GOVERNMENT OF PUDUCHERRY

LABOUR DEPARTMENT

(G.O. Rt. No. 158/AIL/Lab./T/2018,

Puducherry, dated 11th December 2018)

NOTIFICATION

Whereas, the Government is of the opinion that an

industrial dispute has arisen between the management

of M/s. Pondicherry Road Transport Corporation,

Puducherry and the union workmen represented by

Anna Thozhir Sanga Peravai, Puducherry, over revision

of Grade Pay under MACP from ` 2,800 to ` 4,200 to

the Conductors as listed in Annexure-I on par with the

Drivers in respect of the matter mentioned in the

Annexure to this order;

And whereas, in the opinion of the Government, it

is necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated

vide G.O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of

the Labour Department, Puducherry, to exercise the

powers conferred by clause (c) of sub-section (1) of

section 10 of the Industrial Disputes Act, 1947 (Central

Act XIV of 1947), it is hereby directed by the Secretary

to Government (Labour) that the said dispute be referred

to the Labour Court, Puducherry, for adjudication. The

Labour Court, Puducherry, shall submit the Award

within 3 months from the date of issue of reference as

stipulated under sub-section (2-A) of section 10 of the

Industrial Disputes Act, 1947 and in accordance with

rule 10-B of the Industrial Disputes (Central) Rules,

1957. The party raising the dispute shall file a statement

of claim complete with relevant documents, list of

reliance and witnesses to the Labour Court, Puducherry,

within 15 days of the receipt of the order of reference

and also forward a copy of such statement to each one

of the opposite parties involved in the dispute.

ANNEXURE

(a) Whether the dispute raised by the union

workmen represented by Anna Thozhir Sanga

Peravai, Puducherry, against the management of

M/s. Pondicherry Road Transport Corporation,

Puducherry, over revision of Grade Pay under MACP

the Lieutenant-Governor, Puducherry, is pleased to

appoint Thiru S. Mouttouvel, Advocate, Puducherry,

as the Special Public Prosecutor for Puducherry District

to hold full additional charge and to conduct cases

under the provisions of the Rights of Persons with

Disabilities Act, 2016, with immediate effect until

further orders.

2. The fees payable to the Special Public Prosecutor

for Puducherry, shall be as set out in the G.O. Ms.

No. 14, dated 18-02-1969 of the Home Department,

Puduchery, as amended from time to time.

NOTIFICATION

In the exercise of the powers conferred by

the Lieutenant-Governor, Puducherry, is pleased to

appoint Thiru S. Krishnavelu, Advocate, Karaikal,

as the Special Public Prosecutor for Karaikal District

to hold full additional charge and to conduct cases

under the provisions of the Rights of Persons with

Disabilities Act, 2016, with immediate effect until

further orders.

2. The fees payable to the Special Public Prosecutor

for Karaikal under the abovesaid Act, shall be as set

out in the G.O. Ms. No. 38, dated 22-05-1981 of the

Home Department, Puducherry, as amended from time

to time.

HEALTH SECRETARIAT

NOTIFICATION

In pursuance of the Notification No. GSR-767(E),

dated 11-08-2018 of the Department of Personnel and

Training, New Delhi and O.M. No. A.12034/4/2018-

CHS.V, dated 13-08-2018 of the Ministry of Health and

Family Welfare, New Delhi, the followings are substituted

in para-3 of G.O. Ms. No. 51, dated 14-10-2016 of the

Health Secretariat, Puducherry, as a partial modification.

“3. The age of superannuation in respect of the

Specialist Doctors and Medical Officers belonging to

Pondicherry Health Service shall normally be sixty-two

years. In case, they desire to continue in their service

up to the age of sixty-five years, they will have to

exercise the option of posting to Teaching, Clinical,

Patient Care, Implementation of Health Programmes,

Public Health Programmes and function including

Advisory and Consultancy, depending on their expertise

and experience. They will be considered for posting to

posts other than administrative posts at the desired field

as per their options indicated subject to availability of

vacancy and administrative convenience and as desired

by the Competent Authority. They shall not stake any

claim for posting to any additional administrative posts

notified in future. Their continuation in service is

subject to the rules and instructions of Government of

Puducherry issued from time to time.

4. The Specialist Doctors and Medical Officers, who

have already attained the age of 62 years or attaining

the age of 62 years within 6 months from the date of

this Government Order and desire to continue in the

service up to the age of 65 years are, therefore, required

to submit their option of posting in the Annexure

enclosed to the Director of Health and Family Welfare

Service, Puducherry, through their Heads of Offices

within a period of 30 days from the date of this

Government Order.

5. The serving Specialist Doctors and Medical

Officers, who fail to exercise the option with regard to

their continuation in service up to the age of 65 years,

stand

superannuated from their service on attaining the age

of 62 years or on expiry of 30 days, as the case may

be, from the date of this Government Order.”
