NOTIFICATION

The 25th February, 2019

No.1036–IIEX-1/2017(Pt)/Ex.— In exercise of the powers conferred by sub-section

(9) of section 5 of the Odisha Excise Act, 2008 (Odisha Act 10 of 2013) and in

supersession of all previous notifications issued on the subject, the State Government do

hereby invest the following powers with the officer in charge of a police station and with

such other officer subordinate to him, whom he deputes pursuant to sub-section (1) of

section 157 of Code of Criminal Procedure, 1973 to perform the functions of an Excise

Officer and such officer shall be deemed to be an Excise Officer for the purpose of the said

Act, namely:—

(a) section-77- Power to arrest without warrant, to seize articles liable to confiscation

and to make searches;

(b) section-79 (2)-Power relating to enter, search and seize;

(c) section-80-Power to prevent commission of offence;-

(d) section-83-Power to investigate offences;

(e) section-84- Power and duties of the officers investigating offences; and

(f) section-85-Provisions as to bail in offences other than non-bailable offence;

This notification shall come into force on the date of its publication in the

Odisha Gazette.
