असाा करणेेत आलेेला आहेे) द्वाारेे बृृहन्मुंं�बई प्रारूप वि¦कास योजनाा-२०३४ सह वि¦कास नि�यंंत्रण व प्रोत्सााहन नि�यमावली-२०३४ (यापुुढेे

याचा उल्लेेख “उक्त नि�यमावली” असाा करणेेत आलेेला आहेे) ला उक्त अधिि˜सूूचनेेसोबतचेे परि�शिि§ष्ट-ब मध्येे दर्शशवि¦लेेलेे साारभूूत

स्वरुपाचेे फेेरबदल (ई.पी.) वगळूून उक्त अधिि˜सूूचनेेसोबतचेे परि�शिि§ष्ट-अेे मध्येे दर्शशवि¦लेेल्या सुुधारणेेसह मंंजुुरी दिि—ली आहेे. आणि�

ज्याअर्थीी शासनाानेे उक्त अधिि˜सूूचनेेस सम क्रमांं�काचेे शुुद्धीीपत्रक दिि—नांं�क २२ जूून २०१८ रोजी नि�र्गगमि�त केेलेे आहेे; आणि� ज्याअर्थीी, त्यानंंंतर

उक्त अधिि˜सूूचनेेस शासनाानेे समक्रमांं�काचेे शुुद्धीीपत्रक व पुुरकपत्र दिि—नांं�क २९ जूून, २०१८ रोजी पारि�त केेलेे असूून सदर शुुद्धीीपत्रक व

पुुरकपत्र महाारााष्ट्र शासनााच्या राजपत्रात दिि—नांं�क ३० जूून, २०१८ रोजी प्रसि�द्ध करण्यात आलेे आहेे; आणि� ज्याअर्थीी, उक्त नि�यमावली

दिि—नांं�क १ सप्टेंंबर २०१८ पासूून अंंमलाात आली आहेे; आणि� ज्याअर्थीी, शासनाानेे दिि—नांं�क २१ सप्टेंंबर २०१८ रोजीच्या अधिि˜सूूचनेेद्वाारेे

उक्त नि�यमावलीमधीील साारभूूत स्वरुपाचेे बदल ईपी-१ तेे ईपी-१६८ ला (ठराावि¦क ईपी व नि�र्णणयाार्थथ प्रलंंबि�त ठेेवलेेल्या ठराावि¦क तरतुुदी

वगळूून) मंंजुुरी प्रदान केेली आहेे; आणि� ज्याअर्थीी, उक्त मंंजुुरीच्या अधिि˜सूूचनेेत आणि� मंंजूूर तरतूूदीमध्येे टंंकलेेखनााच्या त्रुुटी व चुुका

तसेेच उक्त नि�यमावलीमधीील काही तरतुुदींंच्या अर्थथबोोधाची स्पष्टता करून सुुसंंगती आणणेे यांं�करि�ताा शासनाानेे दिि—नांं�क १२ नाेे�व्‍‍हेंंबर

२०१८ रोजी शुुद्धीीपत्रक नि�र्गगमि�त केेलेे आहेे;

आणि� ज्याअर्थीी, जी.टी.बी. नगर, भूू.क्र.१/८९, २/८९, २८/१२८(पैै) साायन-कोळीवाडाा येेथीथीील सिं�ंधी नि�र्वा�सि�तांं�च्या २५ इमारतीी

अंंतर्भूू�त असलेेल्या मि�ळकतींंच्या(यापुुढेे ज्याचा उल्लेेख "उक्त क्षेेत्र" असाा करणेेत आलेेला आहेे.) पुुनर्विवि¦िकास बृृहन्मुंं�बई वि¦कास नि�यंंत्रण

व प्रोत्सााहन नि�यमावली-२०३४ चेे वि¦नि�यम ३३(९) अंंतर्गगत समुुह वि¦कास योजनेेद्वाारेे म्हााडाा मार्फत करण्यासााठी मा. मंंत्रि�मंंडळााच्या

दिि—नांं�क १४ फेेब्रुुवारी २०२४ रोजीचेे बैैठकीमध्येे मान्यता देेण्यात आली असूून, त्यानुुषंंगानेे, शासन नि�र्णणय क्र. संंकीर्णण-२०२३/प्र.क्र.२९/

गृृनि�प दिि—नांं�क २३ फेेब्रुुवारी २०२४ नि�र्गगमि�त करण्यात आला आहेे (यापुुढेे ज्याचा उल्लेेख "उक्त शासन नि�र्णणय" असाा करणेेत आलेेला

आहेे); आणि� ज्याअर्थीी, उक्त शासन नि�र्णणयाातील अ.क्र.२ मध्येे नमूूद असल्यानुुसाार उक्त क्षेेत्रााचा उक्त नि�यमावलीचेे वि¦नि�यम ३३(९)

अंंतर्गगत समूूह वि¦कास योजनेेद्वाारेे म्हााडाामार्फ़़त पुुनर्विवि¦िकास करण्यासााठी म्हााडााची ‘वि¦शेेष नि�योोजन प्राधिि˜करण’ म्हणूून नि�युुक्ती करण्यासााठी

आवश्यक अधिि˜सूूचनाा/ आदेेश नि�र्गगमि�त करण्याबाबत शासन गृृहनि�र्माा�ण वि¦भाागानेे शासन नगरवि¦कास वि¦भाागास वि¦नंंंती केेली आहेे;

आणि� ज्याअर्थीी वरीील वि¦चाराात घेेता, उक्त क्षेेत्र ‘अधिि˜सुुचि�त क्षेेत्र’ म्हणूून घोषि�त करून, उक्त क्षेेत्रााचा उक्त नि�यमावलीचेे वि¦नि�यम

३३(९) अंंतर्गगत समूूह वि¦कास योजनेेद्वाारेे म्हााडाामार्फत पुुनर्विवि¦िकास करण्यासााठी म्हााडााची ‘वि¦शेेष नि�योोजन प्राधिि˜करण’ म्हणूून नि�युुक्ती

करणेे आवश्यक आहेे.

आता त्याअर्थीी, शासन याद्वाारेे,:—

(i) उक्त क्षेेत्र हेे उक्त अधिि˜नि�यमाचेे कलम ४० चेे पोट-कलम (१) अंंतर्गगत ‘अधिि˜सूूचि�त क्षेेत्र’ म्हणूून घोषि�त करण्यात

येेत आहेे. तसेेच,

(ii) उक्त क्षेेत्रााचा उक्त नि�यमावलीचेे वि¦नि�यम ३३(९) अंंतर्गगत समूूह वि¦कास योजनेेद्वाारेे म्हााडाामार्फत पुुनर्विवि¦िकास करण्यासााठी

उक्त अधिि˜सुुचि�त क्षेेत्रााकरि�ताा उक्त अधिि˜नि�यमाचेे कलम ४० चेे पोट-कलम (१) (एए) अन्वयेे म्हााडााची ‘वि¦शेेष नि�योोजन प्राधिि˜करण’

म्हणूून नि�युुक्ती करण्यात येेत आहेे;

(iii) सदरचीी अधिि˜सूूचनाा शासकीय राजपत्रामध्येे प्रसि�द्ध झाालेेचा दिि—नांं�क हाा उक्त अधिि˜सूूचनाा अंंमलाात आलेेचा दिि—नांं�क

असेेल.

या अधिि˜सूूचनेेची प्रत नकााशासह एका महि�न्याच्या कालावधीसााठी खालील कार्याा�लयांं�मध्येे पाहणीीसााठी उपलब्ध करून देेण्यात

यावी :—

(अ) मुुख्य कार्ययकारी अधिि˜कारी, म्हााडाा यांं�चेे कार्याा�लय, गृृहनि�र्माा�ण वि¦भााग, वांं�द्रेे (पुु.), मुंं�बई ५१

(ब) उप संंचालक, नगररचनाा, बृृहन्मुंं�बई, एन्साा हटमेंंंट्स, ई-ब्लॉक, आझााड मैैदान, महाापालि�का मार्गग, मुंं�बई ०१.

सदर अधिि˜सूूचनाा महाारााष्ट्र शासनााच्या www.maharashtra.gov.in (कायदा / नि�यम ) या वेेबसााइटवर देेखील प्रसि�द्ध

करण्यात येेत आहेे.

NOTIFICATION

Maharashtra Regional & Town Planning Act, 1966.

No.TPB-4326/CR-94/2026/UD-11.— Whereas, the Municipal Corporation of Greater Mumbai

is the Planning Authority for the area within its jurisdiction (hereinafter referred to as “the said

Corporation”) as per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter

referred to as “the said Act”) except some notified areas in Greater Mumbai;

Whereas, in exercise of the powers conferred by sub-section (1) of Section 31 of the said Act, the

State Government vide Notification No. TPB-4317/629/CR-118/2017/DP/UD-11, Date 8th May 2018

(hereinafter referred to as “the said Notification”) has accorded sanction to the Draft Development

Plan-2034 of Greater Mumbai (hereinafter referred to as “the said Development Plan”) along with

the Development Control and Promotion Regulations-2034 (hereinafter referred to as “the said

Regulations”) for Greater Mumbai with modifications shown in SCHEDULE-A appended to the

said Notification excluding the substantial modifications as shown in SCHEDULE-B appended to

the said Notification; and whereas, Government has issued corrigendum of even number Date 22nd

June, 2018; and whereas, thereafter Government has issued a Corrigendum and Addendum of even

number Date 29th June, 2018 to the said Notification, which is published in Government Gazette

dt. 30th June, 2018; and whereas, the said Regulations have come into force from 1st Saptember

2018; And whereas, the Government of Maharashtra vide Notification Date 21st September 2018

has sanctioned EP-1 to EP-168 (Excluding certain EP and provisions which were kept in abeyance)

in the said Regulation; And whereas, the Government of Maharashtra vide Notification date 12th

November 2018 has issued corrigendum in respect of some typographical errors and mistakes and

also to clarify and co-relate certain provisions of said Regulations for its proper interpretation;

And whereas, in the Hon’ble Cabinet meeting held on 14th February 2024, it has been approved

to redevelop the properties comprising 25 buildings occupied by Sindhi refugees situated at GTB

Nagar, CTS Nos./ Plot Nos. 1/89, 2/89 and 2/12 (Part), Sion-Koliwada (hereinafter referred to as “the

said Area”) through Maharashtra Area Development Authority (hereinafter referred to as “MHADA”)

under Regulation 33(9) of the said Regulations and accordingly, in this regard a Government

resolution No. संंकीर्णण-2023/प्र.क्र.29/गृृनि�प dated 23rd February 2024 has been issued (hereinafter referred

to as “the said GR”); And whereas, the Housing Department has requested the Urban Development

Department to issue the necessary notification / order as mentioned in Sr No. 2 of the said GR

regarding appointment of MHADA as the Special Planning Authority for redevelopment of the said

Area through Cluster Development Scheme as per Regulation 33(9) of the said Regulations.

And whereas, in view of the above, it is necessary to declare the said Area as ‘Notified area’

and to appoint MHADA as Special Planning Authority for redevelopment of the said Area through

Cluster Development Scheme as per Regulation 33 (9) of the said Regulations;

Now, therefore, the Government hereby :—

(i) Declares the said Area to be ‘Notified area’ under Section 40 (1) of the said Act and,

(ii) Appoints MHADA as Special Planning Authority as per sub-section (1)(AA) of Section

40 of the said Act, for redevelopment of the said Area through Cluster Development Scheme as

per Regulation 33(9) of the said Regulations.

(iii) Fixes the date of publication of this Notification in the Official Gazette as the date of

coming into force of this notification.

A copy of this Notification along with plan shall be made available for inspection for a period of

one month at the following offices :—

(a) Office of the Chief Executive officer, MHADA, Gruhnirman Bhavan, Bandra (East),

Mumbai 51.

(b) Office of the Deputy Director of Town Planning, ENSA Hutments, E- Block,

Azad Maidan, Mahapalika Marg, Mumbai 01.

This Notification shall also be available on the Govt. of Maharashtra website: www.maharashtra.

gov.in ( Acts/Rules ).
