदवाारांं�ची नाावे खालील पध्दतीीने दर्शवूून

उमेदवाारांं�ची यादी प्रसि�ध्द करेल :—

(अ) पहि�लाा गट.—भाारत नि�वडणूूक आयोगाने मान्यताा दि�लेेल्या ज्या पक्षांं�नीी रााज्य नि�वडणूूक आयोगाकडे

नोंंदणीी केलेली आहे असेे मान्यतााप्राप्त रााष्ट्रीय पक्ष व महारााष्ट्र रााज्यातील मान्यतााप्राप्त रााज्यस्तरीीय पक्ष यां�चेे उमेदवाार.

(ब) दुसराा गट.—भाारत नि�वडणूूक आयोगाने मान्यताा दि�लेेल्या ज्या इतर रााज्यातील रााज्यस्तरीीय पक्षांं�नीी रााज्य

नि�वडणूूक आयोगाकडे नोंंदणीी केली आहे अशा पक्षांं�चेे उमेदवाार.

(क) ति�सराा गट.—रााज्य नि�वडणूूक आयोगाकडे नोंंदणीी झाालेले अमान्यतााप्राप्त रााजकीय पक्ष यां�चेे उमेदवाार.

(ड) चौौथाा गट.—अपक्ष उमेदवाार

(ii) वरीीलप्रमाणे प्रत्येक गटातील उमेदवाारांं�चा क्रम लावताानाा तो मरााठीी भााषेेतील वर्णा�नुुक्रमानुसार लावण्यात यावा.

उमेदवाारांं�चा क्रम लावताानाा प्रथथम त्यां�चेे आडनांं�व (आडनााव नसल्यास नांं�व), त्यानंंतर नांं�व व त्यानंंतर पत्ताा वि¦चाराात घ्यावा.”

NOTIFICATION

Maharashtra Municipal Corporations Act, 1949.

No.MCO-2025/C.R.534/UD-14.-Whereas, it is expedient further to amend the Maharashtra

Municipal Corporations Election Rules in SCHEDULE ‘ D ’ of the Maharashtra Municipal Corporations

(LIX of 1949) for the purpose of conduct of election of Municipal Corporations;

And Whereas the Government of Maharashtra is satisfied that circumstances exist which

render it necessary to take immediate action; and for that purpose to dispense with the condition of

previous publication thereof;

Now, therefore, in exercise of the powers conferred by section 456A of the Maharashtra Municipal

Corporations Act (LIX of 1949) and of all other powers enabling it in that behalf, the Government

of Maharashtra hereby, in consultation with the State Election Commissioner, makes the following

rules further to amend Maharashtra Municipal Corporations Election Rules in SCHEDULE ‘ D ’ of

the said Act, as follows, namely :—

These rules may be called the Maharashtra Municipal Corporations Election Rules

in SCHEDULE ‘ D ’ (Amendment) Rules, 2025.

In rule 11 of the Maharashtra Municipal Corporations Election Rules in SCHEDULE

‘ D ’ of the Maharashtra Municipal Corporations Act (LIX of 1949), for sub-rule (3), the following

sub-rule shall be substituted, namely :—

“(3) (i) After allocation of symbols, the Returning Officer shall publish a list of the

contesting candidates by arranging the names of candidates in the following order,—

(a) First Group.—Candidates of the National Parties and the State- level Parties

in Maharashtra recognised by the Election Commission of India and registered with

the State Election Commission.

(b) Second Group.—Candidates of State-level Parties of other States recognised by

the Election Commission of India and registered with the State Election Commission.

(c) Third Group.—Candidates of unrecognized political parties registered with

the State Election Commission.

(d) Fourth Group.—Independent Candidates.

(ii) The names of candidates in each of the above groups shall be arranged in alphabetical

order in Marathi beginning with the surnames (in respect of candidates having surnames)

followed by their names and addresses as stated in the nomination papers.".
