NOTIFICATION

The Lieutenant-Governor, Puducherry is pleased to enhance

the quantum of immediate relief assistance for the legal heir of the

deceased/missing fishermen under the scheme “Welfare and Relief

for Fishermen during Lean Season and Natural Calamities” in the

Union territory of Puducherry.

AMENDMENT

1. Short title and commencement.— (1) These rules may be

hereafter called as—

(a) Immediate death relief assistance @ ` 2.00 lakhs

for the legal heir of the deceased fishermen;

(b) Immediate relief assistance @ ` 1.50 lakhs for the legal

heir of the missing fishermen.

(2) They shall be deemed to have come into force with

effect from the date of issue of this notification.

In paragraph 5(a)(ii) and 5(b) (iii) (a) and (b) the following shall

be substituted.

5(a) (ii) Pattern of assistance.— Cash assistance of ` 2.00 lakhs

to the family (legal heir) of deceased fishermen within 15 days

to 3 months of time from the date of receipt of application as in

Annexures-I and II from the affected family.

5(b) (iii) (a).— Cash assistance @ ` 1.50 lakhs for the

family (legal heir) of the missing fishermen will be extended in

two phases after scrutiny of application and approval of the

Government. Initially, a cash assistance of 50% i.e., ` 0.75 lakh

will be extended within 3 months from the date of receipt of application

as in Annexure-I for the family (legal heir) of missing fishermen

regarding the incident with authenticated documents. The family

(legal heir) of the missing fishermen should approach the department

for the release of balance 50% of relief which will be deposited in

the bank in a joint account in the name of kin (legal heir) and the

competent authority concerned. The deposited relief assistance of

` 0.75 lakh shall be released after 9 months of period from the

date of release of 1st part of lump sum for the family (legal heir)

of the missing fishermen. In case of return of the missing fishermen,

the amount extended as compensation either ` 0.75 lakh or ` 1.50 lakhs

as the case may be, will be recovered by invoking insurance bond.

5(b)(iii)(b).— The ex gratia amount will be released to the

next kin of missing person subject to the condition that they

should execute an indemnity bond to the value of ` 1.50 lakhs in

addition to the undertaking certificate from the legal heir.

Further, the quantum of assistance mentioned wherever in the

G. O. Ms. No. 31/Fy., dated 6-9-2011 from the Under Secretary

to Government (Fisheries), Chief Secretariat, Puducherry as ` 1.00 lakh

for the family of missing/deceased will be substituted as ` 1.50 lakhs

for the legal heir of the missing fishermen and ` 2.00 lakhs for

the legal heir of the deceased fishermen.

2. This issues with the concurrence of the Finance Department,

Puducherry vide their U.O. No. 1191/2012-13/F4, dated 30-8-2012.

Now, in consideration of the department having made the payment

to the legal heir , the legal heir agrees to indemnify and produce insurance

bond for ` ....................................... (which is the claimed amount from

this department) with a validity for 12 months obtained from nationalised

insurance company.

In case the missing person is later reported to be alive/returns

home, the legal heir undertakes to indemnify the department for relief

amount paid. Further, the department reserves the right to recover the

loss to this administration.
