Whereas, an Award in I.D (L) No. 27/2018, dated

06-03-2021 of the Industrial Tribunal-cum-Labour Court,

Puducherry in respect of the Industrial Dispute between

the management of M/s. Puducherry Distilleries Limited,

Ariyapalayam, Puducherry and the Union workmen

represented by Puducherry Distilleries Limited

Employees Welfare Union, Lawspet, Puducherry, over

Pay Scale revision has been received;

Now, therefore, in exercise of the powers conferred

by sub-section (1) of section 17 of the Industrial

Disputes Act, 1947 (Central Act XIV of 1947), read with

the notification issued in Labour Department’s G.O. Ms.

No. 20/91/Lab./L, dated 23-05-1991, it is hereby directed

by the Secretary to Government (Labour) that the said

Award shall be published in the Official Gazette,

Puducherry.

This case coming on this day for hearing before me

in the presence of Thiru R.T. Shankar, Advocate, for the

petitioner and Thiru B. Mohandoss, Advocate for the

respondent and the petitioner’s Counsel has endorsed

for not pressing this petition, upon hearing and

perusing the records, this Court passed the following:

AWARD

1. This Industrial Dispute arises out of the reference

made by the Government of Puducherry, vide G.O. Rt.

No. 71/AIL/Lab./T/2018, dated 04-05-2018 of the Labour

Department, Puducherry, to resolve the following

dispute between the petitioner and the respondent, viz.,

(i) Whether the dispute raised by the Union

workmen Puducherry Distilleries Limited Employees

Welfare Union against the management of

M/s. Puducherry Distilleries Limited, Puducherry,

over revision of Scale of Pay from ` 4,500-125-7,000

to ` 5,000-150-8,000 for the post of Lab Chemist to

Thiru S. Neelakandan, Lab Chemist and Thiru

L. Manohar, Supervisor, as per the recommendations

of the Fifth Central Pay Commission, implemented by

the Government of Puducherry vide G.O. Ms. No. 55/

97/F3, dated 15-10-1997 is justified or not? If justified,

what relief Thiru S. Neelakandan, Lab Chemist and

Thiru L. Manohar, Supervisor are entitled to?

(ii) To compute the relief if any, awarded in terms

of money if, it can be so computed?

2. Today, when the case came for hearing, in view

of the endorsement made by the petitioner’s Counsel,

this petition is dismissed as not pressed. No cost.

HEALTH SECRETARIAT

NOTIFICATION

Whereas, the Union territory of Puducherry is

threatened with the outbreak of dangerous epidemic

disease, namely, Mucormycosis, among immune-

compromised patients, especially COVID-19 patients

being treated with steroids;

Whereas, there is urgent need to control and manage

the disease;

Now, therefore, in exercise of the powers conferred

under section 2 of the Epidemic Diseases Act, 1897, the

Lieutenant-Governor of Puducherry is pleased to make

the following regulations, namely:-

1. These regulations may be called the Puducherry

Epidemic Diseases (Mucormycosis) Regulations, 2021.

2. In these regulations, unless the context otherwise

requires “Epidemic Disease” means, Mucormycosis.

3. All the healthcare facilities (Government and

private) will follow the guidelines for screening,

diagnosis, management of Mucormycosis, issued by

Ministry of Health and Family Welfare, Government

of India/Indian Council of Medical Research/

Government of Puducherry, as amended from time to

time.

4. All the healthcare facilities (Government and

Private) will report each and every suspected or

confirmed case of Mucormycosis to Health Department

through the State Integrated Disease Surveillance

Programme.

5. No person/institution or organization will

spread any information or material for management

of Mucormycosis without prior permission from

Health Department, Puducherry.

6. Notice for disobeying the Notification: Director

of Health Services will review any violation by any

person/institution or organization of the notification

or any order issued under these regulations.

If, disobeying is disclosed, a notice would be issued

by the Director of Health Services to such person/

institution or organization, indicating the offence/

irregularity committed.

7. The reply of person/institution or organization

received against the notice will be reviewed by the

Director of Health Services, if, reply is not received

within stipulated time of receipt of the notice or if,

the reply is found unsatisfactory, and it is confirmed

that the person/institution or organization has

disobeyed regulations, the Director of Health Services

will take the necessary action against the delinquent

person/institution or organization as per section 3 of

the Epidemic Diseases Act, 1897.

8. Any person/institution or organization disobeying

these regulations or order issued under these

regulations shall be deemed to have committed as

offence punishable under section 188 of Indian Penal

Code (45 of 1860).

9. Protection to persons acting under these

regulations: No suit or legal proceedings shall lie

against any person for anything done or intended to

be done in good faith under these regulations.

10. These regulations shall come into force at

once and shall remain valid for one year from the date

of publication.
