NOTIFICATION

The 6th August, 2019

No.13422‒STSCD-MCW-MISC-0021/2018/M&BCW―Whereas,

the

matters

relating to establishment of Wakf was under the Administrative control of the Law

Department;

And, whereas, to regulate election to the State Wakf Board, the Secretary, Law

Department has been declared as the “Election Authority” under clause (e) of rule-2 of the

Odisha State Wakf Board (Conduct of Election) Rules, 1997;

And, whereas, the said establishment has been entirely transferred to Minority &

Backward Classes Welfare Department in Law Department Resolution No.2866, dated the

23rd March, 2015, published in the Odisha Gazette dated the 5th June, 2015;

And, whereas, after such transfer the Minority & Backward Classes Welfare

Department has become the Administrative Department in respect of the establishment of

Wakf;

And, whereas, it is expedient to declare the Secretary, Minority & Backward

Classes Welfare Department as the Election Authority in place of Secretary, Law

Department;

Now, therefore, in exercise of the powers conferred by sub-section(1) read with

clause (iv) of sub-section (2) of Section 109 of the Wakf Act, 1995 (43 of 1995), the State

Government do hereby make the following rules further to amend the Odisha State Wakf

Board (Conduct of Election) Rules,1997, namely :―

1. Short title and commencement:― (1) These rules may be called the Odisha State

Wakf Board (Conduct of Election) Amendment Rules, 2019.

(2) They shall come into force on the date of their publication in the Odisha

Gazette.

2. In the Odisha State Wakf Board (Conduct of Election) Rules, 1997, in rules 2, for

clause (e), the following clause shall be substituted, namely:―

“(e)

“Election Authority” means the Secretary to Government, Minorities &

Backward Classes Welfare Department”.
