AMENDMENT
In order to promote industrial development/activities and to ease
carrying on business in the Union territory of Puducherry, and to remove
the hardship in procurement of High Speed Diesel Oil, it is proposed to
amend the ‘Puducherry Motor Spirit and High Speed Diesel Oil
(Maintenance and Regulation of Supplies) Order, 1985’, so as to enhance,
the purchase and the storage capacity of High Speed Diesel Oil from
the existing 5 litres to 2500 litres, for use of operating power generators
and for other internal combustion engines installed in the premises by
the Government and private sector industrial establishments.

Accordingly, in partial modification of the ‘Puducherry Motor Spirit
and High Speed Diesel Oil (Maintenance and Regulation of Supplies)
Order, 1985’ (hereinafter referred to as the said order) notified vide G.O. Ms.
No. 16, dated 24-12-1985 of the Civil Supplies Department, Government
of Puducherry and published in the Extraordinary Gazette No. 18, dated
6th March, 1986, save as respects things done or omitted to be done
before such modification, the Lieutenant-Governor, Puducherry hereby
makes the following Order, further to amend the said order, namely:-
1. Short title, extent and commencement.— (1) This order may be
called the ‘Puducherry Motor Spirit and High Speed Diesel Oil
(Maintenance and Regulation of Supplies) (Amendment) Order, 2017’.
(2) It extends to the whole of the Union territory of Puducherry.
(3) It shall come into force on and from the date of its
publication in the Official Gazette.
2. Amendment of Clause-6.— In the said Order, under clause 6,
after the existing proviso, the following second proviso shall be inserted,
namely:-
“Provided further that, this restriction shall also not apply, if,
the High Speed Diesel Oil in possession of a person at any one
place, does not exceed two thousand and five hundred litres of
High Speed Diesel Oil (Non-bulk) and none of it is contained in
a receptacle/container/tanker of water capacity not exceeding
1000 litres and is exclusively procured for use of operating Power
Generators or for operating internal combustion engines installed
within the premises of the industrial units or for the use in such
other legitimate purposes in industries”.
3. Amendment of Clause-7.— For the title and the existing entries
against clause 7 of the said Order, the following shall be substituted,
namely:-
“7. Motor Spirit and High Speed Diesel Oil to be delivered only
into a motor vehicle or for use in industry or against a permit.-
(1) It shall not be lawful for any dealer or sub-dealer or consumer
stations to supply or for any person to receive Motor Spirit and
High Speed Diesel Oil except into a tank fixed permanently to a
motor vehicle for use for its propulsion, or into a receptacle/
container/tanker of water capacity not exceeding 1000 litres for use
in industries as furnished in the written requisition to be made by
the industry in this behalf, unless the person receiving the Motor
Spirit and High Speed Diesel Oil has a permit issued in Form-III to
receive the same, issued by the Licensing Authority or by any
Officer authorised by him.

Provided that in an emergency to help a standard motor vehicle,
a supply not exceeding five litres may be made into a can on taking
a written requisition from the party. All such supplies, including
supplies made to Industries as per sub-clause (1) above, shall be
entered into a separate register with date, the name and address
of the party concerned, and details and number of the vehicle, in
the case of Motor Vehicles and, the name of the firm and the
address of the Registered Owner/Authorised Representative and the
nature of business, in the case of industries, as the case may be.
(2) In respect of supplies made into a receptacle/container/
tanker of water capacity not exceeding 1000 litres for use in
industries, as the case may be, the quantity to be supplied at any
time shall be subject to such restrictions as may be notified from
time to time by the Licensing Authority.”
4. Amendment of Clause-8.— For the title and the existing entry
against clause 8 of the said Order, the following shall be substituted,
namely:-
“8. Permit system for supply of Motor Spirit and High Speed
Diesel Oil to motor vehicles and to industrial units, to be introduced
if necessary.- In times of shortage or apprehended shortage,
notwithstanding provisions contained in clause 7, it shall be lawful
for the Licensing Authority with the concurrence of the Government,
to notify that supply of Motor Spirit and High Speed Diesel Oil even
into tank permanently attached to a motor vehicle or into a receptacle/
container/tanker of water capacity not exceeding 1000 litres for use
in industries, as the case may be, shall require a permit and clause 7
shall thereafter apply to supply made to the tank permanently
attached to a motor vehicle or to the supply made for use in
industries also.”.
