GOVERNMENT OF PUDUCHERRY
DEPARTMENT OF HINDU RELIGIOUS
INSTITUTIONS AND WAKF
No. 3609/CHRI/T1/2010/243.
Puducherry, the 28th February 2011.
ORDER
Whereas the Mata Amirthanandamayi Math had
offered to purchase the land belonging to Sri Kasi
Visalatchi Samedha Sri Kasi Visvanathar Devasthanam,
Odiampet, Villianur, Puducherry, situate at R. S. Nos. 99/5
and 99/1 (46. Oulgaret Revenue Village) to the extent

LA GAZETTE DE L’ETAT
of 00.71.50 and 00.71.00 Hectares (1,53,330 sq.ft.) for
starting Educational Institutions, proposed to be run
by the Math, in Puducherry;
And whereas, the consent of the said temple was
called for and in pursuance of section 25(1) of the
Puducherry Hindu Religious Institutions Act, 1972, a
notification was issued on 28-1-2008 in Dinakaran. In
this regard, several objections were received from the
Special Officer of the said Devasthanam/villagers as
well as the Hon’ble Minister for Public Health and were
heard by the Commissioner, Hindu Religious
Institutions. However, the said objections were
withdrawn by the Hon’ble Minister for Public Health as
well as the villagers, as enunciated in the Cabinet
Memorandum submitted on 29-12-2010 for consideration
of the Council of Ministers;
And whereas, at a later stage, the Math had
requested to lease the extent of 1,23,330 sq.ft.
in R.S. Nos. 99/5 and 99/1 for starting Educational
Institutions, proposed to be run by the Math in
Puducherry, if outright sale is not possible;
And whereas, the said subject matter of leasing of
the said temple land to the Math was placed before the
Council of Ministers on 29th December 2010, wherein
the Council of Ministers vide its Resolution No. 2010/
M.25/227, dated 29-12-2010, resolved to allow outright
sale of the temple land to Mata Amirthanandamayi Math
for setting up of a school. The value of the land the Mutt
authorities to the effect that 10% of the seats in the
school every year shall be filled up through Government
nominees. The Sub- Collector (Revenue) South,
vide Letter No. 349/SCRS/F-RENT/2010, dated 26-5-2010
has furnished that the present GLR 2010-11 is
` 150 per sq.ft , for the land situate at R.S. Nos. 99/l
and 99/5 of Odiampet Revenue Village;
And whereas, the said Special Officer also resolved
on 13-1-2011 to direct sale of the said temple land situate
in R.S. Nos. 99/1 and 99/5 of Odiampet Revenue Village
at the rate resolved by the Council of Ministers i.e.,
@ ` 150 per sq.ft +30% solatium and 12% thereupon
and arrived a total sale amount of ` 2,69,35,272
for 1,23,330 sq.ft., out of the total area of 1,53,330 sq.ft
situate therein;
And whereas, the proposed sale is considered as
being necessary and beneficial to the institution, since
the interest earned out of the fixed deposits will be much
higher than the very meager income now derived out of
the land;
Now therefore, in view of the withdrawal of objections
and the resolution passed by the temple authorities
on 13-1-2011 and that the land proposed for sale is
ascertained to be barren, the Commissioner, Hindu
Religious Institutions is hereby pleased to approve the
proposed direct sale of the temple land to the extent of
1,23,330 sq.ft., out of the total area of 1,53,330 sq.ft
situate therein at R.S. Nos. 99/1 and 99/5 of Odiampet
Revenue Village of Sri Kasi Visalatchi Samedha Sri
Kasi Visvanathar Devasthanam, Odiampet, Villianur,
Puducherry to Mata Amirthanandamayi Math for
establishing a CBSE Pattern School @ ` 150 per sq.ft
(1,23,330 sq.ft x ` l50=` l,84,99,500) + 30% solatium
(` 55,49,850) and 12% (` 28,85,922), with a total sale
amount of ` 2,69,35,272 for 1,23,330 sq.ft. with a
commitment to be obtained from the Mutt authorities to
the effect that 10% of the seats in the school every year
shall be filled up through Government sponsored
candidates, provided that—
(a) the sale proceeds received from the intended
purchaser from time to time have to be remitted into
a nationalised bank in one account and thereafter the
total amount should be converted as fixed deposit in
favour of “The Commissioner, Hindu Religious
Institutions on account of Sri Kasi Visalatchi Samedha
Sri Kasi Visvanathar Devasthanam, Odiampet,
Villianur, Puducherry”;
(b) the fixed deposit shall not be withdrawn from
the bank on any account and shall be invested again
and again perpetuating the asset.
(c) the transaction shall be completed within the
period of three months from the date of issue of this
order. If delay occurs beyond the said period of three
months in payment of sale proceeds, interest @ 12%
per annum on the sale amount or the balance thereof
shall be collected from the intended purchaser
concerned, as the case may be. However, this order will
be in vogue for a period of 12 months from the date
of issue of this order; and

temple land shall be sent to the office of the

GOVERNMENT OF PUDUCHERRY
HEALTH SECRETARIAT
(G.O. Ms. No. 8, dated 28th February 2011)
ORDER
Whereas, at present, the Food and Drugs Administration is functioning as one of the unit of the Health
Department under the control of Director of Health and Family Welfare Services who has been notified as
Commissioner of Food and Drugs Administration for the purpose of the Drugs and Cosmetics Act, 1940 and
Prevention of Food Adulteration Act, 1945;
214
LA GAZETTE DE L’ETAT
[22 March 2011
Of late, there has been enormous growth in the field of Drugs Manufacturing Units and Drugs Sales Units,
with a meager capacity of manpower in the Food and Drugs Administration unit, this Administration is unable to
perform proper statutory functions like enforcement of the Drugs and Cosmetics Act with the increase in the number
of pharmaceutical industrial units, sales units and complaints thereon like adulterated drugs, non-quality of drugs
and expired drugs moving in the market.
At one stage, the continuance of the Director of Medical Services as Licensing Authority under the Drugs
and Cosmetics Rules, 1945 was legally challenged under the provisions of the Drugs and Cosmetics Rules, 1945
since he did not possess the qualifications as prescribed under rule 49(A) of the Drugs and Cosmetics Rules, 1945.
As per the court direction, the appointment of a qualified person as Licensing Authority has been carried out,
but delinking of Food and Drugs Administration from the Directorate of Health and Family Welfare Services was under
consideration of the Government since long back.
Besides, the section 21(3) of the Drugs and Cosmetics Act requires that ‘No person who has any financial
interest in the import, manufacture or sale of drugs or cosmetics shall be appointed as an Inspector under this
section’. The Directorate and other subordinate institutions of the Health Department is purchasing drugs for
the purpose of storage and distribution of the medicines at free cost to the poor and at a price for others.
The Health Department along with subordinate institutions is involved in the purchase and sale of drugs to the
patients. Hence, delinking of Drugs Administration from the Health Department, which has direct and indirect interest
in the sale of drugs is only legal necessity as per the Act.
In other states like Tamil Nadu, Andhra Pradesh, Karnataka and Kerala, Drugs Control Department is
independent of the Health Department and the Heads of these Departments are reporting to the Government directly.
As such, it is decided to delink the Drugs Administration from the Health Department and to set up a separate
Directorate in order to streamline and strengthen the Drugs Administration.
2. Whereas, the Government of India has taken a corrective measure in food safety structure and the status
of Food Testing Laboratory in the States and accordingly the Food Safety and Standards Authority of India (FSSAI)
has been established under Food Safety and Standards Act, 2006 with the mandate to lay down science based
standards for articles of food and to regulate their manufacture, storage, distribution, sale and import, to ensure
availability of safe and wholesome food for human consumption.
As instructed by the Government of India to all the State Governments/Union Territories, a separate
Department of Food Safety is to be constituted for which a Senior Secretary Level Officer will be the Apex of the
