NOTIFICATION

The 28th September, 2018

S.R.O. No.399/2018— Whereas, the draft of certain rules further to amend the

Odisha Municipal Corporation Rules, 2004 was published as required by sub-section(1) of

Section 656 of the Odisha Municipal Corporation Act,2003 (Odisha Act 11 of 2003) in the

Extraordinary issue of the Odisha Gazette No.1205, dated the 19th July,2018 issued under

the notification of the Government of Odisha in the Housing & Urban Development

Department No.18910-HUD-13-LEGIS-67-POLICY-15-16/2018, dated the 18th July, 2018

inviting objections and suggestions from all persons likely to be affected thereby within a

period of thirty days from the date of publication of the said notification in the

Odisha Gazette;

And, whereas, no objection or suggestion has been received during the stipulated

period;

Now, therefore, in exercise of the powers conferred by sub-section(1) of Section

656 of the said Act, the State Government do hereby make the following rules further to

amend the Odisha Municipal Corporation Rules, 2004, namely:—

1.Short title and Commencement:— (1) These rules may be called the Odisha

Municipal Corporation (Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the

Odisha Gazette.

2. In the Odisha Municipal Corporation Rules,2004, after rule 50 , the following

rule shall be inserted, namely:—

“50A. Manner of voting at meeting of no-confidence motion.-(1) Every Political

Party, whose member as an elected Corporator cast a vote in a meeting of no- confidence

motion against the Mayor or the Deputy Mayor, as the case may be, may appoint an

authorised agent and the President, General Secretary or any person authorised by the

State Level Political Party or State Unit of the National Political Party shall, in writing,

inform the same to the Presiding Officer, with full details of the authorised agent,

proposed to be engaged for the said meeting prior to the scheduled date of the meeting.

(2) The Presiding Officer shall issue the ballot papers to all elected Corporators

mentioning the serial number thereon as reflected in a register specifically prepared for the

purpose with proper acknowledgement to cast his vote.

(3)The Presiding Officer shall, when an elected Corporator being a member of a

political party records his vote on the ballot paper and before such Corporator inserts that

ballot paper into the ballot box, allow the authorised agent of that political party to verify as

to whom such Corporator has cast his vote.”.
