NOTIFICATION
Whereas, the Government is of the opinion that
the dispute has been raised by Thiru M.L. Muthukrishnan,
against the management of M/s. Daily Thanthi, Puducherry
over Dearness Allowance in terms of the Majithia
Wage Board Award, in respect of the matter mentioned
in the Annexure to this order;
And whereas, in the opinion of the Government,
it is necessary to refer the said dispute for adjudication;
Now, therefore, by virtue of the authority delegated
vide G.O. Ms. No. 20/91/Lab., dated 23-5-1991 of
the Labour Department, Puducherry, to exercise the
powers conferred by clause (d) of sub-section (1) of
section 10 of the Industrial Disputes Act, 1947
(Central Act XIV of 1947), it is hereby directed by the
Secretary to Government (Labour) that the said dispute
be referred to the Industrial Tribunal, Puducherry for
adjudication. The Industrial Tribunal, Puducherry, shall
submit the Award within 3 months from the date of
issue of reference as stipulated under sub-section (2-A)
of section 10 of the Industrial Disputes Act, 1947 and
in accordance with rule 10-B of the Industrial Disputes
(Central) Rules, 1957. The party raising the dispute
shall file a statement of claim complete with relevant
documents, list of reliance and witnesses to the
Industrial Tribunal, Puducherry, within 15 days of the
receipt of the order of reference and also forward a
copy of such statement to each one of the opposite
parties involved in the dispute.

in “Security Guards” in the Union territory of
Puducherry with effect from 01-01-2018 on the basis
of rise in the average consumer price index number

thereby resulting in an increase of 13 points calculated
on the basis of average rates of Dearness Allowance

of rise in the average consumer price index number
reaching 299 from 286 (Base year 2001=100) and
thereby resulting in an increase of 13 points calculated
on the basis of average rates of Dearness Allowance
with effect from 01-01-2018.
Accordingly, the Dearness Allowance payable to the
classes of employees employed in the employment of
Paper and Paper Products both Machine made and
Handmade Industries in the Union territory of
Puducherry with effect from 01-01-2018 would
be ` 185.25 per month in respect of Machine made
Industries and ` 177.45 per month in respect of
Handmade Industries.

(up to September 2015). Dearness Allowance was
fixed during 2017 based on the rise in the average
indices of Puducherry City Consumer Price Index for
the years 2015 and 2016 i.e., 12 points up to
31-12-2016. Now, the rise in the average indices of
Puducherry City Consumer Price Index for the year
2017 is 13 points. Accordingly, the Dearness
Allowance payable to the employee’s with effect from
01.01.2018 would be ` 188.00 per month (previous
` 90 + current ` 98).

under rule 12 (2) of CCS (Leave) Rules,
1972-issued.
Ref. : This Office Memorandum of even No.
dated 26-6-2018, published in Dinamalar
and Dinamani newspapers on 27-6-2018.
Tmt. Thilagavathy Pierre, who was working as
Primary School Teacher in Government Primary
School, Mdagadipet, Puducherry, is unauthorisedly
absent from duty since 18-1-2007. She has not
responded to the communication sent by the Deputy
Inspector of Schools, Zone-V, Villianur, Puducherry
several times to her last known address. A press
notification was also issued vide reference cited
asking her to resume duty immediately on 27-06-2018
in Dinamalar Daily and Dinamani Daily. But, she has
not reported for duty till date.
2. As per rule 12 (2) of the CCS (Leave) Rules, 1972,
a Government Servant who remains absent from duty
for a continuous period exceeding five years other than
on foreign service, with or without leave, shall be
deemed to have resigned from the Government Service
provided that a reasonable opportunity to explain the
reasons for such absence shall be given to that Government
servant before provisions of sub-rule (2) are invoked
3. Accordingly, Tmt. Thilagavathy Pierre, who was
working as Primary School Teacher in Government
Primary School, Madagadipet, Puducherry, is hereby
given another opportunity to explain as to why the
abovesaid rule 12 (2) of the CCS (Leave) Rules, 1972
shall not be invoked against her as she remains absent
from duty for a continuous period exceeding five years.
4. The required explanation shall reach the
undersigned within 10 days from the date of
publication/issue of this memorandum failing which
she shall be deemed to have resigned from the
Government service with effect from 29-03-2012,
without any further notice.
