NOTIFICATION

Whereas, the Government is of the opinion that an

industrial dispute has arisen between the management

of M/s. Aravind Eye Hospitals, Puducherry and the

union

workmen represented by Aravind Kann

Maruthuvamanai Thozhilalar Sangam, Puducherry, over

unfair labour practice and refusal of employment of

30 employees as listed in Annexure-I, in respect of the

matter mentioned in the Annexure to this order;

And whereas, in the opinion of the Government, it is

necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated

vide G.O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of the

Labour Department, Puducherry, to exercise the powers

conferred by clause (c) of sub-section (1) of section

10 of the Industrial Disputes Act, 1947 (Central Act XIV

of 1947), it is hereby directed by the Secretary to

Government (Labour) that the said dispute be referred

to the Labour Court, Puducherry for adjudication. The

Labour Court, Puducherry, shall submit the Award

within 3 months from the date of issue of reference as

stipulated under sub-section (2-A) of section 10 of the

Industrial Disputes Act, 1947 and in accordance with

rule 10-B of the Industrial Disputes (Central) Rules,

1957. The party raising the dispute shall file a statement

of claim complete with relevant documents, list of

reliance and witnesses to the Labour Court, Puducherry,

within 15 days of the receipt of the order of reference

and also forward a copy of such statement to each one

of the opposite parties involved in the dispute.

GOVERNMENT OF PUDUCHERRY

SOCIAL WELFARE SECRETARIAT

(G.O. Ms. No. 18/SWS/2018-19,

Puducherry, dated 8th March 2019)

NOTIFICATION

The Legislative Department, Ministry of Law and

Justice, Government of India, has enacted a new law viz.,

“The Rights of Persons with Disabilities Act, 2016”

(No. 49 of 2016). The Department of Empowerment of

Persons with Disabilities, Ministry of Social Justice and

Empowerment, Government of India, has appointed

19-04-2017 as the date on which the said Act shall come

into force vide Notification S.O.No. l215(E), dated

19-04-2017;

Whereas, the Ministry of Home Affairs, Government

of India, has delegated the powers of the State

Government under the Act to the Administrators of all

the Union Territories vide Notification S.O.No. 3870(E),

dated 12-12-2017;

And whereas, the said Act casts responsibilities

upon the States/Union Territory Governments on the

implementation of the various provisions of the said

Act. Further, section 34 of the Act mandates provision

of 4% reservation in employment in every Government

establishment for persons with benchmark disabilities;

And whereas, in compliance of the interim Order,

dated 24-03-2015 and 28-04-2015 of the Hon’ble Supreme

Court in contempt petition No. 499/2014 in Civil Appeal

No. 9096/2013 in the matter of National Federation of

Blind, the Government of India has constituted an

Inter-Ministerial Committee to monitor the progress in

filling up of vacancies of persons with disabilities vide

order No. 36012/39/2014-Estt.(Res), dated 22-05-2015;

And whereas, the Government of Puducherry has

decided to comply with the provisions of the Act by

way of ensuring that the reservation in employment to

the extent of 4% shall be extended to the persons with

benchmark disabilities in all the Government establishments;

Now, therefore, the Lieutenant-Governor, Puducherry,

is hereby pleased to constitute a Committee to expedite

the process of filling up of vacancies of persons with

benchmark disabilities in accordance with section 34 of

the said Act and the composition of the said Committee

shall be as follows:–

TENDER-CUM-AUCTION NOTICE

Sealed tenders are invited by the Medical

Superintendent, E.S.I. Hospital, Gorimedu, Puducherry,

for the lease of usufructs at E.S.I. Hospital Campus,

Gorimedu, Puducherry. The details of usufructs and the

duration of lease period of the lease of usufructs are

given in the Annexure.

1. The rate for above usufructs should be quoted for

all trees in a lot.

2. The tenders in sealed covers superscribing as

“Tender for lease of usufructs” should be addressed to

the Medical Superintendent, E.S.I. Hospital, Gorimedu,

Puducherry and sent to this office on or before

28-03-2019 (Thursday) at 10.45 a.m. The tenders will be

opened on the same day at 11.00 a.m in the presence of

the tenderers present at that time. If, the day for

opening of the tenders happens to be a public holiday

for any reason, the tenders will be received and opened

by the same time on the next working day.

3. Based on the highest quoting on the sealed

tender, open auction will be conducted at 11.15 a.m. on

28-03-2019 of Thursday.

4. The indenting renderers should deposit an amount

of ` 2,000 (Rupees two thousand only) in cash as

earnest money deposit with this office while submitting

the tenders.

5. The earnest money deposit of the unsuccessful

tenderers will be refunded immediately after the auction/

tenders are finalized.

6. Tenders received after the due date and time will

be rejected.

7. The undersigned reserves the right to accept or

reject any tender without assigning any reason thereof.

8. The successful tenderer should pay the full

amount of bid immediately and usufructs will be

maintained at his own risk and expenses.

9. Sales tax at the rate applicable will be collected

extra.

10. The usufructs trees can be inspected during

office hours on any working day of this office.

11. No claim about the quantity/quality of the items

will be entertained after opening the tenders.

12. In case of any dispute, the decision of the

undersigned will be the final.
