REVENUE & DISASTER MANAGEMENT DEPARTMENT

RESOLUTION

The 13th March, 2018

In order to promote tourism in a mission mode for economic development and to

promote the brand image of Odisha nationally and internationally and also to attract

investment in tourism sector in the State, the State Government in Tourism and Culture

(Tourism) Department have formulated the Odisha Tourism Policy, 2016 which has been

published in the extraordinary issue of the Odisha Gazette bearing No. 2164 dated 26th

November, 2016. Para 8.1.1 of the said Policy envisages that land for tourism units will be

allotted at concessional rates as per the provisions of IPR, 2015 or as per the guidelines to

be fixed by the Government from time to time.

2. With a view to facilitating allotment of Government Land for setting up tourism

units in the State, formulation of a uniform principle in the matter was under active

consideration of Government for some time past.

3. Keeping the above in view, Government, after careful consideration, have been

pleased to lay down the following principle for allotment of Government Land in favour of

project proponents for establishment of tourism units:—

(i) Whenever the Land Recommendation Committee constituted under Para.

7.2.1 of the Tourism Policy makes a recommendation for allotment of land for

a tourism project, the Tourism Department shall intimate the concerned

Collector about the approval of the project by the Special Single Window

Clearance Committee (SSWCC) constituted under the chairmanship of

Secretary, Tourism Department or State Level Single Window Clearance

Authority (SLSWCA) constituted under the Odisha Industries Facilitation Act,

2004 or High Level Clearance Authority (HLCA) constituted under the same

2

Act, as the case may be, and also about the recommendation of the Land

Recommendation Committee.

(ii) The project proponent shall file requisition for settlement of the land before

the concerned Tahasildar with all documents relating to approval of SSWCC/

SLSWCA/ HLCA, recommendation of the Land Recommendation Committee

and Department of Tourism and lease of the same shall be sanctioned by the

Collector by following due procedure of law.

(iii) The Government Land shall be settled with the project proponent at IPR,

2015 rate of concessional premium.

(iv) The above guidelines shall not be applicable for Municipal Corporation

area limits of Bhubaneswar, Cuttack, Brahmapur, Rourkela and

Sambalpur and Municipal area limits of Puri. For these places, an

auction method shall be followed, the norms of which shall be fixed by

Tourism Department.

(v) Norms for allocation shall be fixed by the Tourism Department along with

clear timelines for completion, failing which land allotment shall be cancelled.

4. Further, Para. 7.2 of the Tourism Policy envisages constitution of a Land Bank

consisting of land parcels identified by Tourism Department and reserved for development

of appropriate categories of tourism projects. As stated therein, the land so reserved will

be allotted for tourism projects as per IPR, 2015 rate as applicable.

5. Keeping the above in view, Government have further been pleased to decide that

if Tourism Department desires to keep any parcel of Government Land reserved in their

'Land Bank for Tourism Projects' for which project proponents have not been finalized,

Government Land identified for such purpose may be reserved in the Land Bank of

Tourism Department u/s 3 (1) (a) of the OGLS Act, 1962. For the purpose, the following

procedure shall be followed:—

(i) After Government Land parcels are identified by Tourism Department for

tourism development, the Tourist Officer of the District shall request the

Collector to reserve the land parcels for Land Bank of Tourism Department

U/s 3 (1) (a) of the OGLS Act, 1962.

(ii) Collector, after getting such request from the Tourist Officer, shall instruct the

concerned Tahasildar to process the proposal for reservation of the land in a

Case Record and the Tahasildar shall send the duly processed Case Record

to Collector through the Sub- Collector.

3

(iii) Collector, after getting the Case Record, shall send the same to Revenue &

DM Department with his recommendation in the Case Record itself for

consideration of Government for reservation of the said land for Land Bank of

Tourism Department.

(iv) On recommendation of the Land Recommendation Committee, the land so

reserved shall be allotted to the project proponents on IPR rate of premium
