NOTIFICATION

No.19955-RDM-LAA-KHD-0010/2015/R&DM.―Whereas, the Declaration under Section

8 (2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013 was issued by Government for acquisition of private land measuring an

area of Ac.0.570 in village - Badatota, under Jatni Tahasil of Khordha District vide Revenue &

Disaster Management Department notification No. 21994, dated the 20th June, 2018 which was

published on dated the 28th June, 2018 and Preliminary Notification under Section 11 (1) of the

Act in respect of the above schedule of land has not been issued till date;

And, whereas, as per Section 14 of the Act, where a Preliminary notification under

Section 11 is not issued within twelve months from the date of appraisal of the Social Impact

Assessment report submitted by the Expert Group under Section 7, then, such report shall be

deemed to have lapsed and a fresh Social Impact Assessment shall be required to be undertaken

prior to acquisition proceedings under Section 11: The 1st proviso to Section 14 provides that the

appropriate Government shall have the power to extend the period of twelve months, if in its

opinion circumstances exist justifying the same;

And, whereas, the Land Acquisition Officer, Khordha / Project Proponent i.e. Commandant,

160 Batalion, BSF, Badatota, Jatni, Khordha has requested with reasons to extend the period of

twelve months up to 27th June, 2020 and the appropriate Government is of the opinion that

circumstances existed for the inadvertent delay;

Now, therefore, in exercise of the powers conferred by Para. 2 of Section 14 of the Right to

Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act,

2013 (30 of 2013), the State Government do hereby decide to extend the period off twelve

months from the date of Declaration U/s. 8 (2) of the RFCTLAR&R Act, 2013 up to 27th June,

2020 for issue of Preliminary Notification under Section 11(1) of the said Act.
