NOTIFICATION

The following draft proposal for fixation of the minimum rates of wages payable to the employees under

employment in sweeping and cleaning work in the Union territory of Puducherry, which the Lieutenant-Governor,

Puducherry proposes to make in exercise of the powers conferred by clause (a) of sub-section (1) of section 3 read with

sub-section (1) of section 13 of the Minimum Wages Act, 1948 (Central Act 11 of 1948) is hereby published as required

under clause (b) of sub-section (1) of section 5 of the said Act for information of all persons likely to be affected thereby

and notice is hereby given that the said draft proposal will be taken into consideration by the Government of Puducherry

after the expiry of sixty days from the date of publication of the said proposal in the official gazette, Puducherry.

2. Any objections or suggestions, which may be received from any person with respect to the proposal before

the expiry of the period specified above, will be considered by the Government of Puducherry. The objections or

suggestions should be addressed to the Secretary to Government, Labour Department, Puducherry.

Draft proposal

In exercise of the powers conferred by clause (a) of sub-section (1) of section 3 read with sub-section (1) of

section 13 of the Minimum Wages Act, 1948 (Central Act 11 of 1948), the Lieutenant-Governor, Puducherry has been

pleased to fix the minimum wages as specified in the Schedule hereunder, in respect of the employees employed in

sweeping and cleaning work in the Union territory of Puducherry.

NOTE

Dearness allowance : (1) In addition to the minimum wages fixed above, the employees shall be paid

dearness allowance as indicated below :

(i) The dearness allowance is linked to the average Puducherry Consumer Price Index Number for the base

year 2001=100 and for every raise or fall in consumer price index number (Base year 2001=100) beyond 133

points for industrial workers an increase of 0.90 paise (ninety paise only) per day shall be paid as dearness

allowance.

(ii) The dearness allowance shall be calculated every year on the 1st April on the basis of the average

of the indices for the preceding twelve months namely from January to December.

(iii) The first calculation shall thus be effective from the date of publication of the notification in the

Puducherry Government Gazette based on the average of Puducherry Consumer Price Index Number for the

previous year.

(2) This minimum rate of wages includes the wages for weekly day of rest and also applicable to the

employees engaged on contract and casual labour.

(3) The men and women employees shall get the same rates of wages for the same work or work of similar

nature and there shall not be any discrimination on the basis of sex.

(4) To arrive at the daily rate of wages, the monthly wages shall be divided by 26.

(5) To arrive at the monthly rates of wages, the daily rate of wages shall be multiplied by 30.

(6) Wherever the existing wages are higher than the minimum wages fixed herein, the same shall be continued

to be paid.

(7) The minimum rate of wages and dearness allowance both constitute the minimum rate of wages to be

enforceable under the Minimum Wages Act, 1948.

NOTIFICATION

Whereas, the local bodies are presently collecting the entertainment tax from the cable television network

operators, operating the cable television network connections to the households, hotels/restaurants, etc., within the

jurisdiction of the respective local body and the quantum of entertainment tax so far collected by the local body is

found to be very meagre. Further it has also been observed that there is no uniform rate of fee charged by the cable

television network operators and eventhough the number of cable television network operators are found to be more,

only a few of them are found to have registered their system of cable television network operation with the local bodies

and remitted the entertainment tax to the local body concerned. As of now, the cable television network is being

digitalised and the practice of viewing television program is also increasing for which there is no provision in the law

relating to local bodies for collection of entertainment tax from the cable operators;

2. And whereas, in order to regulate the procedure of collection of entertainment tax from the cable television

network operators, the Government desires to have a detailed study on the introduction of a new methodology and to

bring an amendment in the existing provisions of the Puducherry Municipalities Act, 1973 and the Puducherry Village

and Commune Panchayats Act, 1973 relating to cable television network system, the Government has considered it

has necessary for constitution of a committee for giving recommendations;

3. Now, therefore, the Lieutenant-Governor, Puducherry is pleased to constitute a committee to study the

methodology and to recommend the uniform procedure of collection of entertainment tax from the cable television

network operators to be followed by local bodies in this Union Territory and to bring suitable amendments in the

existing provisions of the Puducherry Municipalities Act, 1973 and the Puducherry Village and Commune Panchayats

Act, 1973 relating to the levy and collection of entertainment tax on the cable network system, with the following

(i) To study the methodology and regulate the uniform procedure of collection of entertainment tax from

the cable television network operators and to bring an amendment in the existing provisions of the Puducherry

Municipalities Act, 1973 and the Puducherry Village and Commune Panchayats Act, 1973 relating to cable

television network system.

(ii) To evolve a process for registration by the cable television network operators with the local bodies

for the purpose of entertainment tax and advertisement tax.

(iii) To conduct meetings of all the Commissioners of the local bodies in Puducherry, Karaikal, Mahe and

Yanam regions whenever necessary and to discuss the subject relating to assessment of collection of

entertainment tax from the cable television network operators including the methodologies, framing of formula

and calculation of arrears, etc.

(iv) The committee has to submit its report to the Government within 30 days from the date of issue of

the notification.

NOTIFICATION

Whereas, it shall be the duty of the Municipalities, Commune Panchayats and Village Panchayats, as the case

may be, as far as the funds at its disposal admit, to take reasonable provision for the lighting of public streets in

built-up areas and also in areas other than built-up areas under section 229 of the Puducherry Municipalities Act, 1973

and section 76 read with section 82 of the Puducherry Village and Commune Panchayats Act, 1973;

2. And whereas, the Electricity Department hitherto installed and maintained the street lights, by engaging

their staff and claim installation charges and monthly current consumption charges, at fixed tariff, from the local bodies concerned;

3. And whereas, in pursuance of the Electricity Act, 2003 (Central Act 36 of 2003) of Joint Electricity Regulatory

Commission constituted by the Joint Electricity Regulatory Commission, Electricity Supply Code Regulations, 2012

have advised that the maintenance of street lights hitherto carried out by the Electricity Department in Municipal and

Village Panchayat areas in the Union Territory shall be discontinued and it should be given back to the local bodies

concerned for their maintenance and the concerned local bodies shall bear full cost of estimate and work shall be

taken up only after deposit of the amount and execution of agreement by the local bodies;

4. And whereas, while the directions of the Joint Electricity Regulatory Commission are sought to be enforced

against the local bodies they have raised that they are facing acute shortage of funds to settle the overdue current

consumption charges in respect of the public street lights and the Government has therefore considered it necessary

to review the existing pattern of provision of street lights for introducing appropriate remedial measures for providing

and maintaining the street light in public streets in future in the municipal and village panchayat areas in the Union

Territory by the local body concerned;

5. Now, therefore, the Lieutenant-Governor, Puducherry is pleased to constitute a High Level Committee to

discuss and recommend the methodology for maintenance of street lights by the Municipalities, Commune Panchayats

and Village Panchayats, as the case may be, in liaison with the Electricity Department, Puducherry, with the following composition:
