NOTIFICATION

No.14544–PT23-WCD-CW-MISC-0019/2015/WCD&MS.— In pursuance of this

Department Notifications No.8415, dated the 2nd June, 2016 relating to constitution of

additional Child Welfare Committee of Khurda District which shall function at Bhubaneswar

and in consonance with the provisions contained under section 27 of the Juvenile Justice

(Care and Protection of Children) Act, 2015 [hereinafter referred to as “the Act”] read with

rule 15 of the Juvenile Justice (Care and Protection of Children) Model Rules, 2016, the

additional Child Welfare Committee in respect of Khurda District is hereby constituted for

exercising the powers and to discharge the duties conferred on such Committee in relation

to children in need of care and protection as prescribed under the Act and the Rules

framed thereunder with immediate effect for a period of three years.

Additional Child Welfare Committee, Khurda which shall function at Bhubaneswar

will exercise the powers and functions conferred under the said Act over the territorial area

of Bhubaneswar Tahasil.

Child Welfare Committee, Khurda which shall function at Khurda will exercise the

powers and functions conferred under the said Act over the territorial area of Khurda

District excluding Bhubaneswar Tahasil.

The appointment of any member of the Committee shall be terminated by the State

Government after making an inquiry, as stipulated under sub-section (7) of Section 27 of

the Act, if—

(i) he/she has been found guilty of misuse of power vested on him/her under the

Act;

(ii) he/she has been convicted of an offence involving moral turpitude and such

conviction has not been reversed or he/she has not been granted full pardon in

respect of such offence;

(iii) he/she fails to attend the proceedings of the Committee consecutively for three

months without any valid reason or he/she fails to attend less than three-fourths

of the sittings in a year.

The Committee shall function as a Bench and shall have the powers conferred by

the Code of Criminal Procedure, 1973 (2 of 1974) on a Judicial Magistrate of First Class.

The Committee shall meet at least twenty days in a month and shall observe such

rules and procedures with regard to the transaction of business at its meetings, as

prescribed.
