IN THE COURT OF THE SUBDIVISIONAL MAGISTRATE (SOUTH)
AT VILLIANUR
Present : Thiru P. PARTHIBAN, I.A.S.,
Subdivisional Magistrate (South).
M.C. No. 542/2014
ORDER UNDER SECTION 144 of Cr. P.C.
Whereas, it has been brought to me by the S.H.O’s of my jurisdiction that
various political parties, caste based organizations and other individual groups are
in the habit of erecting cut outs, banners, hoardings and wall paintings in public
places and important junctions with the portrait of political leaders during the
celebrations of birthdays, marriage functions, etc., and also installed their party flag posts
in the public places without getting approval from the competent authority;
Whereas, the sympathizers of particular community are frequently having
quarrel with other community people when they are erecting banners in public places
and important junctions. This creates enmity, hatred and ill feeling among the members
of other communities. In some occasions, there are instances of communal clash

between different communities over the removal of banners, defacement of wall paintings
which in turn even leads to law and order problem and affects the normal life of the
innocent public. The traders, petty shop owners and other general merchants are also
facing lot of hardship due to such unwanted structures in their business place and
also it becomes a nuisance for general public;
Whereas, I am convinced that such activities will endanger public peace
and it is also a threat to public tranquility in the region under the control of my
subdivision and surrounding areas. Therefore, removal/disfigurement of such
banners, cut outs, hoardings and wall paintings from the public places has become
indispensable in the view of maintaining peace and tranquility in the locality.
Therefore, immediate action is required for curtailing such illegal activities;
Whereas, in my opinion that there is sufficient ground for proceedings
under section 144 of the Code of Criminal Procedure, 1973 and immediate prevention
is desirable;
Now, therefore, I, P. Parthiban, I.A.S., Subdivisional Magistrate (South),
Villianur, in exercise of the powers conferred under 144 of Cr.P.C. do hereby prohibit
the erecting of political and caste based cut outs, banners, hoardings and wall
paintings in the region under the control of my jurisdiction for a period of two
months from the date of this order or till any further orders are passed by the
Competent Authority revoking this prohibition as per law, whichever is earlier.
This order shall valid for 2 months from the date of publication in the
official gazette.
At Villianur, dated 16th day of July 2014.
P. PARTHIBAN, I.A.S.,
Subdivisional Magistrate (South).
