AWARD
This case arises out of an application filed by the above named workman under Section
2-A(2) of the I. D. Act, 1947 with a prayer to adjudicate the following industrial dispute as
scheduled below :
“Whether the termination from service of Shri Himanshu Sekhar Panigrahi, Area
Business Manager with effect from the 4th June 2012 by the Management of RPG
Life Sciences Limited, At Worli, Mumbai-400030 is legal and/or justified? If not,
what relief the workman Shri Himanshu Sekhar Panigrahi is entitled to ?”
2. After institution of this case by the workman, the management made appearance and filed
its W.S. Thereafter, issues were settled and the case was ready for hearing. The workman took
several adjournments for hearing of this case. At last, on the 8th July 2020, he files a Memo.
intimating that he does not want to proceed further with this case. On perusal of the Memo., dated
the 8th July 2020 attached to the case record, this Court is of considered opinion that the workman
does not want to proceed further with this case. The further pendency of this case will be an abuse
of the process of the Court. Inadvertently, the case could not be disposed of earlier, due to non-
tracing of the Memo., dated the 8th July 2020 by this Court, which should have been disposed of
much earlier.
2.1 From the above, this Court is of considered view that, when the workman himself is not
interested to proceed with the case, there is no necessity to keep pending this case. Moreover, this
is a case of eight years old, which needs early disposal. Hence this Court does hereby pass a “No
Dispute Award” so far as the present application is concerned.
