NOTIFICATION

Whereas, the Managements of (i) M/s. Rathnaa

Talkees, Anna Salai, Puducherry (ii) M/s. Ashok Theatre,

Villianur, Puducherry (iii) M/s. Raja Talkies, No. 246,

Anna Salai, Puducherry-605 001 (iv) M/s. Murugaa

Theatre, Thattanchavadi, Puducherry-605 009 and

(v) Balaji Theatre, No. 118, Kamaraj Salai, Puducherry

have applied for grant of exemption from certain

provisions of the Pondicherry Shops and Establishments

Act, 1964 to conduct special morning shows at 8.00 a.m.,

9.00 a.m., 9.00 a.m., 8.00 a.m. and 8.30 a.m.

respectively, from 18-10-2017 to 22-10-2017 on

account of screening a new Tamil film “Mersal”;

Now, therefore, in exercise of the powers conferred

by section 6 of the said Act, vide G.O. Ms. No. 9/95/

Lab., dated 7-4-1995, the Secretary to Government,

Labour Department, Puducherry hereby exempts

(i) M/s. Rathnaa Talkees, Anna Salai, Puducherry

(ii) M/s. Ashok Theatre, Villianur, Puducherry

(iii) M/s. Raja Talkies, No. 246, Anna Salai,

Puducherry-605 001 (iv) M/s. Murugaa Theatre,

Thattanchavadi, Puducherry-605 009 and (v) Balaji

Theatre, No. 118, Kamaraj Salai, Puducherry from the

provisions of the section 16(1), 17(1), 17(2) and 18

of the Pondicherry Shops and Establishments Act, 1964

for

conducting

special

morning

shows

from

18-10-2017 to 22-10-2017 on account of screening a

new Tamil film “Mersal” subject to the following

conditions;

(i) Every person employed shall be paid

overtime wages for the period of work done by him

in excess of 8 hours in a week.

(ii) The total hours of work of each worker

including overtime shall not exceed 10 hours including

one hour rest on any day or 54 hours in a week.

(iii) The management should obtain permission

from the authorities concerned wherever necessary.

(iv) In case, the said screening of the new film

does not take place, this notification shall have no

effect.

NOTIFICATION

Whereas, the Government is of the opinion that an

industrial dispute has arisen between the management

of M/s. Murudeshwar Ceramics Limited, Karaikal and

Thiru P. Sandhirakasu, Karaikal, over reinstatement

with back wages in respect of the matter mentioned in

the Annexure to this order;

And whereas, in the opinion of the Government,

it is necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated

vide G.O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of

the Labour Department, Puducherry to exercise the

powers conferred by clause (c) of sub-section (1) of

section 10 of the Industrial Disputes Act, 1947

(Central Act XIV of 1947), it is hereby directed by the

Secretary to Government (Labour) that the said dispute

be referred to the Labour Court, Puducherry for

adjudication. The Labour Court, Puducherry shall

submit the Award within 3 months from the date of

issue of reference as stipulated under sub-section 2-A

of section 10 of the Industrial Disputes Act, 1947 and

in accordance with rule 10-B of the Industrial Disputes

(Central) Rules, 1957. The party raising the dispute

shall file a statement of claim complete with relevant

documents, list of reliance and witnesses to the Labour

Court, Puducherry within 15 days of the receipt of the

order of reference and also forward a copy of such

statement to each one of the opposite parties involved

in the dispute.

NOTIFICATION

In exercise of the power conferred under section 27

of the Minimum Wages Act, 1948 (Central Act 11 of

1948), the Lieutenant-Governor of Puducherry hereby

proposes to add the Information Technology (IT) & IT

Enabled Service Industries in the Union territory of

Puducherry under Part-I of the Schedule to the said

Act, for the purpose of fixation of minimum rates of

wages, for the workers employed in the said

employment under section 3 of the Minimum Wages

Act, 1948.

Any objection, which may be received from any

person with respect to the said proposal, before the

expiry of three months, from the date to publication

of this notification in the Official Gazette, shall be

considered by the Government of Puducherry.

All such objections should invariably be addressed

to the Secretary to Government, Labour Department,

Puducherry.
