No. A.13016/H1/Health/2006-2016.
Puducherry, the 10th March 2016.
ORDER
Whereas, one month Notice of termination of service
was issued under rule 5 of the Central Civil Services
(Temporary Service) Rules, 1965 to some Medical
Officers who were unauthorisedly absent from
service vide Notice of termination of service issued
under rule 5 (1) of the CCS (Temporary Service) Rules, 1965,
dated 17-7-2012.

LA GAZETTE DE L’ETAT
2. And whereas, Dr. M. Sivaraj is one amongst them
and he was issued Notice of termination of service by
treating that he was on unauthorised absence from
service w.e.f. 22-6-2011.
3. And whereas, Dr. M. Sivaraj has reported and
brought to the Notice that within one month of the
Notice period under representations of Dr. M. Sivaraj,
General Duty Medical Officer, dated 8-8-2012/13-8-2012
that he was undergoing higher studies viz., Postgraduate
Diploma course in TB and Chest Diseases at Madras
Medical College, Chennai for which he had already
submitted application for E.O.L for the period of 2 years
from 22-6-2011 along with the necessary Bond under
rule 32 (2) (e) of the CCS (Leave) Rules, 1972 for which
he was entitled as he was having more than 3 years of
service as on 22-6-2011 i.e. at the time of admission to
the higher studies. He has stated that in anticipation
of sanction of E.O.L. for study purpose, he left for his
Diploma course and he is very much willing to continue
in service and assured that he would rejoin duty the
next day of completion of his course. He has requested
to withdraw the Termination Order and to grant of E.O.L.
already applied for 2 years for study purpose.
4. And whereas, a thorough study was made with
reference to the connected records, which revealed
that:-
Dr. M. Sivaraj was appointed as General Duty Medical
Officer and posted in the Indira Gandhi Government
General Hospital and Postgraduate Institute,
Puducherry with effect from 7-4-2008. Subsequently,
he was transferred to CHC, Karikalampakkam during
the year 2010.
On selection for pursuing postgraduate diploma
course in TB and Chest Diseases (DTCD) (2 years
course) at Institute of Thoracic Medicine, Chetpet
through AIPGMEE -January 2011 session, he had
submitted an application for E.O.L. for study purpose
for a period of 2 years under rule 32 (2) (e) of the
CCS (Leave) Rules, 1972, for which he is eligible,
since he had completed required number of years of
service i.e. more than 3 years.
His letter, dated 21-6-2011 along with the leave
application and necessary Bond in Form-6 requesting
for sanction of E.O.L. had been forwarded by the
Medical Officer, In-charge, CHC, Karikalampakkam on
21-6-2011 to the Directorate. Whereas, the
Directorate has refused the leave applied for, since
the Medical Officer has not submitted his application
through proper channel nor obtained prior permission
while applying for postgraduate course and hence,
the leave application was returned to the Medical
Officer with the direction to report for duty
forthwith, failing which action would be taken against
him.
The Medical Officer In-charge CHC, Karikalampakkam
had forwarded the same to the residential address of
Dr. M.Sivaraj for his information since he was not
available in the Centre and he was already
undergoing study at Chennai.
In this position, as there was no response from
the Medical Officer who was staying at Chennai for
study purpose, it was treated as unauthorised
absence from service and action was taken against
him under Temporary Service Rules and accordingly
Termination Notice was issued.
5. And whereas, the above has made it clear that
rejecting his leave application to prosecute higher
studies only on the ground of non-obtaining of prior
permission was not in order. Having completed 3 years
and 2 months service, which makes him eligible to avail
E.O.L. to prosecute higher studies, the Medical Officer
in anticipation of the leave sanction proceeded to
undergo higher study at Chennai unaware of the fact
that his leave application was rejected, thereby, the
absence from service was treated as unauthorised
absence which consequently led to the issue of Notice
of termination of his service.
6. And whereas, inclusion of his case in the proposal
as one of the cases of unauthorised absence and action
contemplated against him thereon without knowing/
confirming the above factual position is not correct and
has to be treated as an erroneous one.
7. And whereas, in view of the above, the Notice of
termination from service which was issued inadvertently
in the case of Dr. M. Sivaraj, General Duty Medical
Officer has to be withdrawn with the approval of
Competent Authority. Subject to that, the Medical
Officer was permitted to rejoin duty into service after
completion of his higher studies with effect from
12-8-2013 in exigency of public interest.
8. Now, therefore, the Lieutenant-Governor is
pleased to order that the Notice of termination issued
in respect of Dr. M. Sivaraj, General Duty Medical Officer
under Notice of termination of service issued under
rules 5(1) of the (CCS Temporary Sevice) Rules 1965,
dated 17-7-2012 is deemed to have been withdrawn.
(By order of the Lieutenant-Governor)
V. JEEVA,
Under Secretary to Government (Health).
