the petitioner has been in service as a Casual Labour

from 1980 to 1983 and the textile mill was closed in

the year 1983 and subsequently, it was reopened in the

year 1986 and that there was break in service for three

years and furthermore, even after, the reopening of the

textile mill by the new management, he had been

appointed as Casual substitute and only in the year 1989,

he has been appointed as a Regular substitute and that

therefore, even prior to the closure of the textile and

after reopening of the textile mill, he had been in

service as a Casual substitute. As admitted by him in

the evidence, no Casual Labour would be given

regularization and that therefore, they sought for the

regularization after 24 years and furthermore, the

industrial dispute raised by the petitioner after 24

years is not maintainable and furthermore, being

worked as a Casual substitute, he has not entitled for

any order of regularization in the said period and

admittedly, he was posted as a Casual substitute only

in the year 1989, he cannot be granted regularization

for the period 1980 to 1989 since that there was a

break in service for three years and as a casual labour,

he has not entitled for any order of regularization as

prayed and that therefore, the petition is liable to be

dismissed.

13. In the result, the petition is dismissed. No cost.

NOTIFICATION

Whereas, the Government of India had constituted

a Committee under the Chairmanship of Secretary,

Ministry of Social Justice and Empowerment to make

in depth analysis of the reasons for non-filling of

reserved vacancies/less employability of SCs, STs,

OBCs and PwDs in Government sector and suggest

remedial measures.

And whereas, the aforesaid Committee, after holding

various meetings submitted its report. Various time

bound measures have been identified from the

recommendations of the Report of the Committee

during a meeting held on 22nd December 2014 by the

Department of Personnel and Training and communicated

to the State/Union Territory Government vide

O.M. No. 36038/01/2013-Estt(Res.), dated 26-11-2014

of the Ministry of Personnel, Public Grievances and

Pensions, Department of Personnel and Training,

Government of India, New Delhi. Deliverables of the

DoPT includes constitution of Expert Committee,

preparation of data sheet for backlog vacancies, study

of reasons for non-filling up of backlog vacancies,

review of educational qualifications and time-limits

thereof were discussed and it was observed that

deliverables need to be achieved in a specific time

bound manner aiming at the reduction of backlog

reserved vacancies in comprehensive manner.

Now, therefore, the Government of Puducherry is

pleased to constitute the following Committee for the

abovesaid purpose:-

TENDER-CUM-AUCTION NOTICE

Sealed tenders are invited for the sale of

condemned and unserviceable articles belonging to

Government

General

Hospital,

Yanam

by

the

undersigned.

2. Tenders should be sent in sealed cover

superscribing as “Tender for the purchase of condemned

and unserviceable articles” addressed to the Deputy

Director, Government General Hospital, Yanam-533 464,

on or before 29-8-2017 at 3.00 p.m. and it will be

opened on the same day at 3.30 p.m. in the presence

of tenderers who are present. In case, the prescribed

date happens to be a holiday, the tenders will be opened

on the immediate next working day.

3. The intending tenderers should enclose Bankers

Cheque in favour of The Deputy Director, Government

General Hospital, Yanam for an amount of ` 2,000

(Rupees two thousand only) along with their tenders.

The earnest money deposit of the unsuccessful tenderers

will be refunded after the tender is over. The tender

without earnest money will summarily be rejected.

4. The tender received after the due date and time

will not be entertained.

5. The rate should be quoted for the entire items

and who quotes highest rate will be considered as

successful tenderer. If, the highest rate quoted by the

tenderer is not satisfied by the undersigned, the open

auction will be conducted on the same day. In the open

auction, the tenderers who have submitted sealed

tenderers already will only be allowed.

6. The successful tenderer should pay the entire

amount soon after completion of tender/auction

including Sales tax and other taxes as applicable under

the rules in force and shift the unserviceable articles

immediately on the same day from the premises of the

Government General Hospital, Yanam, at their own cost

and risk, failing which the Deputy Director,

Government General Hospital, Yanam shall not be

responsible for safe custody or loss or damage of

articles once the tender/auction is finalized.

7. No claim about the quantity and quality of the

condemned article will be admitted once the tender/

auction is finalized.

8. The intending

tenderers can

inspect the

condemned articles during hospital working hours with

prior permission of the concerned Head/Medical

Officer in-charge of the Government General

Hospital, Yanam from 21-8-2017 to 28-8-2017 on all

working days and in office timings.

9. The undersigned reserves the right to accept or

reject any tender in part or whole without assigning

any reason thereof. Auction is subject to discretion of

the undersigned whose decision will be final in case of

any dispute.
