BRIHANMUMBAI MUNICIPAL CORPORATION

NOTIFICATION

क्रमांं�क प्र. अ./(वि¦.नि�)/२४१६३/पुु. उप.—Whereas, as per the powers conferred by sub-section (1) of

section 31 of the MR and TP Act, 1966, State Government has accorded sanction to the Draft

Development Plan-2034 of Greater Mumbai (hereinafter referred to as “the said Development Plan”)

vide Notification No. TPB-4317/629/CR-118/2017/DP/UD-11, Dt. 08.05.2018 (hereinafter referred to

as “the said Notification”) along with the Development Control and Promotion Regulations-2034 for

Greater Mumbai ;

And whereas, as per the DP-2034, of ‘S’ Ward the land bearing C.T.S. No. 657(pt) of village

Kanjur(E) is affected by the reservation of RR2.2(Affordable Housing) & ROS1.5(Garden/Park).

Further, it is affected by 9.15 mt., 18.30 mt(4 nos.) & 27.45 mt wide proposed DP Road and Existing

roads ;

And whereas, M/s. Jolly Brothers Pvt. Ltd. vide their letter dated 29.07.2020, requested the

Urban Development Department, Government of Maharashtra, to delete the proposed 18.30 mt wide

diagonal DP road affecting the land bearing C.T.S. No. 657(pt) of village Kanjur (E), in ‘S’ Ward ;

And whereas, Under Secretary, Urban Development Dept.(UDD), GoM, vide their letter dated

09.07.2024, informed that the modification proposal should be submitted to the Goverment by

following the procedure for modification under section 37(1) of the Maharashtra Regional and Town

Planning Act ;

And whereas, in the sanctioned Development Plan-2034 of ‘S’ Ward, it is proposed to delete the

18.30 mt wide diagonal DP road affecting the land bearing C.T.S. No. 657(pt) of village Kanjur(E)

having area adm. approx. 8383.8 sq.mt and to include the said land in the adjoining reservation of

‘Affordable Housing (RR2.2)’ ;

And whereas, Administrator (Improvement Committee) vide Resolution No. 83 of 09.12.2025

and Administrator (Corporation) vide Resolution No. 927 dtd. 10.12.2025 has accorded sanction to

initiate the modification proposal u/s. 37(1) of MRTP Act, 1966 , to invite suggestions/ objections

from general public to conduct hearing on said suggestions /objections and to make correspondence

with State Govt. in Urban Development Dept for final sanction u/s. 37(2) of MRTP Act, 1966 for the

proposed modification in Sanctioned DP 2034 ;

And whereas, as per circular u/no. BMC/ADMN/3, dt. 07.04.2022, under section 6C (1) of Mumbai

Municipal Corporation Act, 1888 (hereinafter referred as ‘MMC Act,1888’) all the powers of the

Corporation are now vested with the Administrator ;

And whereas, in exercise of the powers conferred by sub-section (1) and (2) of Section 37 of the

Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as “MR & TP Act,

1966”), the Planning Authority may, or when so directed by the State Government shall within one

month from date of such directions publish a notice inviting suggestions/ objections from any person,

as mentioned therein and after giving hearing, submit the proposed modification to the State

Government and the State Government subject to such condition as it may deem fit sanction the

modification or refuse to accord sanction.

Now, therefore, after considering the above facts and circumstances and in exercise of the powers

conferred by sub-section (1) of Section 37 of the MR & TP Act, 1966; and of all other powers enabling

it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby

publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed

modification, as required by Section 37(1) of the said Act, for information of all persons likely to be

affected thereby. BMC is further pleased to inform that any objections/ suggestions in respect of the

proposed modification mentioned above may be forwarded, in writing before the expiry of 30 days

from the date of publication of this notification, to the office of

Notice

No. Ch.E/DP/24357/City.—Whereas, in exercise of the powers conferred by sub section (1) and

(2) of Section 37 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to

as “MR & TP Act, 1966”), the Planning Authority may, or when so directed by the State Government

shall within one month from date of such directions publish a notice inviting suggestions/ objections

from any person, as mentioned therein and after giving hearing, submit the proposed modification

to the State Government and the State Government subject to such condition as it may deem fit

sanction the modification or refuse to accord sanction ;

And whereas, as per circular u/No. BMC/ADMN/3, dt. 07.04.2022, under section 6C (1) of Mumbai

Municipal Corporation Act, 1888 (hereinafter referred as ‘MMC Act. 1888’) all the powers of the

Corporation are now vested with the Administrator;

And whereas, Administrator (Corporation) has accorded sanction to the proposal vide resolution

No. 988 dtd. 12.12.2025, to take further action regarding deletion of Existing Amenity of

EPU5.2(Electricity transmission & distribution facilities) + ET1.4(Best bus facilities) shown on entire

plot bearing CS No.1B/669 of Malabar Hill div. in D Ward admeasuring 2475.07sqm (herein referred

as ‘the said plot’), and to include said CS No.1B/669 of Malabar Hill div. in adjoining predominant

zone of Residential zone (R zone), so as to modify the Sanctioned DP 2034 and to invite suggestions/

objections from general public u/sec 37(1) of MRTP Act, 1966 and to approach State Govt. in Urban

Development Dept for final sanction u/sec 37(2) of MRTP Act, 1966 for modification in Sanctioned

DP 2034 ;

And whereas, as per the powers conferred by sub-section (1) of Section 31 of the MR & TP

Act, 1966, State Government has accorded sanction to the Draft Development Plan- 2034 of Greater

Mumbai (hereinafter referred to as “the said Development Plan”) vide Notification No. TPB-4317/629/

CR-118/2017/DP/UD-11, Dt. 08.05.2018 (hereinafter referred to as “the said Notification”) along with

the Development Control and Promotion Regulations-2034 for Greater Mumbai with modifications

shown in SCHEDULE-A appended to the said Notification excluding the substantial modifications

as shown in SCHEDULE-B appended to the said Notification ;

And whereas, thereafter Government has issued a Corrigendum and Addendum dtd. 29th

June 2018 to the said Notification, which is published in the Government Gazette dated 30th

June, 2018 ;

And whereas, Government has issued a corrigendum dated 22nd June 2018 to the said

Notification, as per which, the said Development Plan has come into force from 01.09.2018 ;

And whereas, a letter u/No. DO/GM/CEC/15193/2025, dated 05.12.2025 is received from General

Manager, BEST Undertaking addressed to the Municipal Commissioner, wherein it is mentioned

that, the BEST Undertaking has initiated tender process to lease its existing staff/officer’s quarters

to third parties for residential use in order to generate additional revenue to augment non-fare box

revenue which will be instrumental in enhancing the Undertaking’s operational efficiency and service

delivery. Plot bearing CS No.1B/669 of Malabar Hill is categorized under existing amenity

EPU5.2+ET1.4 (Electricity transmission & distribution facilities+ Best bus facilities) which allows

for ancillary use of emergency/essential BEST staff quarters. Leasing these flats to third party for

general residential use would therefore require a change in land use classification in DP-2034 ;

And whereas, also as per letter dtd 02.12.2025 from UDD, GoM, wherein, it is directed to initiate

the process of 37(1) of MR & TP Act, 1966 for deletion of existing amenity EPU5.2+ET1.4 (Electricity

transmission & distribution facilities+ Best bus facilities) on the said plot in DP-2034. As per online

PRC ownership details of said plot bearing CS No.1B/669 Malabar Hill vests with ‘ The BEST

Undertaking ’ and plot area as per PRC is 2475.07 sqm. As per DP 2034, entire area of said plot is

seen to be affected by existing amenity of EPU5.2 (Electricity transmission & distribution facilities)

+ ET1.4(Best bus facilities) ;

And whereas, as per the request of BEST Undertaking and the directions from Govt. in UDD,

it is proposed to delete the Existing Amenity of EPU5.2 (Electricity transmission & distribution

facilities) + ET1.4(Best bus facilities) shown on entire plot bearing CS No.1B/669 of Malabar Hill

div. in D Ward admeasuring 2475.07sqm and to include said plot in adjoining predominant zone of

Residential zone (R zone) u/sec.37(1) of MR & TP Act, 1966, Municipal Corporation of Greater

Mumbai has accorded sanction vide Improvement Committee Resolution No. 103, dtd 12.12.2025

and Corporation Resolution No. 988 dtd 12.12.2025 for initiating the process of aforesaid modification

as per su-bsection (1) of Section 37 MR & TP Act, 1966.

Now, therefore, after considering the above facts and whereas Chief Engineer (Development

Plan) is empowered to invite suggestions/objections u/s. 37(1) of MRTP Act, 1966 for proposed

modification in Sanctioned DP 2034.

Now, therefore, after considering the above facts and circumstances and in exercise of the powers

conferred by sub-section (1) of Section 37 of the said Act; and of all other powers enabling it in this

behalf, MCGM hereby publishes a Notice for inviting objections / suggestions from any persons with

respect to proposed modification, as required by Section 37(1) of the said Act, for information of all

persons likely to be affected thereby. MCGM is further pleased to inform that any objections/

suggestions in respect of the proposed modification mentioned in the Schedule given below may be

forwarded, in writing before the expiry of one month from the date of publication of this notification,

Notice

No. Ch.E/DP/23048/WS.—Whereas, the Brihanmumbai Municipal Corporation is the Planning

Authority for the area within its jurisdiction (hereinafter referred to as “the said Corporation”) as

per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as

‘MR & TP Act, 1966) ;

Whereas, in exercise of the powers conferred by sub-section (l) of Section 3l of the said Act, the

State Government vide Notification No. TPB-4317/629/CR-118/2017 /DP/UD-11, Dt. 08/05/2018

(hereinafter referred to as “the said Notification”) has accorded sanction to the Draft Development

Plan-2034 of Greater Mumbai (hereinafter referred to as “the said Development Plan”) along with

the Development Control and Promotion Regulations-2034 (hereinafter referred to as “the said

Regulations”) for Greater Mumbai with modifications shown in SCHEDULE-A appended to the said

Notification excluding the substantial modifications as shown in SCHEDULE-B appended to the

said Notification; And whereas, Government has issued corrigendum of even number dt.22nd June,

2018; and whereas, thereafter Government has issued a corrigendum and Addendum of even number

dt. 29th June, 2018 to the said Notification, which is published in Government Gazette dt. 30th June,

2018; and whereas, the said Regulations have come into force from l/09/2018;

And whereas, in exercise of the powers conferred by sub-section (1) and (2) of Section 37 of

the ‘MR & TP Act, 1966, the Planning Authority may, or when so directed by the State Government

shall within Ninety days from date of such directions publish a notice inviting objections and

suggestions from any person, as mentioned therein and after giving hearing, submit the proposed

modification to the State Government and the State Government subject to such condition as it may

deem fit sanction the modification or refuse to accord sanction;

And whereas, as per circular u/no. BMC/ADMN/3, dt. 07.04.2022, under section 6C (1) of Mumbai

Municipal Corporation Act, 1888 (hereinafter referred as ‘MMC Act,1888’) all the powers of the

Corporation are now vested with the Administrator;

And whereas, with respect to this office remarks dtd: 22.07.2021 & 16.09.2024 to Under Secretary,

UDD in GoM. Under Secretary, UDD vide letter dtd. 16.09.2024 has directed as follows:

And whereas, Administrator (Improvement Committee) & Administrator (Corporation) has

accorded sanction vide resolution u/no.101 Dtd.12.12.2025 & u/no.982 dtd:12.12.2025 respectively

to process the proposal and for inviting suggestions/ objections under section 37(1) of MR & TP Act

& to make correspondence with the UD Department, Government of Maharashtra for final sanction

u/s 37 (2) of MR & TP Act regarding modification in respect of plot bearing CTS No.203 of Village :

Majas in K/East ward in D. P. 2034 under section 37(1) of Maharashtra Regional and Town Planning

Act, 1966 by deleting the reservation of ROS 1.5 (Garden / Park) affecting on said land & including

the said land in residential (R) zone as per direction of UDD, GoM to be reads with Plan u/n: Ch.E/

D.P/23048/WS. Dtd. 09.12.2025.

And whereas, Administrator (Improvement Committee) & Administrator (Corporation) has

empowered the Municipal Commissioner of Brihanmumbai Municipal Corporation to take further

action under section 37(1) of the Maharashtra Regional & Town Planning Act, 1966 and also

empowered to approach UDD, GoM for seeking the final sanction of State Government u/s 37(2) of

Maharashtra Regional & Town Planning Act 1966 for proposed modification in Sanctioned

Development Plan 2034 of ‘K/East’ Ward.

Now, therefore, after considering the above facts and circumstances and in exercise of the powers

conferred by subsection (1) of Section 37 of the MR & TP Act, 1966; and of all other powers enabling

it in this behalf, Brihanmumbai Municipal Corporation (hereinafter referred as BMC) hereby

publishes a Notice for inviting objections/ suggestions from any persons with respect to proposed

modification as required by Section 37(1) of the said Act, for information of all persons likely to be

affected thereby. BMC is further pleased to inform that any suggestions and /or objections in respect

of the proposed modification mentioned above may be forwarded, in writing before the expiry of one

month from the date of publication of this notification to:

5th floor, Brihanmumbai Municipal Corporation,

Municipal Head office, Mahapalika Marg, Fort, Mumbai 1400 001.

Any suggestions and /or objections, which may be received within the said period will be dealt

with in accordance with the provisions of Section 37(1) of the said Act by the Chief Engineer

(Development Plan) BMC. The suggestions and /or objections received after the aforesaid period will

not be considered.

A plan in respect of proposed modification to the Sanctioned Development Plan 2034 of K/E

Ward is kept open for inspection of the general public during office hours except Saturday, Sunday

and Public holidays, at the following offices:-
