NOTIFICATION
Whereas, the Government is of the opinion that an
industrial dispute has arisen between the management
of M/s. Public Health Division, Public Works Division

Puducherry (Principal Employer) and M/s. Waterlife
India Private Limited, Puducherry (Contractor), and the
union workmen represented by Puducherry Water Life
Workers Welfare Association, Puducherry, over
non-employment of Thiruvalargal S. Balamurugan,
Manikandan, Panja and Felix in respect of the matter
mentioned in the Annexure to this order;
And whereas, in the opinion of the Government, it is
necessary to refer the said dispute for adjudication;
Now, therefore, by virtue of the authority delegated
vide G.O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of the
Labour Department, Puducherry, to exercise the powers
conferred by clause (c) of sub-section (1) of section 10
of the Industrial Disputes Act, 1947 (Central Act XIV
of 1947), it is hereby directed by the Secretary to
Government (Labour) that the said dispute be referred
to the Labour Court, Puducherry, for adjudication.
The Labour Court, Puducherry, shall submit the Award
within 3 months from the date of issue of reference as
stipulated under sub-section (2-A) of section 10 of the
Industrial Disputes Act, 1947 and in accordance with
rule 10-B of the Industrial Disputes (Central) Rules,
1957. The party raising the dispute shall file a statement
of claim complete with relevant documents, list of
reliance and witnesses to the Labour Court, Puducherry,
within 15 days of the receipt of the order of reference
and also forward a copy of such statement to each one
of the opposite parties involved in the dispute.

relationship between the management of M/s. Public
Health Division, Public Works Division, Puducherry
(Principal Employer) or M/s. Water Life India Private
Limited, Puducherry (Contractor), and the union

ORDER
The tentative seniority list of Assistant Commercial Tax Officers, working in the Commercial Taxes
Department, has been circulated vide Memorandum No. 1024/CT/A1/99/1317, dated 17-9-2019 of the Commercial Taxes
Secretariat, Puducherry, to all officials concerned inviting objections, if any, to the seniority assigned therein.
As, objections received from the officials have no merit and valid justification, the request was not agreed to.

Puducherry, the 12th November 2019.
NOTIFICATION
Whereas, the manufacture, storage, distribution or
sale of Gutkha and Panmasala, and any other food
products containing tobacco or nicotine as ingredients
were banned in the whole of the Union territory of
Puducherry for a period of one year vide Notification
No. 1388/CS/Health/H7/2013, dated 18th June, 2013 and
published in the Office Gazette of Puducherry, No.27,
dated 2nd July, 2013, and thereafter, being renewed
periodically, the last notification having been issued on
13th November, 2018, published in the Official Gazette
of Puducherry, No. 48, dated 27th November, 2018.
Whereas, the validity period of the abovesaid
Notification expires on 17-11-2019;
Whereas, it has been brought to notice that, of late,
the banned food products containing tobacco or
nicotine which are injurious to health are sometimes/
occasionally available in the market in contravention of
the provisions of the Food Safety and Standards Act,
2006 (Central Act 34 of 2006) and the rules made
thereunder;
Whereas, Regulation 2.3.4. of the Food Safety and
Standards (Prohibition and Restrictions on Sales)
Regulations, 2011, prohibits and restricts the sale of
food products which contain tobacco and nicotine as
ingredients as they are injurious to health;
Whereas, in the public interest, it is expedient to
prohibit consumption of Gutkha and Panmasala in the
Union territory of Puducherry being the food products
in which tobacco and nicotine are widely used as
ingredients;
Now, therefore, in exercise of the powers conferred
by clause (a) of sub-section (2) of section 30 of the
Food Safety and Standards Act, 2006 (Central Act 34
of 2006), the Commissioner of Food Safety of the
Union territory of Puducherry, in the interest of public
health, hereby prohibits the manufacture, storage,
distribution or sale of Gutkha and Panmasala (containing
tobacco or nicotine) and any other products marketed
separately to constitute as Gutkha or Panmasala as final
product by whatsoever name called, whether packaged
or unpackaged and/or sold as one product or though
packaged as separate products, sold or distributed in
such a manner so as to easily facilitate mixing by the
consumer in the whole of the Union territory of
Puducherry for a further period of one year from
18-11-2019.
