9. Though, the petitioner union has raised the

industrial dispute against the respondent management

over the above said issues, it has not come forward to

exhibit any documents to establish their case and in

support of their oral evidence no document is

exhibited before this Court to prove their case. Even

the petitioner union has not established that the

industrial dispute was raised for the affected workers

and the said alleged workers have also not been

examined before this Court as witness to establish the

case of the petitioner union and therefore, nothing is

proved by the petitioner union as alleged in the claim

petition through the documentary evidence while the

oral evidence of the petitioner side witness PW.1 is

not supported by even the oral evidence of the affected

workmen to prove even the prima facie case of the

petitioner union and therefore, it is just and necessary

to decide that the industrial dispute raised by the

petitioner union against the respondent management

over the abovesaid issues is not justified and hence, the

members of the petitioner union are not entitled for

any relief as prayed for and as such the petition is

liable to be dismissed.

10. In the result, this petition is dismissed. No cost.

NOTIFICATION

Under section 25 of Negotiable Instruments Act, 1881

(Central Act XXVI of 1881), read with Notification of the

Government of India, Ministry of Home Affairs S.O. 358(E),

dated 28th June 1973, the Government of Puducherry hereby

declares Wednesday, the 8th August 2018 as a Public Holiday,

as a mark of respect to the late Kalaignar Dr. M. Karunanidhi,

former Chief Minister of Tamil Nadu.

2. The above notified Public Holiday shall also apply

to all Government Undertakings/Corporations/Boards, etc.

Terms and conditions

1. The sealed tenders should be addressed to the

Principal, Tagore Government Arts and Science

College, Puducherry, duly superscribing on the

envelope as “Tender for purchase of old books,

newspapers and magazine articles” and should reach

this office on or before 27-08-2018 at 10.00 a.m. The

tenders will be opened at 11.30 a.m. on the same day

in the presence of the tenderers present if any, in the

Chamber of the undersigned at Tagore Government

Arts and Science College, Puducherry-605 008.

2. The tender will be awarded to the highest

tenderer on the spot.

3. If, the highest tender amount offered by the

tenderer is found to be not acceptable by the

undersigned, then the public auction will be conducted

on the spot keeping the highest tender amount as

minimum upset price for bid.

4. The intending tenderers should deposit an

earnest money of ` 500 (Rupees five hundred only)

along with sealed tenders. The earnest money deposit

of the unsuccessful tenderers will be refunded on the

same day soon after completion of tender/auction sale.

5. The successful tenderer/bidder should pay the

entire amount soon after the completion of the tender/

auction sale and should clear the tender/auction sold

materials at his own arrangement/cost before 5.00

p.m. on the same day, failing which the office will not

be held responsible either for the safe custody or for

loss or damage of articles once the tender/auction sale

is over.

6. GST/Sales tax will be charged extra as per the

rate applicable at the time of tender/auction sale.

7. No claim on the quantity or quality of the

articles will be admitted once the tender/auction sale

is over.

8. The intending

tenderers can

inspect the

unserviceable articles during office hours from 10.00 a.m.

to 12.00 noon on any working day, but, on or before

the tender/auction sale date, at this Institution with the

permission of the undersigned.

9. The tenders offered after the due date and time

will be rejected.

10. The undersigned reserves the right to accept or

reject any or all the tenders without assigning any

reason thereof and the decision of the undersigned in

this regard will be final and binding on all the

tenders. If, the tender/auction date falls on a holiday,

the tender/auction sale will be held on the next working day.

11. Along with the tender, a copy of all the

following self attested documents should be submitted.

(a) Aadhaar Card;

(b) Valid PAN Card;
