NOTIFICATION
In exercise of the powers conferred by section 21 of the
Puducherry Excise Act, 1970 (No. 12 of 1970), the Lieutenant-Governor,
Puducherry hereby makes the following to further amend the Revenue
Department's notification issued under S.O. No. 24, dated 5th July 1974
(hereinafter referred to as the said notification) and published in the
Extraordinary Gazette No. 83, dated 5th July 1974 as amended from time
to time, namely:—

AMENDMENT
(i) In the Schedule appended to the said notification, for the
entries under column (3) against serial number 1, the following words
and figures shall be substituted :—
"(a) Cheap brands whose declared price per case
. .
` 68.00
is up to ` 399.
(b) Ordinary brands whose declared price per case . .
` 78.00
is between ` 400 to ` 599.
(c) Medium and premium brands whose declared . .
` 85.00";
price per case is ` 600 and above.
(ii) In the Schedule appended to the said notification, in the
entries under column (2) and (3) against serial number 3, the following
shall be substituted:—

NOTIFICATION
The draft of the following rules further to amend the Puducherry
Excise Rules, 1970, which the Lieutenant-Governor, Puducherry, proposes
to make in exercise of the powers conferred by section 70 of the
Puducherry Excise Act, 1970 (No. 12 of 1970), is hereby published as
required under sub-section (1) of the said section for information of all
persons likely to be affected thereby and notice is hereby given that
the said draft rules will be taken into consideration on the expiry of
seven days from the date of publication of this notification in the official
gazette.
Any objection or suggestion which may be received from any
person by the Government of Puducherry in respect of the said draft
rules within the period specified above will be considered by the
Government. The objections or suggestions should be addressed to the
Secretary to Government (Excise), Chief Secretariat, Goubert Avenue,
Puducherry.
DRAFT RULES
1. Short title and commencement.— (1) These rules may be called
the Puducherry Excise (Amendment) Rules, 2015.
(2) They shall come into force on and from the date of their
publication in the official gazette.
2. Amendment of rule 28.—In rule 28 of the Puducherry Excise
Rules, 1970, the following shall be substituted:—
"28. Licence fee.—The fee for the grant of licence or for renewal
of a licence shall be as follows.
(i) Distilleries having production up to 20 lakhs . .
` 20 lakhs
proof litre per year.

(ii) For every additional production of one lakh . .
` 1 lakh
proof litre or part thereof in excess of 20 lakhs
per year
proof litre in a year.

Explanation.—In the case of renewal of licence, for the purposes
of calculating the production of the Distillery under this rule, the
actual production carried out during the period from January to
December of the immediately preceding year shall be taken up."
3. Amendement of rule 118.— In rule 118 of the Puducherry Excise
Rules, 1970,—
(i) in the entries against item (a), for the letters, words and
figures, "F.L.1 Licence - ` 9 lakhs per year", the letters, words and figures
"F.L.1 Licence - ` 15 lakhs per year" shall be substituted;
(ii) in the entries against item (b), for the letters, words, brackets
and figures "Additional licence fee for retail counter run by the FL.1
licensee (without permission to serve liquor for consumption in the
premises) - ` 4.5 lakhs per year", the letters, words, brackets and figures
"Additional licence fee for retail counter run by the FL.1 licensee
(without permission to serve liquor for consumption in the premises) -
` 7 lakhs per year" shall be substituted;
(iii) in the entries against item (d), for the letters, words,
brackets and figures "FL.2 licence (with permission to serve liquor for
consumption within the licensed premises) excepting tourism category
hotels/ restaurants - ` 6 lakhs per year", the letters, words, brackets and
figures "FL.2 licence (with permission to serve liquor for consumption
within the licensed premises) excepting tourism category hotels/
restaurants - ` 10 lakhs per year" shall be substituted;
(iv) in the entries against item (e), for the letters, words,
brackets and figures "FL.2 licence (without permission to serve liquor
for consumption within the licensed premises) -` 4.5 lakhs per year",
the letters, words, brackets and figures "FL.2 licence (without permission
to serve liquor for consumption within the licensed premises) - ` 7 lakhs
per year" shall be substituted; and
(v) in the entries against item (f), for the letters, words, brackets
and figures "FL.2 licence for tourism category hotels/restaurants to serve
liquor for consumption only in the restaurant (without permission for
having retail counter and retail sale) - ` 4 lakhs per year", the letters,
words, brackets and figures "FL.2 licence for tourism category hotels/
restaurants to serve liquor for consumption only in the restaurant
(without permission for having retail counter and retail sale) - ` 6 lakhs
per year" shall be substituted;

4. Amendment of rule 249.— In rule 249 of the Puducherry Excise
Rules, 1970, the following shall be substituted:–
"249. Fee for grant or renewal of licence.— The fee for grant
of a licence or for renewal of a licence shall be as follows:–
(i) Breweries having production up to 200 lakhs . .
` 20 lakhs
bulk litre per year.

(ii) For every additional production of one bulk . .
` 0.50
litre in excess of 200 lakhs bulk litre per year.

Explanation.— In the case of renewal of licence, for the
purposes of calculating the production of the Brewery under this rule,
the actual production carried out during the period from January to
December of the immediately preceding year shall be taken up."
