It is hereby publicly notified for general information that Tmt.Kalaiselvi, wife of Gnanamurthy, residing at

No. F-7, Chanakya Apartments, Sithankudi, Puducherry District, has purchased on 31-07-2019 at public e-auction,

the undermentioned land sold for arrears of revenue due by Thiru Krishnamoorthy (late), son of Kannu Counder

and Tmt. Nagakanni, wife of Krishnamurthy, the land holders in the undermentioned Village and has paid the full

purchase money, viz., ` 9,93,750 (Rupees nine lakhs ninety-three thousand seven-hundred and fifty only) and that

the land has been registered in her name. It is therefore, declared that the said Tmt. Kalaiselvi has succeeded to all

NOTIFICATION

Whereas, the Government is of the opinion that an

industrial dispute has arisen between the management

of M/s. Kerry Indev Logistics Private Limited (CFS),

Karasur Village, Villianur Commune, Puducherry and

their workmen represented by Pudhuvai Udal Uzhaipor

Sangam (AICCTU), Sitthankudi, Puducherry, over

retrenchment of 18 workmen as listed in Annexure-I,

change of service conditions and unfair labour practice

in respect of the matter mentioned in the Annexure to

this order;

And whereas, in the opinion of the Government, it is

necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated

vide G.O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of the

Labour Department, Puducherry, to exercise the powers

conferred by clause (d) of sub-section (1) of section 10

of the Industrial Disputes Act, 1947 (Central Act XIV

of 1947), it is hereby directed by the Secretary to

Government (Labour) that the said dispute be referred

to the Industrial Tribunal, Puducherry for adjudication.

The Industrial Tribunal, Puducherry, shall submit the

Award within 3 months from the date of issue of

reference as stipulated under sub-section (2-A) of

section 10 of the Industrial Disputes Act, 1947 and in

accordance with rule 10-B of the Industrial Disputes

(Central) Rules, 1957. The party raising the dispute shall

file a statement of claim complete with relevant

documents, list of reliance and witnesses to the

Industrial Tribunal, Puducherry, within 15 days of the

receipt of the order of reference and also forward a copy

of such statement to each one of the opposite parties

involved in the dispute.

(a) Whether the dispute raised by the workmen

(AICCTU), Sitthankudi, Puducherry, against the

management of M/s. Kerry Indev Logistics Private

Limited (CFS), Karasur Village, Villianur Commune,

Puducherry, over retrenchment of 18 workmen as

listed in Annexure-I is justified or not? If justified,

what relief the workmen are entitled to?

(b) Whether dispute raised by the workmen

represented by Pudhuvai Udal Uzhaipor Sangam

(AICCTU), Sitthankudi, Puducherry, against the

management of M/s. Kerry Indev Logistics Private

Limited (CFS), Karasur Village, Villianur Commune,

Puducherry, over change of service conditions of

18 employees listed in Annexure-I in contravention

of section 9 (A), read with item 10 of the Fourth

Schedule of the Industrial Disputes Act, 1947, is

justified or not? If justified, what relief the workmen

are entitled to?

Logistics Private Limited (CFS), Karasur Village,

Villianur Commune, Puducherry, has committed unfair

labour practice in contravention of section 25T, read

with item 5 (a), (b), 6, 9 and 14 of Part-I of the Fifth

Schedule of the Industrial Disputes Act, 1947. If so,

to give appropriate directions.

(d) To what other relief the 18 workmen listed in

Annexure-I are entitled to?

(e) To compute the relief if any, awarded in terms

of money if, it can be so computed?

In continuation to the G.O. Ms. No. 1/Ag., dated 01-04-2010 of the Chief Secretariat (Agriculture), Puducherry,

the tentative seniority list of Deputy Directors (Agriculture) who were appointed subsequently was circulated to

all concerned vide this Department’s Memorandum No. 32041/CS(Agri.)/2017 /A1, dated 04-01-2018, calling for

objections if any, and informing them that if, no objections were received their seniority would be fixed as indicated

therein.
