LABOUR DEPARTMENT

NOTIFICATION

Whereas, the Lieutenant-Governor, Puducherry has by

notification vide G.O. Ms. No. 9/95/Lab., dated 7-4-1995

under sub-section (1) of section 52 of the Puducherry

Shops and Establishments Act, 1964 authorised the

Secretary to Government, Labour Department, Puducherry

to exercise the powers of the Government under section 6

of the said Act relating to exemption;

And whereas, the Karaikal Stationery Merchants

Association, Karaikal West Side Viyabarigal Sangam,

Karaikal Jewellers Association and Karaikal Jawli

Viyabarigal Sangam have applied for grant of exemption

to shops and establishments in Karaikal region to keep

them open beyond the working hours and on weekly

holidays from certain provisions of the said Act on

account of important festivals viz., Tamil New Year,

Atchayathridhiyai, Re-opening of schools/colleges,

Mangani Festival, Ramalan, Adi Month Festival,

Vinayagar Chaturthi, Bakrid, Ayuthapooja, Deepavali,

Christmas and Pongal, etc.;

Now, therefore, in exercise of the powers conferred

by section 6 of the said Act, the Secretary to

Government, Labour Department hereby exempt all

shops and establishments in Karaikal region from the

application of the provisions of the sections 10(1),

12(1), 12(2), 13, 14(1), 14(2), 16(1), 17(1), 17(2), 18

and 19 of the said Act, to keep them open beyond the

working hours and on weekly holidays during the under -

mentioned festivals period, subject to the following

conditions:—

1. Every person shall be paid overtime wages at

twice the ordinary rate of wages for the period of

work done by him in excess of 8 hours in a day or

48 hours in a week.

2. The total hours of work of each worker

including overtime shall not exceed 10 hours

including one hour of rest in any day or 54 hours in

a week.

3. Each shop/establishment should file a return at

the end of each of spell exemption specifying the

number of workmen engaged beyond normal working

hours and on their weekly holiday and enclosing

proof for payment of extra wages for the hours/days

so employed.

Whereas, the National e-Governance Plan (NeGP)

of the Government of India aims to make all

Government services accessible to the common man

in his locality, through common services delivery

outlets and ensure efficiency, transparency and

reliability of such services at affordable costs to

realise the basic needs of the common man;

And whereas, the Government of Puducherry

desires to create a mechanism to deliver public

services by utilising the network of the Common

Services Centres;

And

whereas,

the

State

Government

is

implementing State Portal (SP), State Service Delivery

Gateway (SSDG) and Electronic Forms Project;

And whereas, State Portal, State Service Delivery

Gateway and Electronic Forms Project entails delivery

of the services through Common Services Centres

(CSCs) by leveraging the common infrastructure

[State Wide Area Network (SWAN), State Data Centre

(SDC), etc.] and develop the applications and

infrastructure required for deployment of State Portal

and State Service Delivery Gateway (SSDG) for the

State which will enable citizens to download forms

and submit their applications electronically through

a common gateway;

And whereas, this initiative facilitating Electronic

Service Delivery will provide significant benefits to

the citizens, especially in the form of a single gateway

to citizen for service delivery;

And whereas, State Portal, State Service Delivery

Gateway and Electronic Forms Project will enable

citizen to fill the form either online or offline at Common

Services Centres and submit it electronically to the

concerned office of the concerned department. While

the submitted e-form will be routed through State

Service Delivery Gateway (SSDG) to the respective

field office of the concerned department responsible,

for providing that particular service, State Portal (SP)
