क्रमांं�क परीक्षाा-२०१९/(प्र.क्र.१२३/२०१९)/आ.(प्रशिि§).— भाारतीीय संंविि¦धाानााच्या अनुुच्छेेद ३०९ च्या परंतुुकाद्वाारे प्रदान केलेल्या

अधि�काारांं�चाा वापर करून महााराष्ट्रााचे राज्यपाल, याद्वाारे जलसंंपदा विि¦भाागाच्या महाासंंचाालक (संंकल्पन, प्रशिि§क्षण, जलविि¦ज्ञाान, संंशोधन व

सुुरक्षि�तताा), महााराष्ट्र अभि�यांं�त्रि�की संंशोधन संंस्थाा, नााशिि§क, यांं�च्या अधि�नस्त वैज्ञाानि�क अधि�काारी, गट ब या पदावर पदोन्नतीी देण्यासाठीी

पुुढीील विि¦भाागीय परीक्षाा नि�यम करीत आहेत :-

१. संक्षििȦप्त नाव :- या नि�यमांं�स जलसंंपदा विि¦भाागातीील वैज्ञाानि�क अधि�काारी, गट-ब या पदावर पदोन्नतीी देण्यासाठीीचे विि¦भाागीय

परीक्षाा नि�यम, २०२६ असे म्हणाावे.

२. व्याख्या :- या नि�यमांं�त, संंदर्भाभााɑनुुसाार दुसरा अर्थथ आवश्यक नसेेल तर,-

(क) “परि�शिि§ष्ट” याचाा अर्थथ, या नि�यमांं�सोबत जोडलेले परि�शिि§ष्ट, असा आहे;

(ख) “नि�यंंत्रक अधि�काारी” याचाा अर्थथ, संंबंधि�त क्षेत्रि�य अधीक्षक अभि�यंंता (गट-अ) असा आहे;

(ग) “महाासंंचाालक” म्हणजे महाासंंचाालक, (संंकल्पन, प्रशिि§क्षण, जलविि¦ज्ञाान, संंशोधन व सुुरक्षि�तताा), मेरी, नााशिि§क,

असा आहे;

(घ) “परीक्षाा” याचाा अर्थथ, या नि�यमांं�न्वये वैज्ञाानि�क अधि�काारी, (गट-ब) पदावरील पदोन्नतीीसाठीी नि�यम ८ अन्वये परि�शिि§ष्ट

“क” व परि�शिि§ष्ट “ख” नुुसाार विि¦हि�त केलेल्या अभ्यासक्रमानुुसाार वैज्ञाानि�क अधि�काारी (गट-ब) पदावर पदोन्नतीीची पात्रताा

तपाासण्यासाठीी घेतलीी जाणारी परीक्षाा, असा आहे;

(ङ) “संंधी” याचाा अर्थथ, महााराष्ट्र अभि�यांं�त्रि�की प्रशिि§क्षण प्रबोधि�नीी, नााशिि§क यांं�च्याकडून वरि�ष्ठ वैज्ञाानि�क सहाायक, गट-क

यांं�च्याकरि�ताा वैज्ञाानि�क अधि�काारी, गट-ब या पदावर पदोन्नतीीसाठीीची पात्रताा तपाासण्यासाठीी आयोजि�त केलेल्या विि¦भाागीय परीक्षेस

बसण्यास देण्यात आलेली संंधी, असा आहे;

(च) “प्रबोधि�नीी” याचाा अर्थथ, महााराष्ट्र अभि�यांं�त्रि�की प्रशिि§क्षण प्रबोधि�नीी, नााशिि§क असा आहे;

(छ) “वैज्ञाानि�क अधि�काारी” याचाा अर्थथ, जलसंंपदा विि¦भाागां�तर्गगत महाासंंचाालक (संंप्रजसंंसुु), महााराष्ट्र अभि�यांं�त्रि�की संंशोधन

संंस्थाा (मेरी), नााशिि§क यांं�च्या अधि�नस्त वैज्ञाानि�क अधि�काारी (गट ब), असा आहे;

(ज) “वरि�ष्ठ वैज्ञाानि�क सहाायक” याचाा अर्थथ, जलसंंपदा विि¦भाागां�तर्गगत महाासंंचाालक (संंप्रजसंंसुु), महााराष्ट्र अभि�यांं�त्रि�की

संंशोधन संंस्थाा (मेरी), नााशिि§क यांं�च्या अधि�नस्त (पाटबंधाारे संंशोधन व विि¦कास संंचाालनाालय, पुणेे वगळूून) गट-क मधीील वरि�ष्ठ

वैज्ञाानि�क सहाायक (गट-क), असा आहे;

( झ) “जलसंंपदा विि¦भााग” याचाा अर्थथ, महााराष्ट्र शासनााचाा जलसंंपदा विि¦भााग, असा आहे.

३. परीक्षेला बसण्याची पात्रता :- वरि�ष्ठ वैज्ञाानि�क सहाायक (गट-क) पदावर नि�युुक्त केलेली व्यक्तीी पदोन्नतीीच्या विि¦भाागीय

परीक्षेस बसण्यास पात्र राहील.

परंतुु असे की, सेवाप्रवेश नि�यमानुुसाार वैज्ञाानि�क अधि�काारी पदावर पदोन्नतीीसाठीी व्यवसाायि�क परीक्षाा उत्तीीर्णण होण्याची अट पूर्णण न

करणारे तथाापि�, या अधि�सूूचनेेच्या दि—नांं�कापूर्वीच वैज्ञाानि�क अधि�काारी या पदावर पदोन्नत झालेल्या सर्वव अधि�कााऱ्यां�नाा सदरहू विि¦भाागीय

परीक्षाा उत्तीीर्णण होणे अनि�वाार्यय असेल.

४. परीक्षा उत्तीीर्णण होण्यासाठी संधीची संख्या :- (एक) सदर परीक्षाा उत्तीीर्णण झाल्याशिि§वाय वरि�ष्ठ वैज्ञाानि�क सहाायक हे

वैज्ञाानि�क अधि�काारी पदावर पदोन्नतीीसाठीी पात्र ठरणार नसल्यामुुळे, परीक्षाा उत्तीीर्णण होण्याच्या संंधीवर कोणतीीही मर्याɑदा नााही.

परंतुु, सदर अधि�सूूचनाा राजपत्राात प्रसि�द्ध होण्याच्या दि—नांं�कापूर्वी वरि�ष्ठ वैज्ञाानि�क सहाायकां�नाा वैज्ञाानि�क अधि�काारी पदावर पदोन्नतीी

दि—ली असल्यास अशा अधि�कााऱ्यां�नाा सदर विि¦भाागीय परीक्षाा तीीन सलग संंधीमध्ये उत्तीीर्णण होणे अनि�वाार्यय असेल.

(दोन) सदर अधि�सूूचनाा राजपत्राात प्रसि�द्ध झाल्यानंंतर महााराष्ट्र अभि�यांं�त्रि�की प्रशिि§क्षण प्रबोधि�नीी, नााशिि§क यांं�च्यामार्फफत सलग ज्या

तीीन विि¦भाागीय परीक्षेचे आयोजन होईल, त्या परीक्षाा उमेदवारां�सााठीी सलग तीीन संंधी म्हणूून गणण्यात येतीील.

परंतुु, जी व्यक्तीी, उक्त परीक्षेस बसण्यास पात्र आहे परंतुु, जि�नेे परीक्षाा अर्जज सादर केलेला नााही किं�ंवा जी परीक्षेला अनुुपस्थि�ित

राहि�लेेली, तीी अशा व्यक्तीीची संंधी म्हणूून गणण्यात येईल.

५. वि�हि�त संधीत परीक्षा उत्तीीर्णण न होण्याचे परि�णााम :- सदर अधि�सूूचनाा राजपत्राात प्रसि�द्ध होण्याच्या दि—नांं�कापूर्वी वैज्ञाानि�क

अधि�काारी या पदावर कार्ययरत असणाारे अधि�काारी विि¦हि�त संंधीत परीक्षाा उत्तीीर्णण न झाल्यास सदर परीक्षाा उत्तीीर्णण होईपर्यंत अथवाा सदर

अधि�सूूचनेेतीील नि�यम क्र. ६ नुुसाार परीक्षाा उत्तीीर्णण होण्यापासून सुुट प्राप्त होईपर्यंत संंबंधि�तांं�चीी वेतनवााढ रोखण्यात येईल. संंबंधि�त अधि�काारी

ज्या दि—नांं�कास परीक्षाा उत्तीीर्णण होईल अथवाा सदर अधि�सूूचनेेतीील नि�यम क्र. ६ अन्वये परीक्षाा उत्तीीर्णण होण्यापासून सूट प्राप्त होईल. त्या

दि—नांं�कानंंतर येणाऱ्या जानेवारी किं�ंवा जुलैै महि�न्यात संंबंधि�त अधि�कााऱ्याची रोखलेली वेतनवााढ अदा करण्यात येईल. परंतुु, मागील

कालावधीीतीील कोणतीीही थकबाकी अनुुज्ञेय असणाार नााही.

६. परीक्षा उत्तीीर्णण होण्यापासून सूट :- ज्या व्यक्तीीने वरि�ष्ठ वैज्ञाानि�क सहाायक पदावर कि�माान पंधराा वर्षेे सेवा पूर्णण केलेली आहे

किं�ंवा ज्या व्यक्तीीस उक्त परीक्षाा उत्तीीर्णण न होता ही अधि�सूूचनाा प्रकाशिि§त झाल्याच्या दि—नांं�कापूर्वी वैज्ञाानि�क अधि�काारी या पदावर पदोन्नतीी

मि�ळााली आहे व उक्त वैज्ञाानि�क अधि�काारी पदावर कि�माान पंधराा वर्षेे सेवा पूर्णण झालेली आहे किं�ंवा वयाची पन्नाास वर्षेे पूर्णण केलेली आहे,

यापैकी, जे नंंतर असेल,त्यानूसार त्यास उक्त परीक्षाा उत्तीीर्णण होण्यापासून सूट देण्यात येईल.

७. उत्तीीर्णण झााल्याचाा दि�नांं�क - परीक्षेच्या शेवटच्या पेपरच्या लगतनंंंतरचाा दि—वस, परीक्षाा उत्तीीर्णण झाल्याचाा दि—नांं�क म्हणूून

समजण्यात येईल.

८. अभ्यासक्रम - परीक्षेचे स्वरुप, प्रश्नपत्रि�कांं�ची संंख्या, विि¦षय व मि�ळवाावयाचे कि�माान अर्हतााकारी गुुण, परि�शिि§ष्ट “क”

मध्ये विि¦नि�र्दिदि—िष्ट केल्याप्रमाणे असतीील आणि� परीक्षेचाा अभ्यासक्रम परि�शिि§ष्ट “ख” मध्ये विि¦नि�र्दिदि—िष्ट केल्याप्रमाणे असेल किं�ंवा राज्य शासन

वेळोवेळी आदेशाद्वाारे नि�देेश देईल त्याप्रमाणे असेल.

९. उत्तीीर्णण होण्याचे मानक - परीक्षाा उत्तीीर्णण होण्याचे मानक, प्रत्येक ऑनलााईन, प्रात्यक्षि�क व मौखि�क परीक्षेमधीील एकूण

गुणांं�च्या पन्नाास टक्के इतकेे असेल. अनुुत्तीीर्णण झाल्यास, अशा उमेदवाराने, ज्या विि¦षयांं�त तो अनुुत्तीीर्णण झाला आहे त्याविि¦षयााची परीक्षाा

उत्तीीर्णण करणे आवश्यक आहे.

१०. वि�शेेषष प्रावि�ण्य - जो उमेदवार पहि�ल्या प्रयत्नाात परीक्षाा उत्तीीर्णण होईल आणि� कोणत्याही विि¦षयाात सत्तर टक्के किं�ंवा त्यापेक्षाा

अधि�क गुुण मि�ळवेेल, त्या उमेदवाराने, विि¦शेष प्राविि¦ण्यासह परीक्षाा उत्तीीर्णण केली असल्याचे मानण्यात येईल आणि� तशीी नोंंद, त्याच्या सेवा

पुुस्तकाात नोंंदविि¦ण्यात येईल.

११. परीक्षा केव्हाा घेेण्यात येेईल - (एक) महााराष्ट्र अभि�यांं�त्रि�की प्रशिि§क्षण प्रबोधि�नीी, नााशिि§क यांं�च्याद्वाारे वर्षााɑतून एकदा, शक्यतो

मार्चच किं�ंवा एप्रििŌल महि�न्यात परीक्षाा घेण्यात येईल, परीक्षाा मरााठीी व इंग्रजी भााषेषेेत घेण्यात येईल.

(दोन) प्रबोधि�नीी, परीक्षाा पूर्णण झाल्याच्या दि—नांं�कापासून साठ दि—वसांं�च्या कालावधीीत परीक्षेचाा नि�कााल जाहीर करेल. प्रबोधि�नीीने

जाहीर केलेला नि�कााल अंति�म असेल आणि� नि�कााल जाहीर करण्यास विि¦लंब झाल्यास, परीक्षाा अविि¦धि�ग्रााहय ठरणार नााही.

१२. प्रशि�क्षण वर्गग :- महााराष्ट्र अभि�यांं�त्रि�की प्रशिि§क्षण प्रबोधि�नीी, नााशिि§क, पात्र उमेदवारां�नाा प्रशिि§क्षण देण्याकरि�ताा एक महि�न्याच्या

प्रशिि§क्षण वर्गाɑचे आयोजन करील व परीक्षेच्या दि—नांं�कापूर्वी कि�माान एक महि�नाा अगोदर प्रशिि§क्षण कार्ययक्रम पूर्णण करण्यात येईल. प्रथमच

परीक्षेस बसणााऱ्या पात्र अशा उमेदवारास प्रशिि§क्षण कार्ययक्रमास उपस्थि�ित राहणेे अनि�वाार्यय असेल. पात्र उमेदवारां�नाा केवळ एकाच प्रशिि§क्षण

सत्राास उपस्थि�ित राहण्याची परवानगीी असेल.

१३. परीक्षा कक्षातील वर्ततन :- परीक्षाा नि�यंंत्रण अधि�काारी, जर उमेदवार खालील नमूूद केलेल्या रीतीीने गैरवर्तन करत असल्याचे

आढळूून आले तर, अशा उमेदवाराला परीक्षेला बसण्यापासून नि�र्बंधि�त करेल आणि� उमेदवाराला उर्ववरि�त परीक्षेला बसण्यास मनााई करेल :-

(एक) कोणताही दस्तऐवज, पुुस्तक, भ्रमणध्वनीी, कोणतेही इलेक्ट्रॉनि�क उपकरण किं�ंवा इतर कोणतीीही सामग्री जी प्रश्नांं�चीी

उत्तरेे देण्यासाठीी वापरली जाऊ शकते असे इतर कोणतेही साहि�त्य, यातून नक्कल करणे, ते बाळगणे किं�ंवा ते वापरणे;

(दोन) इतर उमेदवारां�सोोबत संंभााषण करणे;

(तीीन) कोणत्याही बाबतीीत इतर उमेदवारांं�कडून मदत

घेणे;

(चाार) इतर कोणत्याही उमेदवाराच्या उत्तरपत्रि�केेची नक्कल करणे;

(पाच) उत्तर पत्रि�काा फााडणे;

(सहाा) जो परीक्षेत गैरप्रकार ठरू शकेल असा इतर कोणताही मार्गग किं�ंवा वर्तनााची पद्धत.

१४. वि�भाागीय परीक्षेसंदर्भाभाा�तील सामाईक धोरण आणि� सामान्य प्रशासन विि¦भाागाने त्यात वेळोवेळी केलेले बदल शासन

नि�र्णणय क्र. विि¦पधो- २६२०/प्र.क्र.१६/का.१७, दि—नांं�क ३१ मार्चच, २०२१ या परीक्षाा नि�यमास लागू असेल.

NOTIFICATION

Constitution of India.

No. TGO 2019/(123/19)/ Est.(Trg).—In exercise of the powers conferred by the proviso to article

309 of the Constitution of India, the Governor of Maharashtra, is hereb y pleased to make the

following rules to regulate the Departmental Examination for promotion to the post of Scientific

Officer (Group-B) in the Office of Director General, Design, Training, Hydrology, Research and Safety,

Maharashtra Engineering Research Institute, Nashik in the Water Resources Department, namely :-

1. Short title.- These rules may be called Departmental Examination Rules, 2026 for promotion

to the post of the Scientific Officer (Group-B).

2. Definitions.- In these rules, unless the context otherwise requires,-

(a) “Appendix” means the Appendix appended to these rules;

(b) “Controlling Officer” means the concerned Zonal Superintending Engineer (Group-A);

and Safety, (DTHRS) Maharashtra Engineering Research Institute (MERI), Nashik;

(d) “Examination” means the Departmental Examination conducted as per the syllabus

prescribed under rule 8 read with Appendix “A” and Appendix “B” to check the eligibility for

promotion to the post of the Scientific Officer (Group-B);

(e) “Opportunity” means the chance provided by the Maharashtra Engineering Training

Academy, Nashik for Senior Scientific Assistant, Group-C to appear for the Departmental

Examination conducted to check their eligibility for promotion to the post of Scientific Officer,

Group-B;

(f) “META” means Maharashtra Engineering Training Academy, Nashik;

(g) “Scientific Officer” means the Scientific Officer (Group-B) under Director General

(DTHRS), Maharashtra Engineering Research Institute, Nashik in the Water Resources

Department;

(h) “Senior Scientific Assistant” means the Senior Scientific Assistant (Group-C) under

Director General (DTHRS), Maharashtra Engineering Research Institute, Nashik (Excluding

Directorate of Irrigation Research and Development, Pune) in Water Resources Department;

(i) “Water Resources Department” means the Water Resources Department of the

Government of Maharashtra.

3. Eligibility to appear for Examination.- The persons appointed to the post of Senior Scientific

Assistant, (Group-C) shall be eligible to appear for the Departmental Examination.

Provided that the person promoted to the post of Scientific Officer prior to the date of this

notification, who do not fulfill the condition of passing the professional examination for promotion

to the post of Scientific Officer as per the recruitment rules, shall be required to pass the said

Departmental Examination.

4. Number of opportunities for passing Examination.- (i) As passing of the said Examination is

condition for promotion to the post of Scientific Officer, the person holding the post of Senior Scientific

Assistant shall may avail any number of opportunities to pass the examination.

Provided that, if the Senior Scientific Assistant has been promoted to the post of Scientific

Officer before the date of publication of these rules in the Official Gazette, those officers shall

require to pass the said Departmental Examination in three consecutive opportunities :

(ii) Provided also that, three consecutive Departmental Examination to be conducted by

Maharashtra Engineering Training Academy, Nashik, After the date of publication of these rules in

the Official Gazette, shall be considered as three consecutive opportunities :

Provided further that, if the person is eligible to appear for the said Examination but do not

submit the Examination form or remains absent for the Examination, then it shall be counted

as an opportunity to such person.

5. Consequences of failure to pass Examination within prescribed opportunities.- Any person

holding the post of Scientific Officer, Before the date of publication of this notification in the Official

Gazette, who fails to pass the Examination within the prescribed opportunities, his increment shall be

withheld till he passes the said Examination or gets exempted from passing the Examination as per

rule 6 of these rules, The increment so withheld shall become payable to such person with effect from

the date on which he passes the said Examination or exempted from passing the said Examination.

The increments so withheld shall be paid in the month of January or July coming after that date,

but no arrears for the past period shall be admissible.

6. Exemption from passing the Examination.- A person who has completed at least fifteen years

on the post of Senior Scientific Assistant or any person promoted to the post of Scientific Officer

prior to the date of publication of this notification without passing the said Examination and has

completed at least fifteen years on the said post of Scientific Officer or has completed fifty years of

age, whichever is later, shall be exempted from passing the said Examination.

7. Date of passing.- The day immediately following the next day of the last paper of the

Examination, shall be considered as the date of passing of the Examination.

8. Syllabus.- Pattern of Examination, number of papers, subjects and minimum qualifying

marks to be obtained shall be as specified in Appendix “A” and syllabus of the examination shall be

as specified in Appendix “B” or as the State Government may direct by order, from time to time.

9. Standard of passing.- The standard of passing the Examination, shall be fifty per cent. of

the total marks in each online, practical and oral paper. In case of failure, such person is required

to pass the Examination for those subjects in which he is failed.

10. Special Skills.- The candidate who passes the Examination in first attempt and obtains

seventy percent or more marks in any subject, shall be deemed to have passed the Examination with

special skill and an entry to that effect shall be recorded in his service book.

11. Examination when to be conducted.- (i) The Examination shall be held by the Maharashtra

Engineering Training Academy, Nashik, once in a year preferably in the month of March or April.

The Examination shall be conducted in Marathi and English language.

(ii) The Academy shall declare result of the Examination within a period of sixty days from

date of completion of the Examination. The result declared by the Academy shall be final and delay

in announcement of result shall not invalidate the Examination.

12. Training Class.- Maharashtra Engineering Training Academy, Nashik, shall conduct

training class for one month for imparting training to the eligible candidates. The training program

shall be completed at least one month prior to the date of holding Examination. It shall be compulsory

for eligible candidates to attend the training who is appearing for the Examination for first time.

Eligible candidates shall be permitted to attend only one training session.

13. Conduct in Examination Hall.- The Controlling Officer of Examination shall restrict the

candidate from appearing for the Examination and prohibit the candidate from appearing for rest of

the papers if he finds that the candidate is misbehaving in any manner mentioned below, namely:-

(i) copying, carrying or referring any document, book, mobile, any electronic gadget or any

other material which can be referred for answering the questions;

(ii) making conversation with other candidates;

(iii) receiving help from any other candidate in any matter;

(iv) copying the answer paper of any other candidate;

(v) tearing the answer sheets;

(vi) any other way or manner of behaviour which may amount to malpractices in the

Examination.

14. The Government Resolution No. Wipadho 2620/ C.R.16 / Ka.17, dated the 31st March 2021,

regarding the common policy of Departmental Examination and the changes made by the General

Administration Department, from time to time, shall be applicable to this rule.
