STATEMENT
Section 48 of the Maharashtra Land Revenue Code, 1966 (Mah. XLI of
1966) provides for Government title to mines and minerals. Sub-section (7) of
said section 48 provides the penalty for extracting, removing, collecting,
replacing, picking up or disposing of minerals without lawful authority which
is upto five times of the market value of such minerals.
2. It is noticed that, different amounts of penalties are imposed in
different areas for illegal extraction, removal, etc. of minerals as market value
determined by the Collector is different in different Districts. It is also seen
that, in some of the projects, the penalty imposed is more than the project cost
which has resulted in halting of such projects. The amount of penalty is
substantial since it is dependent on the market value of minerals. Hence, large
number of appeals against imposed penalty are filed before the Competent
Authority. This has resulted in delay in recovery of penalty. Therefore, it is
considered expedient to amend section 48 of the said Code with a view to provide
for levy of penalty equal to ten times of the royalty payable for such minerals.
3. As both Houses of the State Legislature are not in session and the
Governor of Maharashtra is satisfied that circumstances exist which render it
necessary for him to take immediate action further to amend the Maharashtra
Land Revenue Code, 1966, for the purposes aforesaid, this Ordinance is
promulgated.
