Government under section 368(3) of the Puducherry

Municipalities Act, 1973 and section 109 (1) of

Puducherry Village and Commune Panchayats Act, 1973,

closure of all the Slaughter House, Arrack & Wine

shops and shops selling meat, fish, pork, beef,

chicken, etc., in all the Municipal and Commune

Panchayat limits in the Union territory of Puducherry

on the occasion of “Thiruvalluvar Day”, “Saint

Vallalar Arutperunj Jothi Day”, “Mahaveer Jayanthi”

and “Gandhi Jayanthi” every year on the respective

date of celebration declared by the Government of

Puducherry.

Whereas, the managements of (i) Rathnaa Talkies,

Anna Salai, Puducherry, (ii) M/s. Ashok Theatre, Villianur,

Puducherry, (iii) M/s. Raja Talkies, Anna Salai,

Puducherry, (iv) JR Cinemas, Kamaraj Salai, Puducherry,

(v) M/s. Murugaa Theatre, Thattanchavady, Puducherry,

(vi) The Cinema Providence, Puducherry, have applied

for grant of exemption from certain provisions of the

Puducherry Shops and Establishments Act, 1964, to

conduct special morning shows on account of

screening new Tamil films;

And whereas, the Lieutenant-Governor, Puducherry,

has by Notification in G.O. Ms. No. 9/95/Lab., dated

07-04-1995 under sub-section (1) of section 52 of the

Puducherry Shops and Establishments Act, 1964,

authorized the Secretary to Government, Labour

Department, Puducherry, to exercise the powers of the

Government under section 6 of the said Act, relating to

exemption;

Now, therefore, in exercise of the powers conferred

by section 6 of the said Act, the Secretary to Government,

Labour Department, Puducherry, hereby exempts

the aforesaid Theaters from the provisions of the

sections 16(1), 17(1), 17(2) and 18 of the Puducherry

Shops and Establishments Act, 1964 for conducting

special morning shows as detailed below:

The conduct of special shows shall be subject to the

following conditions:–

(i) Every person employed shall be paid overtime

wages for the period of work done by him in excess

of 8 hours in a day or 48 hours in a week.

(ii) The person employed shall be given rest interval

of at least half-an-hour for every four hours of work.

(iii) The management should obtain permission

from the authorities concerned wherever necessary.

(iv) In case, the said screening of the new film

does not take place, this Notification shall have no effect.

(v) The SOPs issued in respect of COVID-19 like

wearing of mask, social distancing, seating capacity,

etc., by the Department of Revenue and Disaster

Management, Puducherry, shall be strictly adhered to.
