21. It is also trite that for the purpose of grant of

back wages, conduct of the concerned workman also

plays a vital role. Each decision, as regards grant of back

wages or the quantum thereof, would, therefore, depend

on the facts of each case. It cannot be claimed as a

matter of right. The petitioner cannot get two wages

from the two employers for the same period. Considering

the facts and circumstances of this case, this court

comes to the conclusion that the petitioner is not

entitled to get the full back wages, continuity of service

and other benefits. The point is decided accordingly.

22. In the result, the industrial dispute is allowed and

the respondent is hereby directed to reinstate the

petitioner. However, the petitioner is not entitled to get

full back wages, continuity of service and other

benefits. There is no order as to costs.

GOVERNMENT OF PUDUCHERRY

DEPARTMENT OF HINDU RELIGIOUS INSTITUTIONS AND WAKF

No. 4542/CHRI/T1/2010/240.

Puducherry, the 28th February 2011.

ORDER

Whereas, the present Board of Trustees of Sri Maragathavalli Udanurai Malligarjuneswarar and

Muthalamman Devasthanam, Pandasozhanallur, Nettapakkam, Puducherry have proposed to alienate temple land

(certain sub-divisions as stated in the Annexure-A and B) in R.S.No. 65 of Pandasozhanallur Revenue Village in

Nettapakkam Commune in Puducherry region to an extent of 00H. 33A. 90Ca., in favour of 42 residents who are

living on the said temple land;

And whereas, the temple authorities have resolved to alienate the land as per the extent they have occupied

at present. These residents have been allowed to reside in the said temple land in R.S. No. 65 more than several

decades and have been in continuous occupation of these lands by putting up their houses. Therefore the temple

authorities have come forward to alienate the land to these occupants as per the Annexure-A and B;

And whereas, a newspaper Notice No. 4542/CHRI/T1/2010, dated 26-5-2010 was published under section 25 (1)

of the Puducherry Hindu Religious Institutions Act, 1972 by the Commissioner, Hindu Religious Institutions regarding

the proposed sale of the temple land in the “Dina Malar” on 4-6-2010 inviting objections/suggestions, if any, from

the public on or before the expiry of 30 days from the date of publication of the said notice in the said newspaper;

And whereas, 86 objections were received in this regard and they were called for enquiry on various dates

during the month of July 2010. Out of the said 86 objectioners only two objectioners appeared for enquiry before

the undersigned and in view of the reasons/replies stated in the report submitted to His Excellency the

Lieutenant-Governor on 17-9-2010 and as the alienation rate has been resolved by the Council of Ministers, in the

Cabinet Meeting, vide “Resolution No. 2010/M.25/225, dated 29th December 2010”, and approved by the Government

under Puducherry Hindu Religious Institutions Act and Rules the abovesaid 86 objections have been overruled,

vide Office Order No. 4542/CHRI/T1/2010/128, dated 21-01-2011;

And whereas, the proposed sale is considered as being necessary and beneficial to the institution;

Now, therefore, in view of the said disposal of objections made by the 86 objectioners, and in the light of

the resolution passed by the temple authority on 23-4-2010 and 12-1-2011 and as the land proposed for alienation

does not fetch revenue to the said temple, as no rent has been collected from its tenants, in exercise of the powers

conferred by sub-section (1) of section 25 of Puducherry Hindu Religious Institutions Act, 1972 on the undersigned

being the Commissioner for the purposes of the said Act, sanction is hereby accorded to the temple authority

of the abovesaid Devasthanam for the sale of land comprised in R.S. No.65 (certain sub-divisions as stated in

Annexure-A and B ) of Pandasozhanallur Revenue Village (No. 58) in Puducherry region in favour of the 42 tenants

living therein at the rate of ` l50 per sq.ft. for 13 tenants and @ ` 40 per sq.ft for 29 tenants as resolved by

the Council of Ministers in the Cabinet Meeting, vide Resolution, dated 29-12-2010 and as specified in the

Annexure-A and B to this order. Further, it is ordered that :

(a) The sale proceeds received from the intended purchaser from time to time have to be remitted into a

nationalised bank in one account and thereafter the total amount should be converted as fixed deposit in

favour of “The Commissioner, Hindu Religious Institutions on account of Sri Maragathavalli Udanurai

Malligarjuneswarar and Muthalamman Devasthanam, Pandasozhanallur, Nettapakkam, Puducherry”.

(b) The fixed deposit shall not be withdrawn from the bank on any account and shall be reinvested again

and again perpetuating the asset.

(c) The transaction shall be completed within the period of three months from the date of issue of this

order. If delay occurs beyond the said period of three months in payment of sale proceeds, interest @ 12%

per annum to the balance amount or sale amount shall be collected from the intended purchaser concerned,

as the case may be. However, this order will be in vogue for a period of 12 months from the date of issue

of this order.

(d) The progress report on the alienation of the temple land shall be sent to the office of the undersigned

every month without fail till the completion of this alienation.
