क्रमांं�क सेप्रनि�-२०२२/प्र.क्र.१९९/काामगाार-८.— भाारतीय संविि¦धाानााच्या अनुच्छेेद ३०९ खाालील परंतुकाान्वये प्रदाान करण्यात

आलेल्या शक्तींचाा वापर करून आणिि” अस्तिĒित्त्वात असलेले सर्वव विि¦द्यमान नि�यम, आदेश किं�ंवा अनुदेश अधि�क्रमि�त करून, महााराष्ट्रााचे

राज्यपाल याद्वाारे महााराष्ट्र शासनााच्या काामगाार विि¦भाागाच्या अधि�पत्याखाालील काामगाार आयुक्त यांं�च्या काार्या�लयातील “ दुकााने नि�रीीक्षक

श्रेेणी-१ व दुकााने नि�रीीक्षक श्रेेणी-२”, गट-क या पदाावरील सेवा प्रवेशाचे विि¦नि�यमन करण्यासाठीी याद्वाारे पुढीील नि�यम करीीत आहे ते असे :-

१.संंक्षिȦप्त नाव, प्रारंभ :–

ाा नि�यमांं�ना काामगाार आयुक्त काार्या�लयातील “दुकााने नि�रीीक्षक श्रेेणी-१ व दुकााने नि�रीीक्षक श्रेेणी-२”, गट-क सेवाप्रवेश

नि�यम, २०२६ असे संबोधण्यात यावे.

२.

सदर नि�यम शासन राजपत्र प्रसि�ध्द झााल्याच्या दि�नांं�काापासून अंमलाात येतील.

२. व्याख्या — या नि�यमांं�मध्ये संदर्भाभाा�नुुसार अन्यथाा दुसरा अर्थथ अभि�प्रेेत नसेेल तर,-

(क) “ नि�युुक्ती प्राधि�काारी ” याचाा अर्थथ, शासकीय सेवेतील “दुकााने नि�रीीक्षक श्रेेणी-१ व दुकााने नि�रीीक्षक श्रेेणी-२”,

गट-क या पदाावर नि�युुक्ती करण्यासाठीी सक्षम असणारा “ काामगाार आयुक्त ” हा प्राधि�काारी असा आहे ;

(ख) “ आयुक्ताालय ” याचाा अर्थथ काामगाार विि¦भााग या प्रशासकीय विि¦भाागाच्या अधि�पत्याखाालील काामगाार आयुक्ताालय

असा आहे ;

(ग) “ पदोन्नतीीसाठीीची पात्रताा” याचाा अर्थथ, शासनााच्या सामान्य प्रशासन विि¦भाागाने वेळोोवेळी यासंदर्भाभाा�त नि�र्गगमि�त केलेले

नि�यम, शासन नि�र्णणय किं�ंवा आदेशाद्वाारे पदोन्नतीीसाठीी विि¦हि�त केलेल्या अटी व शर्तीनुसार पदोन्नतीीसाठीीची पात्रताा असा आहे ;

(घ) “ पदवीी ” याचाा अर्थथ, सांं�विि¦धि�क विि¦द्यापीठाची कोणत्याही शाखेतील पदवीी किं�ंवा शासनााने त्याच्याशी समतुुल्य

म्हणूून घोषिि¨त केलेली अन्य कोणतीीही अर्हहताा ;

(च) “ शासन ” याचाा अर्थथ, महााराष्ट्र शासन असा आहे ;

(छ) “ आयोग ” याचाा अर्थथ महााराष्ट्र लोकसेेवा आयोग असा आहे.

३. दुकाने नि�रीीक्षक श्रेेणीीी-१, गट-क या पदावरीीील नि�युुक्तीीी पुढीीील मार्गा�ने करण्यात येेईल.

आयुक्ताालयातील दुकााने नि�रीीक्षक श्रेेणी-१ (गट-क) या पदाावर नि�युुक्ती ही आयुक्ताालयातील दुकााने नि�रीीक्षक श्रेेणी-२, (गट-क)

हे पद धाारण करणाऱ्या तसेेच सदर पदाावर तीन वर्षांंɕहून कमीी नसेेल इतकीी सलग नि�यमि�त सेवा झाालेल्या व्यक्तींमधूून पदोन्नतीीसाठीीची

पात्रताा या नि�कषाावर योग्य व्यक्तींच्या पदोन्नतीीने.

४. दुकाने नि�रीीक्षक श्रेेणीीी-२, गट-क या पदावरीीील नि�युुक्तीीी पुढीीील मार्गा�ने करण्यात येेईल.

(क) पदोन्नतीीने नि�युुक्तीीचा मार्गग—

लि�पि�क-टंंकलेेखक, गट-क हे पद धाारण करणाऱ्या व दुकााने नि�रीीक्षक श्रेेणी-२ या पदाावर पदोन्नतीी देण्याचाा विि¦कल्प दि�लेेल्या

आणिि” लि�पि�क-टंंकलेेखक या पदाावर तीन वर्षांंɕहून कमीी नसेेल इतकीी सलग नि�यमि�त सेवा झाालेल्या आणिि” खंड (ख) च्या उपखंड

(दोन) येथील शैक्षणिि”क अर्हहताा धाारण केलेल्या व्यक्तींमधूून पदोन्नतीीसाठीीची पात्रताा या नि�कषाावर, आणिि” लि�पि�क-टंंकलेेखक संवर्गा�तीील

पदवीीधरांं�ची राज्यस्तरावर (काामगाार आयुक्ताालय) ठेवण्यात येत असलेल्या स्वतंत्र ज्येष्ठताा यादीतील योग्य व्यक्तींच्या पदोन्नतीीने.

परंतु, सदर विि¦कल्प संबंधि�त नि�वडसूची वर्षा�करि�ताा राहील व तद्नंंतरच्या नि�वडसूची वर्षा�करि�ताा पुन्हा नव्याने विि¦कल्प देणे

आवश्यक राहील.”

(ख) नामनि�र्देशनाद्वाारे नि�युुक्तीीचा मार्गग—

महााराष्ट्र लोकसेेवा आयोगामार्फफत घेण्यात येणाऱ्या स्पधाा�त्मक परीक्षेच्या नि�काालाच्या आधाारे शि�फाारस करण्यात आलेल्या

उमेदवाारां�मधू

ून नाामनि�र्देेशनााद्वाारे.

(एक) वयोमर्या�दा-

दुकााने नि�रीीक्षक श्रेेणी-२, गट-क या पदाासाठीी खाालीलप्रमाणे आवश्यक राहील.

(एक) कि�माान वयोमर्या�दाा- सदर पद भरतीच्या जाहि�राातीत नमूूद केलेल्या

अर्जज स्वििĒिकृृतीच्या अंति�म दि�नांं�काास १८ वर्षष पूर्णण असावे.

(दोन) कमााल वयोमर्या�दाा- सदर पद भरतीच्या जाहि�राातीत नमूूद केलेल्या

अर्जज स्वििĒिकृृतीच्या अंति�म दि�नांं�काास अमागास

प्रवर्गा�तीील व्यक्तींचे वय ३८ वर्षष पूर्णण पेक्षा

अधि�क नसाावे आणिि” मागास प्रवर्गा�तीील

व्यक्तींचे वय ४३ वर्षष पूर्णण पेक्षा अधि�क नसाावे.

(तीन) वयोमर्या�देेची गणनाा- जाहि�राातीत नमूूद केलेल्या अर्जज स्वीकृतीच्या

अंति�म दि�नांं�काास, उपरोक्त प्रमाणे नमूूद

केलेली कि�माान व कमााल वयोमर्या�दाा धाारण

केलेली असणे आवश्यक राहील.

(दोन) शैक्षणि�क अर्हहता-

सांं�विि¦धि�क विि¦द्यापीठातील कोणत्याही विि¦द्याशाखेची कि�माान पदवीी किं�ंवा शासनााने ति�च्याशी समतुुल्य असल्याचे घोषिि¨त केलेली

अन्य कोणतीीही शैक्षणिि”क अर्हहताा धाारण करणे आवश्यक आहे.

५. नि�यम ३ व ४ येथे नमूूद केलेल्या पदाावरील नि�युुक्त्या या नि�युुक्ती प्राधि�कााऱ्याच्या मान्यतेने करण्यात येतील.

६.नि�युुक्तीीी मार्गा�नुसार नि�युुक्तीीचे प्रमाण :—

नि�यम ४ येथे नमूूद केलेल्या पदााच्या एकूण मंंजूर पदसंंख्येसाठीी, पदोन्नतीीने व नाामनि�र्देेशनााने नि�युुक्ती देण्याचे प्रमाण हे

अनुक्रमे ५०:५० असे राहील;

७. हिं�ंदीीी व मराठीीी भाषाा परीीक्षेबाबतचीीी तरतूद :—

(क) नि�यम ३ व ४ येथे नमूूद केलेल्या पदाावर पदोन्नतीीने नि�युुक्त होणाऱ्या व्यक्तीने, पदोन्नतीीपूर्वी हिं�ंदी भााषा परीक्षा व

मरााठीी भााषा परीक्षा या दोन्ही परीक्षांं�संंदर्भाभाा�त मरााठीी भााषा विि¦भाागाने वेळोोवेळी केलेल्या नि�यमांं�नुसार, हिं�ंदी भााषा व मरााठीी भााषा

परीक्षा अगोदरच उत्तीीर्णण केलेली असणे अथवाा उत्तीीर्णण होण्यापासून सूट मि�ळविि¦लेली असणे आवश्यक राहील. अन्यथाा नि�यम ३

येथील पदाावर पदोन्नतीी अनुज्ञेेय ठरणार नााही.

(ख)नि�यम ४ येथे नमूूद केलेल्या पदाावर नाामनि�र्देेशनााद्वाारे नि�युुक्त होणाऱ्या व्यक्तीने, हिं�ंदी भााषा परीक्षा व मरााठीी भााषा परीक्षा

या दोन्ही परीक्षांं�संंदर्भाभाा�त मरााठीी भााषा विि¦भाागाने वेळोोवेळी केलेल्या नि�यमांं�नुसार, हिं�ंदी भााषा व मरााठीी भााषा परीक्षा उत्तीीर्णण केलेली

नसेेल अथवाा उत्तीीर्णण होण्यापासून सूट मि�ळविि¦लेली नसेेल तर, नि�युुक्तीनंंतर संबंधि�त नि�यमात नमूूद केलेल्या विि¦हि�त मुदतीीत हिं�ंदी

भााषा व मरााठीी भााषा परीक्षा उत्तीीर्णण होणे आवश्यक राहील. त्याचप्रमाणे विि¦हि�त मुदतीीत हिं�ंदी भााषा व मरााठीी भााषा परीक्षा उत्तीीर्णण

न झााल्यास सदर परीक्षा उत्तीीर्णण होईपर्यंंत वार्षिि¨िक वेतनवााढ अनुज्ञेेय राहणाार नााही. तसेेच वरि�ष्ठ पदाावर पदोन्नतीी अनुज्ञेेय राहणाार

नााही.

८. संगणक अर्हहता प्रमाणपत्राबाबतचीीी तरतूद :—

(क) नि�यम ३ व ४ येथील पदाावर पदोन्नतीीने नि�युुक्त होणाऱ्या व्यक्तीने, पदोन्नतीीपूर्वी संगणक अर्हहताा प्रमाणपत्राासंदर्भाभाा�त

शासनााने वेळोोवेळी केलेल्या नि�यमानुसार, संगणक अर्हहताा प्रमाणपत्र धाारण करणे अथवाा सामान्य प्रशासन विि¦भााग (माहि�तीी व

तंत्रज्ञाान) यां�नीी वेळोोवेळी शासन आदेशाद्वाारे नमूूद केलेल्या संगणक/माहि�तीी तंत्रज्ञाान विि¦षयक परीक्षा उत्तीीर्णण होणे अथवाा सामान्य

प्रशासन विि¦भाागाने वेळोोवेळी शासन आदेशानुसार नि�श्चि�ित

केलेल्या वयोमर्या�देेनुसार संगणक अर्हहताा प्रमाणपत्र सादर करण्यापासून

सूट मि�ळविि¦लेली असणे आवश्यक राहील. अन्यथाा नि�यम ३ येथील पदाावर पदोन्नतीी अनुज्ञेेय ठरणार नााही.

(ख) नि�यम ४ येथील पदाावर नाामनि�र्देेशनााद्वाारे नि�युुक्त होणाऱ्या व्यक्तीने, संगणक अर्हहताा प्रमाणपत्राासंदर्भाभाा�त शासनााने

वेळोोवेळी केलेल्या नि�यमानुसार, नि�युुक्तीपूर्वी संगणक अर्हहताा प्रमाणपत्र धाारण केलेले नसल्यास, याबाबतच्या नि�यमात नमूूद

केलेल्या विि¦हि�त मुदतीीत सदर प्रमाणपत्र धाारण करणे आवश्यक राहील. त्याप्रमाणे विि¦हि�त मुदतीीत प्रमाणपत्र धाारण न केल्यास सदर

संगणक प्रमाणपत्र धाारण करेेपर्यंंत वार्षिि¨िक वेतनवााढ अनुज्ञेेय राहणाार नााही. तसेेच वरि�ष्ठ पदाावर पदोन्नतीी अनुज्ञेेय राहणाार नााही.

९. लहान कुटुंंȾबाच्या प्रति�ज्ञाापनाबाबतचीीी तरतूद :—

(१) नि�यम क्र. ४ येथील पदाावर नाामनि�र्देेशनााद्वाारे नि�युुक्त होणाऱ्या व्यक्तीने, महााराष्ट्र नाागरी सेवा (लहान कुटुंं�बाचे

प्रति�ज्ञाापन) नि�यम, २००५ मधीील तरतुदींनुसार व त्याबाबत वेळोोवेळी करण्यात येणाऱ्या नि�यमांं�नुसार, नि�युुक्तीच्या वेळी लहान

कुटुंं�बाचे प्रति�ज्ञाापन सादर करणे आवश्यक राहील.

(२) लहान कुटुंं�बाचे प्रति�ज्ञाापनाामध्ये जर अपत्यसंख्या दोन पेक्षा अधि�क असल्याचे नमूूद केल्याचे नि�दर्शशनाास आल्यास,

संबंधि�त उमेदवाार शासकीय नि�युुक्तीसाठीी अपात्र राहील.

(३) एखााद्या व्यक्तीची शासकीय सेवेत नि�युुक्ती झााल्यानंंतर, जर नि�युुक्तीच्या वेळी किं�ंवा त्यानंंतर त्याला दोनपेेक्षा जास्त

अपत्ये असल्याचे सि�द्ध झााले, तर ती व्यक्ती शासन सेवेकरि�ताा अनर्हह राहील.

भााग चाार-अ-३७७–१अ

१०. बदलीीबाबतचीीी तरतूद :—

नि�यम ३ व ४ येथील पदाावर पदोन्नतीीने नि�युुक्त होणाऱ्या व्यक्तींची सेवाज्येष्ठताा यादी ही राज्य स्तरावर ठेवण्यात येईल.

त्यामुळे सदर व्यक्ती ही महााराष्ट्राात राज्य स्तरावर बदलीीसाठीी पात्र राहील.

११. शासकीीय सेवेत प्रवेश केल्यानंतर सेवावि�षयक अन्य आदेश/नि�यम लागू होतीीील :—

शासकीय सेवेत नि�युुक्ती झााल्यानंंतर राज्य शासनााच्या वतीीने शासन आदेशाद्वाारे नि�श्चि�ित

केलेल्या अटी व शर्ती संबंधि�तांं�स

लागू राहतीील.

NOTIFICATION

Constitution of India.

No. Seprani-2022/C.R.199/Labour-8.—In exercise of the powers conferred by the proviso to

Article 309 of the Constitution of India, and in supersession of all the existing rules, orders or

instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the

following Rules regulating recruitment to the post of Shop Inspector Grade-I and Shop Inspector

Grade-II (Group-C), in the Office of Commissioner of Labour under the administrative controal of

the Labour Department of Government of Maharashtra, namely :—

1. These rules may be called “ The Shop Inspector Grade-I and Shop Inspector Grade-II

(Group-C) (Recruitment) Rules, 2026.

2. In these rules, unless the context requires otherwise, —

(a) “Appointing Authority” means the Commissioner of Labour in relation to the posts of Shop

Inspector Grade-I and Shop Inspector Grade-II (Group-c) ;

(b) “Commissionerate” means Labour Commissionerate under the administrative control of

the Labour Department ;

and conditions specified for promotion by the rules, resolutions or orders issued by the General

Administration Department of the Government, from time to time ;

(d) “Degree” means degree of any discipline of a statutory university or any qualification

declared by the Government to be equivalent thereto ;

(e) “Government” means the Government of Maharashtra ;

(f) “Commission” means the Maharashtra Public Service Commission.

3. Appointment to the post of Shop Inspector Grade-I (Group-C) in the Commissionerate shall be

made by promotion of a suitable person having eligibility for promotion on the basis of seniority from

amongst the persons holding the post of Shop Inspector Grade-II (Group-C) in the Commissionerate

and having not less than three years regular and continuous service on the said post.

4. Appointment to the post of Shop Inspector Grade-II (Group-C) in the Commissionerate shall

be made either,—

(a) by promotion of a suitable person who have opted for promotion to the said post and by

promotion of suitable persons from the separate seniority list of graduates in the Clerk-Typist

(Group-C) cadre maintained at the state level (Commissionerate) and having not less than

three years regular and continuous service on the said posts alongwith minimum educational

qualification as mentioned in sub-clause (ii) of clause (b) :

Provided that, the separate seniority list of Clerk-Typist who have opted for promotion to

the post of Shop Inspector Grade-II (Group-C) is valid only for a concerned selection list year.

It is necessary to prepare a fresh list of seniority on the basis of options given by Clerk-Typist

for that particular year, or

(b) Through nomination from among the candidates recommended based on the results

of the competitive examination conducted by the Maharashtra Public Service Commission.

(i) Age limit :—

(A)

Lower Age Limit

Not less than eighteen years of age as on the last date

of receipt of applications as per advertisement for

recruitment to the said post.

(B)

Upper Age Limit

Not more than thirty-eight years of age for the persons

not belonging to reserved categories and not more than

forty-three years of age for the persons belonging to

reserved categories as on the last date of receipt of

applications as per advertisement for recruitment to

the said post.

(ii) Minimum Educational Qualification- A candidate possess a degree.

5. Appointment to the post mentioned in rules 3 and 4 shall be made with the approval of

Appointing Authority.

6. Appointment to the post mentioned in rule 4 by promotion and nomination shall be made

in the ratio of 50:50, respectively.

7. (a) A person to be appointed to the posts mentioned in rule 3 and 4 by promotion shall

pass the Marathi and Hindi languages examination as per the rules made in this behalf by the

Government, from time to time unless he has already passed or has been exempted from passing

those examinations, before getting promoted to the said post.

(b) A person appointed to the posts mentioned in rule 4 by nomination shall pass the Marathi

and Hindi languages examinations as per the rules made in this behalf by the Government, from

time to time within the prescribed time limit after appointment, unless he has already passed or

has been exempted from passing those examinations. He shall not be eligible for annual increment

or promotion to the next promotional post until he passes those examinations.

8. (a) A person to be appointed to the posts mentioned in rule 3 and 4 by promotion shall

possess a Certificate of Computer Operations prescribed by rules or orders issued in that behalf by

the Government, from time to time, unless he already possess such Certificate or has been exempted

therefrom, before getting promoted to the said post.

(b) A person appointed to the post mentioned in rule 4 by nomination shall possess a Certificate

of Computer Operations prescribed by the Government, from time to time, within the prescribed

time limit after appointment, unless he already possessed or has been exempted from possessing

such Certificate, otherwise, he shall not be eligible for annual increment or promotion to the next

promotion post until he possesses the same.

9. (1) A person recommended for appointment by nomination to the post mentioned in rule 4

shall submit a declaration of Small Family as per the provision of the Maharashtra Civil Services

(Declaration of Small Family) Rules, 2005 or any other rules, orders or any instruments issued in

this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of small

family shall be disqualified for the appointment in Government Service.

(3) After appointment of a person in the Government service, if it is proved that he has

more than two children at the time of appointment or thereafter, then he shall be disqualified for

continuing on the said post in the Government service.
