NOTIFICATION

Whereas, an Award in I.D (L) No. 19/2003, dated

09-03-2021 of the Industrial Tribunal-cum-Labour Court,

Puducherry, in respect of the Industrial Dispute between

the management of M/s. ACE Glass Containers Limited,

Puducherry and Pondicherry State Trade Union of

Owens Built Limited, Puducherry, over non-employment

of ninety workers has been received;

Now, therefore, in exercise of the powers conferred

by sub-section (1) of section 17 of the Industrial

Disputes Act, 1947, (Central Act XIV of 1947), read with

the notification issued in Labour Department’s G.O. Ms.

No. 20/91/Lab./L, dated 23-5-1991, it is hereby directed

by the Secretary to Government (Labour) that the said

Award shall be published in the Official Gazette,

Puducherry.

This case coming on this day for hearing before me

in the presence of Thiru R. Mugunthan, Advocate, for the

Petitioner and Thiru R. Padmanabhan and Thiru L. Sathish,

Advocate for the 1st Respondent, Thiru K. Ravikumar

and Thiru Doraisamy, Advocates, for the Respondents

2 to 7, upon hearing and perusing the records, this Court

passed the following:

AWARD

1. This Industrial Dispute arises out of the reference

made by the Government of Puducherry, vide G.O. Rt.

No. 102/Lab./AIL/J/2003, dated 23-07-2003 of the Labour

Department, Puducherry, to resolve the following

dispute between the petitioner and the respondents, viz.,

(i) Whether the alleged non-employment of ninety

workers by the management of M/s. ACE Glass

Containers Limited, Pondicherry and Six Contractors

viz., (1) Harikrishna Contract, Mr. N. Tamilarasan

(2) Manohar Contract; Mr. Manohar (3) Mani

Contract, Mr. Mani (4) Mahendiran Contract,

Mr. Mahendiran (5) Sun Flower Land Scapping

Mr. Chellapandian (6) Sri Meenatchi Amman Contract,

R. Ravi, as per details at Annexure-I, is justified or not?

If not justified, what remedies they are entitled to?

(ii) To compute the relief if any, awarded in terms

of money if, it can be so computed?

2. Today, when the case came for hearing, both

parties called absent. Notice served to Rl and R7. For

others postal cover returned. R4 died. For R2, R3, R5

and R6 returned as intimation given. For petitioner also

postal cover returned as intimation given. Further, in the

earlier hearing on 15-02-2021 also petitioner notice

returned as unclaimed. Hence, this industrial dispute is

closed for non-appearance of parties.
