२४३ के व २४३ झेडए अन््वये राज्यातील सर्व स््थथानिक स््वराज्य संस््थथाांांच्या निवडणुकांचे अधीक्षण, संचलन व नियंत्रणाची जबाबदारी

राज्य निवडणूक आयोगाची आहे ; आणि

ज्याअर्थी, राजकीय पक््षाांांच्या नोंदणीसंदर््भभात वेळोवेळी निर््गमित केलेल्या आदेशांची अंमलबजावणी करताना होणारा संभ्रम दूर

करण्याकरिता, आदेशांच्या अंमलबजावणीमध्ये एकसूत्रता आणण्यासाठी ¨महाराष्टट्र राज्य राजकीय पक्ष नोंदणी, विनियमन आणि निवडणूक

चिन्ह (आरक्षण व वाटप) आदेश, २०२५° दिनांक ५ मे २०२५ रोजीचा आदेश राजपत्रात प्रसिद्ध करण्यात आला आहे.

त्याअर्थी, उक्त आदेशामध्ये पुढीलप्रमाणे सुधारणा करणे आवश्यक असल््ययाची राज्य निवडणूक आयोगाची खात्री झाल्याने

आणि उक्त आदेशातील परिच््छछेद २७ मधील राज्य निवडणूक आयोगास प्राप्त अधिकारान््वये खालीलप्रमाणे आदेश देण्यात येत आहे.

महाराष्टट्र राज्य राजकीय पक्ष नोंदणी, विनियमन आणि निवडणूक चिन्ह (आरक्षण व वाटप) आदेश, २०२५ दिनांक ५ मे २०२५ च्या

आदेशातील परिच््छछेद १३ व परिच््छछेद १४ मधील आधीच्या तरतुदी रद्द करून सुधारित परिच््छछेद १३ व परिच््छछेद १४ सामाविष््ट करण्यात

येत आहे :

उक्त आदेशातील परिच््छछेेद १३ व परिच््छछेेद १४ मधील आधीच््या तरतुदी

१३. नोंदणीकृत अमान््यताप्ाप्त राजकीयय पक्ष व अपक्ष उमेदवारांबाबत :

(१) स््थथानिक स््वराज्य संस््थथाांांच्या निवडणुकीत नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाचे उमेदवार व अपक्ष उमेदवारास

नामनिर्देशनपत्र दाखल करताना परिच््छछेद २३(१) (ङ) नुसार मुक्त चिन्हे म्हणून विनिर््ददिष््टटित केलेल्या चिन््हहाांांपैकी जास्तीत जास्त

कोणत्याही तीन चिन््हहाांची प्राधान्यक्रमानुसार मागणी करता येईल.

(२) निवडणूक निर््णय अधिकारी हा राज्य निवडणूक आयोगाकडील नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाच्या उमेदवारांना

चिन्ह वाटप केल्यानंतर अपक्ष उमेदवारांना चिन््हहाचे वाटप करेल.

(३) जर अनेक उमेदवारांनी एकाच मुक्त चिन््हहाची निवड केली आणि जर या अनेक उमेदवारांपैकी एक उमेदवार नोंदणीकृत

अमान्यताप्राप्त राजकीय पक्षाचा असेल आणि उर्वरित अपक्ष उमेदवार असल्यास, निवडणूक निर््णय अधिकारी ते मुक्त चिन्ह नोंदणीकृत

अमान्यताप्राप्त राजकीय पक्षाच्या उमेदवारास देईल, इतर कोणासही देणार नाही.

(४) जर या अनेक उमेदवारांपैकी दोन किंवा त्यापेक्षा अधिक उमेदवार नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाचे असल्यास

आणि उर्वरित अपक्ष उमेदवार असल्यास, निवडणूक निर््णय अधिकारी फक्त नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाच्या उमेदवारांच्या

नावाच्या चिठ्ा टाकून (सोडतीद्ारे) निर््णय घेईल. ज्या नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाच्या उमेदवाराच्या नावाची चिठ्ी येईल,

त्या उमेदवारास त्याने मागणी केलेल्या मुक्त चिन््हहाचे वाटप करेल आणि इतर कोणासही नाही.

(५) जर अशा निवडणुकीत अनेक अपक्ष उमेदवारांनी प्राधान्यक्रमानुसार एकाच मुक्त चिन््हहाची निवड केली असल्यास संबंधित

निवडणूक निर््णय अधिकारी अपक्ष उमेदवारांना चिन्ह वाटप करण्यासाठी सोडत पद्धतीने निर््णय घेईल. ज्या उमेदवाराच्या नावाची चिठ्ी

निघेल, त्या उमेदवारास त्या मुक्त चिन््हहाचे वाटप करेल. या पद्धतीचा अवलंब करून व प्राधान्यक्रम विचारात घेऊन सर्व अपक्ष उमेदवारांना

चिन््हहाांचे वाटप करण्यात येईल.

(६) प्राधान्यक्रम किंवा सोडतीनंतरही नोंदणीकृत अमान्यताप्राप्त राजकीय पक्ष अथवा अपक्ष उमदेवारास चिन्ह वाटप होऊ न

शकल्यास, मुक्त चिन््हहाांांच्या सूचीतील शिल्लक मुक्त चिन््हहाांांपैकी जे चिन्ह अनुक्रमानुसार उपलब्ध असेल त्या चिन््हहाचे संबंधित उमेदवारास

वाटप केले जाईल.

१४. ययथास््थथिती महापौर व नगरपरिषद, नगरपंचाययतीच््या अध््यक्षपदाच््या थेट निवडणुकीबाबत:

(१) यथास््थथिती महापौर किंवा नगरपरिषद/नगरपंचायतींच्या अध्यक्षपदासाठी थेट निवडणूक होत असल्यास, सुरुवातीला महापौर/

अध्यक्षपदाच्या उमेदवारांना प्राधान्याने चिन्ह वाटप केले जाईल. त््ययाांांना वाटप केलेली चिन्हे मुक्त चिन््हहाांांपैकी असल्यास त्या मुक्त चिन््हहाांचे

वाटप सदस्यपदाच्या इतर कोणत्याही उमेदवारांना केले जाणार नाही :

परंतु, एखादा उमेदवार महापौर/अध्यक्षपदासोबत सदस्यपदाची निवडणूक लढवत असल्यास, त्या उमेदवारास महापौर/

अध्यक्षपदाकरिता वाटप करण्यात आलेले चिन्ह त्याने मागणी केल्यास, तो निवडणूक लढवत असलेल्या प्रभागांतील सदस्यपदांकरितादेखील

देण्यात येईल.

सुधारित परिच््छछेेद १३ व परिच््छछेेद १४ मधील तरतुदी

१३. नोंदणीकृत अमान््यताप्ाप्त राजकीयय पक्ष व अपक्ष उमेदवारांबाबत:

नामनिर्देशनपत्र दाखल करताना परिच््छछेद २३(१)(ङ) नुसार मुक्त चिन्हे म्हणून विनिर््ददिष््टटित केलेल्या चिन््हहाांांपैकी जास्तीत जास्त कोणत्याही

तीन चिन््हहाांची प्राधान्यक्रमानुसार मागणी करता येईल.

चिन्ह वाटप केल्यानंतर अपक्ष उमेदवारांना चिन््हहाचे वाटप करेल.

अमान्यताप्राप्त राजकीय पक्षाच्या उमेदवारास देईल, इतर कोणासही देणार नाही.

(क) जिल्हापरिषद व पंचायत समितीसाठी: एखाद्ा नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाच्या उमेदवारास एका जिल्हापरिषद

विभागासाठी मुक्त चिन््हहाचे परिच््छछेद १३(३) प्रमाणे वाटप केल्यास, त््ययाच नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाच्या उमेदवारांस त््ययाांांच्या

नामनिर्देशनपत्रातील मागणीनुसार त्या जिल्हापरिषद विभागाअंतर््गत येणाऱ्या दोन्ही पंचायत समिती निर््वाचक गणासाठीदेखील जिल्हापरिषद

विभागासाठी वाटप करण्यात आलेले मुक्त चिन्ह देण्यात येईल, तसेच असे मुक्त चिन्ह संबंधित जिल्हापरिषद विभागाअंतर््गतच्या दोन्ही

निर््वाचक गणातील अन्य कुठल्याही उमेदवारास वाटप केले जाणार नाही.

विभागासाठी मुक्त चिन््हहाचे परिच््छछेद १३(४) प्रमाणे वाटप केल्यास, त््ययाच नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाच्या उमेदवारांस त््ययाांांच्या

निर््वाचक गणातील अन्य कुठल्याही उमेदवारास वाटप केले जाणार नाही.

चिन््हहाांचे वाटप करण्यात येईल.

(क) जिल्हापरिषद व पंचायत समितीसाठी: एखाद्ा अपक्ष उमेदवारास परिच््छछेद १३(५) प्रमाणे एका जिल्हापरिषद विभागासाठी

मुक्त चिन््हहाचे वाटप केल्यास, व सदर अपक्ष उमेदवार त्या जिल्हापरिषद विभागांतर््गत येणाऱ्या पंचायत समिती निर््वाचक गणासाठीदेखील

निवडणूक लढवत असल्यास त्या अपक्ष उमेदवारास त्याच्या नामनिर्देशनपत्रातील मागणीनुसार पंचायत समिती निर््वाचक गणासाठीदेखील

जिल्हापरिषद विभागासाठी वाटप करण्यात आलेले मुक्त चिन्ह देण्यात येईल, तसेच असे मुक्त चिन्ह संबंधित जिल्हापरिषद विभागाअंतर््गतच्या

दोन्ही निर््वाचक गणातील अन्य कुठल्याही उमेदवारास वाटप केले जाणार नाही.

वाटप केले जाईल.

(१) यथास््थथिती महापौर किंवा नगरपरिषद/नगरपंचायतीच्या अध्यक्षपदासाठी थेट निवडणूक होत असल्यास, सुरुवातीला महापौर/

अध्यक्षपदाच्या उमेदवारांना प्राधान्याने चिन्ह वाटप केले जाईल. एखाद्ा नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाच्या महापौर/अध्यक्षपदाच्या

उमेदवारास वाटप केलेले चिन्ह मुक्त चिन््हहाांांपैकी असल्यास आणि तो उमेदवार त््ययाच नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाकडून

सदस्यपदाचीही निवडणूक लढवित असल्यास त्या उमेदवाराने त्याच्या नामनिर्देशनपत्रात त््ययाच मुक्त चिन््हहाची मागणी केली असल्यास,

त्याला त्या मुक्त चिन््हहाचे थेट वाटप करावे.

(२) एखाद्ा नोंदणीकृत अमान्यताप्राप्त राजकीय पक्षाकडून महापौर/अध्यक्षपदाची निवडणूक लढविणाऱ्या उमेदवारास वाटप

करण्यात आलेले चिन्ह हे मुक्त चिन््हहाांांपैकी असल्यास त्या मुक्त चिन््हहाचे नोंदणीकृत अमान्यताप्राप्त राजकीय पक््षाांांच्या सदस्यपदांच्या

उमेदवारांना त््ययाांांच्या नामनिर्देशनपत्रातील मागणीनुसार परिच््छछेद १३ आणि १५(२)(क) मधील तरतुदीनुसार वाटप करण्यात येईल.

NOTIFICATION

Reference.— 1. ‘Maharashtra State Political Parties Registration, Regulation and Election

Symbols(Reservation and Allotment) Order, 2025’, dated 5th May 2025.

2. State Election Commission Order No. SEC/RPP/2024/CR-24/D-11,

dated 25th November, 2025.

3. State Election Commission Order No. SEC/RPP/2024/CR-24/D-11, Dated 21st

January 2026.

No. SEC/RPP/2026/CR-24/D-11, dated 23rd January 2026.—Whereas, as per Articles 243K and

243ZA of the Constitution of India, the State Election Commission is empowered with all rights in

respect of supervision, direction and control of all elections to all local self-government bodies in the

State ; and

Whereas, in order to consolidate all previous orders and remove any probable confusion while

implementing the orders issued from time to time regarding the registration of political parties, and

to bring uniformity in the implementation of the orders, the ‘Maharashtra State Political Parties

Registration, Regulation and Election Symbols (Reservation and Allotment) Order, 2025’, dated 05th

May, 2025 has been published in the Gazette ;

And whereas the State Election Commission has come to the conclusion that the said order needs

to be amended as follows to bring further clarity and in accordance with the powers vested in the

State Election Commission under paragraph 27 of the said order, the following order is hereby issued.

Order

The previous provisions of paragraphs 13 and 14 of the Maharashtra State Political Parties

Registration, Regulation and Election Symbols (Reservation and Allotment) Order, 2025,

dated 5th May 2025 are hereby repealed and amended paragraphs 13 and 14 are hereby inserted :

The previous provisions of paragraphs 13 and 14 of the said order :

13. Regarding registered unrecognized political parties and independent candidates:

(1) In the elections for Local Self-Government bodies, the candidate of a registered unrecognized

political party and the independent candidate, while filing nomination form, may demand at most

any three symbol amongst the symbols specified as free symbols under Paragraph 23(1)(e) in order

of priority.

(2) The Returning Officer shall allot symbols to independent candidates after allotting symbols

to candidates of unrecognized political parties registered with the State Election Commission.

(3) If several candidates opt for the same free symbol and if one of these candidates belongs to

a registered unrecognized political party and the rest of them are independent candidates, then, the

Returning Officer shall award that free symbol to the candidate of a registered unrecognized political

party and will not allot it to anyone else.

(4) If two or more of these candidates belong to a registered unrecognized political party and rest

of them are independent candidates, the Returning Officer shall take decision by drawing chits (by

draw of lots) only from among the names of the candidates of the registered unrecognized political

parties. The candidate of a registered unrecognized political party, in whose favour the chit is drawn,

shall be allotted the free symbol as sought by him and that symbol shall not be allotted to anyone

else. The remaining candidates of unrecognized political parties shall be allotted other which symbols

which have not been allotted earlier to any other candidate.

(5) If in such elections several independent candidates choose the same free symbol in order of

preference, then, for the allotment of symbols to independent candidates, the concerned Returning

Officer shall take decision by draw of lots, and a free symbol will be allotted to the candidate, in

whose favour the chit has been drawn.

(6) After allotment of symbols according to the order of preference or drawing of lots, any

candidate of a registered unrecognized political party or independent candidate is yet to be allotted a

symbol, then a symbol available among the remaining free symbols will be allotted to the concerned

candidate in the sequence of the free symbol chart.

14. Regarding direct elections of Mayor and President of Municipal Council, Nagar

Panchayat :

(1) In case of direct election for the post of Mayor, President of Municipal Council and Nagar

Panchayat, as the case may be, symbols shall be allotted first to the candidates for the post of Mayor/

President. If symbols allotted to them are amongst the free symbols, then those free symbols shall

not be allotted to any other candidate contesting for the post of member :

Provided that, if a candidate is contesting for the post of member alongwith the post of Mayor/

President, the symbol allotted to that candidate for the post of Mayor/President shall, if he so demands,

also be allotted for contesting the post of member, from the ward from which he contests.

Provisions in amended paragraphs 13 and 14 :

13. Regarding registered unrecognized political parties and independent candidates:

(1) In the elections for Local Self-Government bodies, the candidate of a registered unrecognized

political party and the independent candidate, while filing nomination form, may demand at most

any three symbol amongst the symbols specified as free symbols under Paragraph 23(1)(e) in order

(a) For Zilla Parishad and Panchayat Samiti: If a free symbol is allotted to a candidate

of a registered unrecognized political party for one Zilla Parishad division in accordance with

paragraph 13(3), then the same free symbol shall be allotted to the candidates of the same registered

unrecognized political party for the two Panchayat Samiti electoral colleges falling within that Zilla

Parishad division, as per the preference indicated in the nomination paper by the candidates. Such

free symbol shall not be allotted to any other candidate in both the Panchayat Samiti electoral college

under that Zilla Parishad division.

(4) If two or more of these candidates belong to a registered unrecognized political party and rest

of them are independent candidates, the Returning Officer shall take decision by drawing chits (by

draw of lots) only from among the names of the candidates of the registered unrecognized political

parties. The candidate of a registered unrecognized political party, in whose favour the chit is drawn,

shall be allotted the free symbol as sought by him and that symbol shall not be allotted to anyone

else. The remaining candidates of unrecognized political parties shall be allotted other which symbols

which have not been allotted earlier to any other candidate.

(a) For Zilla Parishad and Panchayat Samiti: If a free symbol is allotted to a candidate of a

registered unrecognized political party for one Zilla Parishad division in accordance with paragraph

13(4), then the same free symbol shall be allotted to the candidates of the same registered unrecognized

political party for the two Panchayat Samiti electoral colleges falling within that Zilla Parishad

division, as per the preference indicated in the nomination paper by the candidates. Such free symbol

shall not be allotted to any other candidate in both the Panchayat Samiti electoral colleges under

that Zilla Parishad division.

(5) If in such elections several independent candidates choose the same free symbol in order of

preference, then, for the allotment of symbols to independent candidates, the concerned Returning

Officer shall take decision by draw of lots, and a free symbol will be allotted to the candidate, in

whose favour the chit has been drawn.

(a) For Zilla Parishad and Panchayat Samiti : If an independent candidate is allotted a free

symbol for a Zilla Parishad division as per paragraph 13(5), and the said independent candidate is

also contesting the election for a Panchayat Samiti electoral college falling under that Zilla Parishad

division, the free symbol allotted for the Zilla Parishad division shall be given to that independent

candidate for the Panchayat Samiti electoral division falling under that Zilla Parishad division as

per the preference indicated in the nomination paper, and such free symbol shall not be allotted to

any other candidate in both the Panchayat Samiti electoral colleges falling under that Zilla Parishad

division.

(6) After allotment of symbols according to the order of preference or drawing of lots, any

candidate of a registered unrecognized political party or independent candidate is yet to be allotted a

symbol, then a symbol available among the remaining free symbols will be allotted to the concerned

candidate in the sequence of the free symbol chart.

14. Regarding direct elections of Mayor and President of Municipal Council, Nagar

Panchayat :

(1) In case of direct election for the post of Mayor or President of the Municipal Council/Nagar

Panchayat, as the case may be, symbols shall be allotted first to the candidates for the post of Mayor/

President. If the symbol allotted to the candidate of a registered unrecognized political party for the

post of Mayor/President is one of the free symbols and if that candidate is also contesting the election

for the post of member from the same registered unrecognized political party, and if that candidate

has demanded the same free symbol in his nomination paper, then that free symbol shall be allotted

to the said candidate.

(2) If the symbol allotted to a candidate contesting the election to the post of Mayor/President

on behalf of a registered unrecognized political party is a free symbol, the same free symbol shall be

allotted to the candidates of that registered unrecognized political party contesting the election to

the post of member in accordance with the preferences mentioned in the nomination papers and as

per the provisions of paragraph 13 and paragraph 15(2)(a).
