18. As this Court has decided that the industrial

dispute raised by the first and second petitioners

against the respondent management over their

non-employment is justified, it is to be decided whether

the first and second petitioners are entitled for back

wages as claimed by them. There is no evidence that

the first and second petitioners are working so far in

any other industry and that there is no proof exhibited

before this Court that they are working anywhere else.

The respondent has not proved the fact that the first

and second petitioners have been working in any other

establishment after their termination. However, the first

and second petitioners could have served at any other

industry after their termination. Considering the above

facts and circumstances, this Court decides that the first

and second petitioners are entitled only for 30% back

wages with continuity of service and other attendant

benefits.

19. In the result, the petition is partly allowed and

the industrial dispute raised by the first and second

petitioners against the respondent management over

their non employment is justified and Award is passed

directing the respondent management to reinstate the

first and second petitioners in service within one month

from the date of this Award and further directed the

respondent management to pay 30% back wages to the

first and second petitioners from the date of

termination till the date of reinstatement with

continuity of service and other attendant benefits and

in respect of the petitioners 3 to 8 the claim petition

is dismissed and the industrial dispute raised by the

petitioners 3 to 8 against the respondent management

over their non-employment is not justified. No cost.

Puducherry, the 27th August 2018.

ORDER

Whereas, Tmt. Thilagavathy Pierre, who was working

as Primary School Teacher in Government Primary

School, Madagadipet, Puducherry, is unauthorizedly

absent from duty since 18-01-2007. She has not

responded to the communication sent by the Deputy

Inspector of School, Zone-V, Villianur, Puducherry,

several times to her last known address.

2. And whereas, as per rule 12(2) of the Central

Civil Services (Leave) Rules, 1972, a Government

Servant who remains absent from duty for a continuous

period exceeding five years other than on foreign

service, with or without leave, shall be deemed to have

resigned from the Government service provided that a

reasonable opportunity to explain the reasons for such

absence shall be given to that Government Servant

before provisions of sub-rule (2) are invoked.

3. And whereas, a press notification was issued

vide this Office Memorandum of even number, dated

26-06-2018 asking her to resume duty immediately in

Dinamalar Daily and Dinamani Daily on 27-06-2018

and in the Gazette of Puducherry on 10-07-2018 and

31-07-2018. But, she has not reported for duty till date.

4. Now, therefore, the Lieutenant-Governor invoking

rule 12(2) of Central Civil Services (Leave) Rules, 1972,

is pleased to order that Tmt. Thilagavathy Pierre, who

was working as Primary School Teacher in Government

Primary School, Madagadipet, Puducherry, is deemed

to have resigned from the Government service with

effect from 29-03-2012.

ORDER

As a mark of respect to the late Thiru A. Kasilingam,

former Social Welfare Minister, Government of

Puducherry, State Mourning shall be observed for one

day on Friday, the 31st August, 2018. The National Flag

will be flown at half-mast for one day on 31st August, 2018

throughout the Union territory of Puducherry on all

buildings where it is flown regularly. It has been

decided that as a mark of respect to the departed

leader, there shall be no official entertainment during

the period of State Mourning.

Honour and State Funeral to the departed leader.
