GOVERNMENT OF PUDUCHERRY
LABOUR DEPARTMENT
(G.O. Rt. No. 137/Lab./S/2022,
Puducherry, dated 26th August 2022)
NOTIFICATION
Whereas, the management of M/s. The Cinema
Providence, Providence Mall, Puducherry, have applied
for grant of exemption from certain provisions of the
Puducherry Shops and Establishments Act, 1964, to
conduct special morning shows on account of
screening new films;
And whereas, the Lieutenant-Governor, Puducherry,
has by Notification in G.O. Ms. No. 9/95/Lab., dated
07-04-1995 under sub-section (1) of section 52 of the
Puducherry Shops and Establishments Act, 1964,
authorized the Secretary to Government, Labour
Department, Puducherry, to exercise the powers of the
Government under section 6 of the said Act, relating to
exemption;
Now, therefore, in exercise of the powers conferred
by section 6 of the said Act, the Secretary to
Government, Labour Department, Puducherry, hereby
exempts M/s. The Cinema Providence, Providence
Mall, Puducherry, from the provisions of the sections
16(1), 17(1), 17(2) and 18 of the Puducherry Shops and
Establishments Act, 1964, for conducting special
morning free shows as per Table below:

The conduct of the special shows shall be subject
to the following conditions:
1. Every person employed shall be paid overtime
wages for the period of work done by him in excess
of 8 hours in a week.
2. The persons employed shall be given rest
interval of atleast half-an-hour for every four hours
of work.
3. The management should obtain permission
from the authorities concerned wherever necessary.
4. In case, the said screening of the new film does
not take place, this notification shall have no effect.
5. The SOPs issued in respect of COVID-19 like
wearing of mask and other conditions issued by the
Department of Revenue and Disaster Management,
Puducherry, shall be strictly adhered to.

NOTIFICATION
Whereas, the Government is of the opinion that an
industrial dispute has arisen between the management
of M/s. Swadeshi Cotton Mills (A Unit of Swadeshee –
Bharathee Textile Mills Limited, Puducherry)
(A Government of Puducherry Undertaking) and the
Pondicherry Textile Mills Labour Union, over promotion
as per seniority to Thiru D. Muniyandi, in respect of
the matter mentioned in the Annexure to this order;
And whereas, in the opinion of the Government, it is
necessary to refer the said dispute for adjudication;
Now, therefore, by virtue of the authority delegated
vide G.O. Ms. No. 20/91/Lab./L., dated 23-05-1991, of
the Labour Department, Puducherry, to exercise the
powers conferred by clause (d) of sub-section (1) of
section 10 of the Industrial Disputes Act, 1947 (Central
Act XIV of 1947), it is hereby directed by the Secretary
to Government (Labour) that the said dispute be referred
to the Industrial Tribunal, Puducherry, for adjudication.
The Industrial Tribunal, Puducherry, shall submit the
Award within 3 months from the date of issue of
reference as stipulated under sub-section (2-A) of
section 10 of the Industrial Disputes Act, 1947 and in
accordance with rule 10-B of the Industrial Disputes
(Central) Rules, 1957. The party raising the dispute shall
file a statement of claim complete with relevant
documents, list of reliance and witnesses to the
Industrial Tribunal, Puducherry, within 15 days of the
receipt of the order of reference and also forward a copy
of such statement to each one of the opposite parties
involved in the dispute.

(i) Whether the dispute raised by the Petitioner’s
Union “Pondicherry Textile Mills Labour Union”,
against the management of M/s. Swadeshi Cotton Mills
(A Unit of Swadeshee – Bharathee Textile Mills Limited,
Puducherry), over promotion to Thiru D. Muniyandi,
as Head Guard, based on seniority is legal and
justified? If justified, give appropriate directions?
(ii) To compute the relief if any, awarded in terms
of money if, it can be so computed?

and the Naam Thamizhar Thozhilalargal Nala Sangam,
over non-employment of Thiru C. Shanmugavel, in
respect of the matter mentioned in the Annexure to this
order;
And whereas, in the opinion of the Government, it is
necessary to refer the said dispute for adjudication;
Now, therefore, by virtue of the authority delegated
vide G. O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of the
Labour Department, Puducherry, to exercise the powers
conferred by clause (c) of sub-section (1) of section 10
of the Industrial Disputes Act, 1947 (Central Act XIV
of 1947), it is hereby directed by the Secretary to

entitiled to?

Undertaking) and All Trade Unions of Swadeshee-Sri Bharathee Textile Mills, over closure and legal dues payable
to 67 regular employees and 262 casual employees in respect of the matter mentioned in the Annexure to this
order;
And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;

GOVERNMENT OF PUDUCHERRY
LABOUR DEPARTMENT

NOTIFICATION
Whereas, the Government is of the opinion that an
industrial dispute has arisen between the management
of M/s. Vinayaka Mission’s Medical College and
Hospital, Kottucherry Post, Karaikal and Vinayaga
Missions Thozhilalar Munnetra Sangam, over promotion
Thiru R. Pandian and 3 others. in respect of the matter
mentioned in the Annexure to this order;
And whereas, in the opinion of the Government, it is
necessary to refer the said dispute for adjudication;
Now, therefore, by virtue of the authority delegated
vide G.O. Ms. No. 20/91/Lab./L., dated 23-05-1991, of
the Labour Department, Puducherry, to exercise the
powers conferred by clause (d) of sub-section (1) of
section 10 of the Industrial Disputes Act, 1947 (Central
Act XIV of 1947), it is hereby directed by the Secretary
to Government (Labour) that the said dispute be referred
to the Industrial Tribunal, Puducherry, for adjudication.
The Industrial Tribunal, Puducherry, shall submit the
Award within 3 months from the date of issue of
reference as stipulated under sub-section (2-A) of
section 10 of the Industrial Disputes Act, 1947 and in
accordance with rule 10-B of the Industrial Disputes
(Central) Rules, 1957. The party raising the dispute shall
file a statement of claim complete with relevant
documents, list of reliance and witnesses to the
Industrial Tribunal, Puducherry, within 15 days of the
receipt of the order of reference and also forward a copy
of such statement to each one of the opposite parties
involved in the dispute.
ANNEXURE
(a) Whether the dispute raised by the Union
Vinayaga Missions Thozhilalar Munnetra Sangam,
Karaikal, against the management of M/s. Vinayaka
Mission’s Medical College and Hospital, Kottucherry
Post, Karaikal, over promotion to 4 workers
namely, (1) Thiru R. Pandian, (2) Tmt. P. Indrani,
(3) Ms. A. Vanitha and (4) Thiru Sarathirajan are
justified?
(b) If justified, to what relief the workmen
represented by the Union are entitled to?
(c) To compute the relief if any, awarded in terms
of money if, it can be so computed?
