NOTIFICATION

The 28th September, 2018

S.R.O. No.400/2018— Whereas, the draft of certain rules further to amend the

Odisha Municipal Rules, 1953 was published as required by Section 392 of the Odisha

Municipal Act,1950(Odisha Act 23 of 1950) in the Extraordinary issue of the

Odisha Gazette No.1204, dated the 19th July,2018 issued under the notification of the

Government of Odisha in the Housing & Urban Development Department No.18906-HUD-

13-LEGIS-67-POLICY-15-16/2018, dated the 18th July, 2018 inviting objections and

suggestions from all persons likely to be affected thereby within a period of thirty days

from the date of publication of the said notification in the Odisha Gazette;

And, whereas, no objection or suggestion has been received during the stipulated

period ;

Now, therefore, in exercise of the powers conferred by Section 387 of the said Act,

the State Government do hereby make the following rules further to amend the Odisha

Municipal Rules, 1953, namely:—

1. Short title and Commencement:— (1) These rules may be called the Odisha

Municipal (Amendment) Rules,2018.

(2) They shall come into force on the date of their publication in the

Odisha Gazette.

2. In the Odisha Municipal Rules, 1953, after rule 64A, the following rule shall be

inserted, namely:—

“64B. Manner of voting at meeting of no-confidence motion.— (1) Every Political

Party, whose member as an elected Councillor cast a vote in a meeting of no- confidence

motion against the Chairperson or the Vice Chairperson, as the case may be, may

appoint an authorised agent and the President, General Secretary or any person

authorised by the State Level Political Party or State Unit of the National Political Party

shall, in writing , inform the same to the Presiding Officer, with full details of the authorised

agent, proposed to be engaged for the said meeting prior to the scheduled date of the

meeting.

(2) The Presiding Officer shall issue the ballot papers to all elected Corporators

mentioning the serial number thereon as reflected in a register specifically prepared for the

purpose with proper acknowledgement to cast his vote.

(3) The Presiding Officer shall , when an elected Councillor being a member of a

political party records his vote on the ballot paper and before such Councillor inserts that

ballot paper into the ballot box, allow the authorised agent of that political party to verify as

to whom such Councillor has cast his vote.”.
