पोोटकलम (१) व (४) अन्वयेे प्रदाान करण्यात आलेेल्या अधिि˜काारांं�चाा व यासंंबंंधी प्राप्त असलेेल्या इतर सर्वव शक्तींंचाा वापर करुन,

(यापूूढेे “ उक्त अधिि˜सूूचनाा ” असेे संंबोधण्यात येेईल), अन्वयेे, एखााद्याा वक्फ किं�ंवा वक्फ मालमत्तेेशी संंबंंधिि˜त वि�वाद, प्रश्न व इतर

संंबंंधिि˜त बाबींंचेे नि�र्धा�रण करण्यासाठीी, एखााद्याा भााडेेकरुचेे नि�ष्काासन किं�ंवा अशा मालमत्ताा संंदर्भाभाा�तीील भााडेेपट्टााकाार व भााडेेपट्टाादाार यांं�च्या

अधिि˜काारांं�चेे व बंंधनांं�चेे (obligation) नि�र्धा�रण उक्त अधिि˜नि�यमांं�तर्गगगत करण्यासाठीी, संंपूूर्णण महााराष्ट्र राज्यावर अधिि˜काारि�ताा असलेेलेे,

महााराष्ट्र राज्य वक्फ न्यायाधिि˜करण, औरंंगाबाद (यापुुढेे “ उक्त न्यायाधिि˜करण ” असेे संंबोधण्यात येेईल) ची स्थाापनाा केेली आहेे ;

आणि� ज्याअर्थीी, महााराष्ट्र शासनााच्या अल्पसंंख्याक वि�काास वि�भााग, शासन अधिि˜सूूचनाा क्र. वक्फ-२०२५/प्र.क्र.५१/काा-४,

दि�नांं�क ९ ऑक्टोबर २०२५ अन्वयेे, सदर न्यायाधिि˜करणाचेे सदस्य म्हणूून श्रीी. अनीस शेेख यांं�चीी नि�युुक्ती रद्द केेली आहेे ;

आणि� ज्याअर्थीी, एकाात्मि��क वक्फ व्यवस्थाापन, सक्षमीकरण आणि� वि�काास अधिि˜नि�यम, १९९५ (१९९५ चाा ४३) मधीील कलम

८३ च्या पोोटकलम (४) मधीील खंंड (ब) नुुसार राज्य शासनााच्या अधिि˜कााऱ्यांं�च्या संंवर्गाा�तीील सदस्याचेे पद रि�क्त आहेे ;

आणि� ज्याअर्थीी, शासनाास सदर श्रेेणीतील एकाा व्यक्तीची सदर न्यायाधिि˜करणावर सदस्य म्हणूून नि�युुक्ती करणेे आवश्यक व

उचि�त वाटतेे ;

आताा, म्हणूून, एकाात्मि��क वक्फ व्यवस्थाापन, सक्षमीकरण आणि� वि�काास अधिि˜नि�यम, १९९५ च्या कलम ८३ च्या पोोट-कलम

(४) मधीील खंंड (ब) अन्वयेे प्रदाान करण्यात आलेेल्या अधिि˜काारांं�चाा वापर करून, शासन याद्वाारेे श्रीी. अनंंंत गव्हाणेे, सेेवानि�वृृत्त

अति�रि�क्त जि�ल्हाधिि˜काारी, यांं�चीी सदर न्यायाधिि˜करणाचेे सदस्य म्हणूून नि�युुक्ती करीीत आहेे. ही नि�युुक्ती नि�युुक्तीच्या दि�नांं�काापासूून पाच

वर्षांंɕच्या काालावधीसाठीी किं�ंवा तेे वयाची ६५ वर्षेे पूूर्णण करेेपर्यंंत, यापैैकी जेे आधी घडेेल तोपर्यंंत राहील.

उक्त अधिि˜सूूचनेेस जोडलेेल्या तक्त्यात अनुुक्रमांं�क १ नंंंतर खाालील नोंंंद समावि�ष्ट करण्यात येेईल, म्हणजेेच :-

NOTIFICATION

Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995.

No.Waqf 2020/C.R.96/Desk-4.—Whereas, in exercise of the powers conferred by sub-

sections (1) and (4) of section 83 of the Waqf Act, 1995 (43 of 1995) and of all other powers

enabling it in that behalf, the Government of Maharashtra vide Government Notification,

Minorities Development Department, No.Waqf-2015/C.R.142/Desk-4, dated the 1st August

2017 (hereinafter referred to as “the said Notification”), has constituted the Maharashtra

State Waqf Tribunal at Aurangabad (hereinafter referred to as “the said Tribunal”) for the

determination of any dispute, question or other matter relating to a waqf or waqf property,

eviction of a tenant or determination of rights and obligations of the lessor and the lessee of

such property, under the said Act, having jurisdiction over whole of the State of Maharashtra ;

And whereas, Government of Maharashtra has vide Government Notification, Minorities

Development Department, No. Waqf 2025/C.R.51/Desk-4, dated 9th October 2025 cancelled

the appointment of Shri Anees Shaikh as Member of the said Tribunal ;

And whereas, the post of the category of officer of the State Government as per sub-clause (b)

of sub-section (4) of Section 83 of the Unified Waqf Management, Empowerment, and

Development Act, 1995 (43 of 1995), is vacant ;

And whereas, the Government considers it expedient to appoint a person from the said

category as member on the said Tribunal ;

Now, therefore, in exercise of the powers conferred by sub-clause (b) of sub-section (4)

of Section 83 of the Unified Waqf Management, Empowerment, and Development Act, 1995,

the Government hereby appoints Shri Anant Gavahane, Retired Additional Collector, as a

Member of the said Tribunal for a period of five years from the date of appointment or until

he attains the age of sixty-five years, whichever is earlier and for that purpose amends the

said Notification as follows;

In the Table appended to the said notification, after Serial No. 1, the following entry

shall be inserted, namely:—
