this Court inclined to pass an Award as per the terms
of settlement ended between the parties on 27-02-2020.
7. In the result, the Award is passed in terms of
settlement arrived between both parties on 27-02-2020
and as per the Joined Memorandum of settlement,
dated 27-02-2020 filed before this Court. No cost.

Whereas, Thiru S. Stalin Rabindranath while working
as Secondary Grade Teacher (now re-designated as
Primary School Teacher) in GPS, Murungapakkampet,
Puducherry, was granted Extraordinary Leave for one
year from 01-06-1992 to 31-05-1993 without Medical
Certificate, for his visit to France, with instruction to
report for duty on or before 01-06-1993 failing which it
will be presumed that he has resigned his job with effect
from 01-06-1993 as per the undertaking given by him;
And whereas, Thiru S. Stalin Rabindranath did not
join duty, and therefore a show cause notice was issued
to him by the Deputy Director of Education (Women),
Puducherry vide No.7870/ DDE(W)/ Estt./E4/95/354, dated
22-05-1995, inter alia, seeking his explanation for not
joining duty;
And whereas, in reply to the abovesaid letter,
Thiru S. Stalin Rabindranath had submitted a letter,
dated 26-06-1995 to the Depuy Director of Education
(Women), Puducherry from France requesting for
extension of EOL till end of the academic year 1995-96
citing poor health condition of his wife. However, he
did not care to join duty all along. After a lapse
(unauthorized absence from duty) of more than 25 years
i.e., on the verge of attaining the age of 60 years, he
tried to take advantage of the situation by offering to
join duty;
And
whereas, Thiru S. Stalin Rabindranath,
subsequently filed O.A. No. 310/00040/2019 in the
Hon’ble CAT, Madras Bench. The Hon’ble CAT,
disposed the O.A on 28-01-2019 with the direction “To
consider the representations of the applicant vide letter,
dated 12-08-2015 and 29-03-2018 in accordance with law
and pass a reasoned and Speaking Order within a period
of three months from the date of receipt of copy of this
order”;
And whereas, in compliance with the orders, dated
28-01-2019 of the Hon’ble CAT, Madras Bench, a
Speaking Order rejecting his request was issued vide
No. 04021/DSE/Estt.-IV/C/2019, dated 04-09-2019 in the
light of the extant legal provisions and rules in force.
And whereas, Rule 12 of the CCS (Leave) Rules,
1972, stipulates inter alia that no Government Servant
shall be granted leave of any kind for a continuous
period exceeding five years. Further, it states that a
Government Servant who remains absent from duty for
a continuous period exceeding five years other than on
foreign service, with or without leave, shall be deemed
to have resigned from the Government Service;
And whereas, Thiru S. Stalin Rabindranath was on
unauthorized absence from 01-06-1993 till the date of
attaining the age of 60 years (i.e., on 31-03-2019); he
has deserted Government Service;
Now, therefore, the Lieutenant-Governor is pleased
to order that Thiru S. Stalin Rabindranath, Secondary
Grade Teacher (now redesignated as Prirmary School
Teacher) in GPS, Murungapakkampet, Puducherry,
is deemed to have resigned from Government Service
with effect from the forenoon of 01-06-1993. He shall
not be entitled for any payment from the Government.

NOTIFICATION
In pursuance to the Guidelines of Centrally
Sponsored Scheme of Pradhan Mantri Adarsh Gram
Yojana(PMAGY) issued by Ministry of Social Justice
and Empowerment, for constitution of State Level
Committee to ensure integrated development of the
selected villages with more than 50% SC population under
the Centrally Sponsored Scheme of Prathan Mantri
Adarsh Gram Yojana (PMAGY), the Lieutenant-Governor,
Puducherry, is pleased to approve the Constitution of
State Level Committee for the Welfare of SC/ST in the
Union territory of Puducherry. Accordingly, composition
of the State Level Committees along with its functions
and frequency of meeting are as follows:
A. STATE-LEVELADVISORY COMMITTEE (SAC):
(I) Functions:
(1) Address broad policy issues and ensure
convergence in the implementation of the scheme.
(2) Monitor implementation of the Scheme, and
(3) Issue supplementary implementation guidelines
from time to time.
(II) Frequency of Meeting:

serve the purpose of gap filling while saturation in
infrastructure and improvement of socio-economic
indicators is achieved by way of convergence with
various Central and State Schemes. The Committee
will ensure that Need Assessment is carried out and
the Action Plan and Progress Reports are monitored
as per the Scheme Guidelines in the State.

found incidental to the functioning of the “Project
Monitoring Unit (PMU)” and shall meet at least once
in six months.

2. The “Project Monitoring Unit (PMU)” shall, but,
not limited to monitor and oversee all aspects on the
key project parameters such as compliance of the
conditions precedent, adherence to time lines,
assessment of performance, remedial measures for
curing defaults, imposition of penalty, levy and
collection of user charges, processing of ongoing
litigations, arbitration proceedings, compliance with the
instructions of Project Authority, etc. and submit
monthly reports at regular intervals to the “Performance
Review Unit (PRU)” of Karaikal Port.
3. The Committee may examine any other issue(s)
found incidental to the functioning of the “Project
Monitoring Unit (PMU)” and shall meet at least once
in three months.

NOTICE OF SALE OF LAND
It is hereby notified that the undermentioned lands selected out of those attached in satisfaction of arrears of
Commercial Tax and penalty amount due by M/s. Srinivas Build Tech (India) Pvt. Ltd., Puducherry, the present
registered land holder and a revenue defaulter will be sold by public auction on 30th day of December 2020 (or other
day to which the sale may be adjourned), at the following place and time and the lands will be knocked down to the
highest bidder.
Place : In front of the M/s. Srinivas Gardens in the village of Manapet in the Revenue village Manapet of
in Bahour Taluk of the region and also in the Government e-auction System web portal (www.eauction.gov.in)
Time : 11.00 a.m.
2. The current revenue payable by the purchaser on the land for the whole (or remainder, as the case may be)
of the current fasli in ` 23,13,76,384 along with 12% accrued interest thereon, the arrears as shown in detail in the
statement at foot.
3. Purchasers will be required to deposit 15 percent of the purchase money at the time of sale, and if they fail
to pay the remainder of the purchase money within 30 days from the day of sale, the money deposited by them shall
be liable to forfeiture.
4. When such deposit shall not be made, nor the remaining purchase money paid up the lands will be resold
at the expense and risk of the first purchaser.
5. Persons bidding at a sale may be required to state whether they bid on their own account or as agents, and
in the latter case to deposit a written authority signed by their principals, otherwise, their bids may be rejected.
6. The sale shall be stayed if the defaulter or other person acting on his behalf or claiming an interest in the
land tenders the full amount of the arrears of revenue with interest and other charges, provided such tender be made
before sunset on the day previous to that appointed for the sale.
7. The sale will not be final, until confirmed by the Collector or other officer empowered in that behalf, and
a period of thirty days will be allowed between sale and confirmation to admit of parties aggrieved by any proceedings
in connection with such sales presenting appeals. On confirmation of the sale, the lands will be registered in the name
of the purchaser and a certificate of sale signed and sealed by the Collector will be granted to him.
8. It is to be distinctly understood that Government are not responsible for errors either in the description
of the lands or in their estimated extent.
9. Purchasers will also understand that the assessment payable to Government on the land will be liable to
alteration at any general revision of the land revenue settlement of the district.
