NOTIFICATION

The 10th April, 2018

No. 10488–HE-FE-VI-POLICY-0001/2018/HE.— Whereas, draft of certain rules

further to amend the Odisha Education (Establishment, Recognition and Management of

Private College) Rules, 1991 was published in the Extraordinary issue No.256 of the

Odisha Gazette, dated the 22nd February, 2018 as required under sub-section (1) of

Section 27 of the Odisha Education Act, 1969 (Odisha Act 15 of 1969) under the

notification of the Government of Odisha in the Higher Education Department No. 3638-

HE-FE-VI-Policy-0001/2018/HE, dated the 8th February, 2018 inviting objections and

suggestions from all persons likely to be affected thereby till the expiry of a period of

fifteen days from the date of publication of the said notification in the Odisha Gazette;

And, whereas, no objection or suggestion has been received from any person in

respect of the said draft during the stipulated period;

Now, therefore, in exercise of the power conferred by sub-section (1) of the Section

27 of the Odisha Education Act, 1969 (Odisha Act 15 of 1969), the State Government do

hereby make the following rules further to amend the Odisha Education (Establishment,

Recognition and Management of Private Colleges) Rules, 1991, namely :—

1. (1) These rules may be called the Odisha Education (Establishment,

Recognition and Management of Private Colleges) Amendment Rules, 2018.

(2) They shall come into force on the date of their publication in the

Odisha Gazette.

2. In the Odisha Education (Establishment, Recognition and Management of Private

Colleges) Rules, 1991 (hereinafter referred to as the said rules), after clause (i) of sub-rule

(2)of rule 21, the following proviso shall be inserted, namely :—

“ Provided that in case the senior most teacher of the college has become the

Secretary for two terms, the next senior most teacher of the college shall be the Member –

Secretary to the Governing Body. ”.

3. In the said rules, in rule 25, to clause (x) , the following proviso shall be inserted,

namely :—

" Provided that on completion of a period of three months from the date of

nomination of the President under clause (i) of sub-rule (1) , if the five persons are not

nominated by the President, in that case, the Prescribed Authority shall nominate five

persons required under clause (x). ".

4. In the said rules, in rule 29, after clause (n), the following clause shall be inserted,

namely :—

" (O) to ensure submission of correct and timely information to the Director, Higher

Education as may be sought from time to time. ".
