NOTIFICATION

The 12th April, 2018

S.R.O. No. 145/2018— Whereas, the term of the office of the Councillors of the

Notified Area Council, Nuapada would expire on Dt. 12th of April 2018,as the first meeting

of the said Council was held on 13th April, 2013;

And, whereas, the notification dated 31.10.2017 issued by the District Magistrate

Nuapada on delimitation of wards & reservation of seats in respect of Nuapada NAC was

Challenged before the Hon’ble High Court in W.P(C) No 3482 of 2018;

And, whereas, the Hon’ble High Court by their interim order dated the 8th March,

2018,passed in aforesaid writ petition have directed that till next date of listing, the

opposite parties shall not issue any fresh notification in pursuance of Annexure-5 to the

writ petition;

And, whereas, the State Election Commission has intimated that the election

schedule issued on 06.03.2018 was stayed from the stage of issue of Notification by the

Election Officer on 09.03.03.2018 in pursuance of the interim orders dated 08.03.2018 of

the Hon’ble High Court of Orissa passed in WP (C) No 3482 of 2018. Hence , elections to

Nuapada NAC could not be held before completion of five years.

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section

423 of the Odisha Municipal Act, 1950 (Odisha Act, 23 of 1950), the State Government do

hereby appoint the Sub-Collector, Nuapada as Administrator to exercise the powers and

discharge the duties of the Nuapada NAC and its Chairperson during the interval period

between the expiry of the term of the office of the Councillors of the said NAC till the date

of the first meeting of the newly elected Councillors.
